"ABSTRAK
Tulisan ini menganalisis tentang strategi manajemen krisis oleh humas Lembaga Penjamin Simpanan LPS dalam melakukan proses penanganan bank gagal, baik dalam bentuk likuidasi maupun penyelamatan bank gagal. Kepiawaian humas LPS dalam melakukan strategi manajemen krisis menjadi krusial karena performa tersebut dapat memengaruhi kepercayaan publik terhadap institusi bank dan industri perbankan secara keseluruhan, yang berdampak pada kondisi stabilitas ekonomi nasional. Dengan menggunakan konsep krisis dan manajemen krisis dari W. Timothy. Coombs, tulisan ini mencoba melihat bagaimana LPS mengimplementasikan strategi manajemen krisis dalam proses penanganan bank gagal, dalam rangka mencegah dan meredam kepanikan publik serta menjaga kepercayaan publik terhadap kinerja LPS dan reliabilitas industri perbankan secara keseluruhan dalam rangka turut berkontribusi untuk menjaga stabilitas ekonomi nasional.
ABSTRACT
This paper analyzes the crisis management strategy by public relations of Indonesia Deposit Insurance Corporation IDIC in handling bank resolution processes, either in the form of bank liquidation or bank recovery. The excellent performance of IDIC rsquo s public relations in crisis management is crucial because it influences public trust toward bank institutions and Indonesian banking industry as a whole, that will affect the condition of national economic stability. Using the concept of crisis and crisis management suggested by W. Timothy Coombs, this paper aims to capture on how IDIC implement the crisis management strategy in bank resolution processes, in order to prevent panic attack of the public and to maintain public trust to IDIC rsquo s performance and to the reliability of banking industry as a whole, as an effort to contribute in maintaining the national economic stability."

Sebagai salah satu unsur penting dalam jaring pengaman sistem keuangan khususnya dibidang perbankan, Lembaga Penjamin Simpanan (LPS) memiliki peranan untuk menjaga stabilitas keuangan Indonesia. Krisis ekonomi global pada tahun 2008 mengharuskan LPS meningkatkan Nilai Penjamin Simpanan. Penelitian ini bertujuan untuk mengetahui alasan LPS meningkatkan Nilai Penjamin Simpanan berdasarkan Undang-Undang Nomor 24 Tahun 2004 Tentang Lembaga Penjamin Simpanan sebagaimana telah diubah dengan Undang-Undang No. 7 Tahun 2009 dan peraturan perundang-undangan yang berlaku, menganalisis kemungkinan penurunan Nilai Penjamin Simpanan LPS serta hubungannya dengan penerapan risk-based premium di Indonesia untuk menjaga stabilitas sistem keuangan Indonesia. Penelitian ini merupakan penelitian kepustakaan yang bersifat yuridis-normatif. Data yang dikumpulkan dengan studi kepustakaan. Hasil dari penelitian ini adalah berdasarkan Pasal 11 UU LPS dimungkinkan terjadi penurunan terhadap Nilai Penjamin Simpanan LPS. Berdasarkan alasan peningkatan Nilai Penjamin Simpanan pada tahun 2008, yaitu adanya ancaman krisis ekonomi, UU LPS mengatur apabila alasan tersebut telah teratasi maka besaran Nilai Penjamin Simpanan dapat disesuaikan kembali. Maka berdasarkan hal ini, dimungkinkan untuk menurunkan Nilai Penjamin Simpanan LPS.

As one of the important elements in the financial safety net, especially in banking system, Indonesia Deposit Insurance Corporation (IDIC) has a big role to keep the stability of Indonesia?s financial system. The global economic crisis in 2008 requires IDIC increase the Deposit Insurance Coverage. This studies aims to determine the reaseon IDIC increase the coverage based on Law No. 24 of 2004 on the Indonesia Deposit Insurance Corporation (IDIC) as amended by Act No. 7 of 2009, to analyze the possibility to decrease the deposit insurance coverage and its relation to the risk-based premium in Indonesia in order to maintan the stability of the financial system. This research is a normative juridical research. The data were collected by literature study. The results for this study are based Article 11 of IDIC Act, there is a posibility to adjust the Deposit Insurance Coverage. "Tulisan ini menganalisis bagaimana ketentuan hukum mengatur kerugian keuangan negara dan pertanggungjawabannya dalam kaitannya dengan resolusi terhadap bank dalam resolusi oleh Lembaga Penjamin Simpanan sebagai lembaga deposit insurance, di mana status kekayaan Lembaga Penjamin Simpanan sebagai kekayaan negara yang terpisahkan mengakibatkan kerugian dalam pelaksanaan resolusi terhadap bank dalam resolusi oleh Lembaga Penjamin Simpanan dapat dipertanggungjawabkan sebagai kerugian negara. Dalam pelaksanaan sebuah resolusi terhadap bank dalam resolusi oleh Lembaga Penjamin Simpanan, dapat hadir kerugian yang diderita oleh Lembaga Penjamin Simpanan berkat biaya resolusi terhadap bank dalam resolusi melalui beberapa metode, di mana kerugian dalam resolusi patut dipandang seutuhnya sebagai bagian dari pelaksanaan fungsi dan tujuan Lembaga Penjamin Simpanan serta tidak dapat dianggap sebagai kerugian keuangan negara. Komparasi dengan wewenang yang dimiliki lembaga yang setara di Singapura dapat menjadi pertimbangan dalam pengembangan lebih lanjut terkait dengan status kekayaan lembaga deposit insurance, pendanaan resolusi dan metode resolusi sehingga liabilitas yang dapat hadir bagi Lembaga Penjamin Simpanan diminimalisasi, dengan adanya pemisahan tegas antara keuangan negara dengan keuangan lembaga deposit insurance, pendanaan resolusi dari iuran yang ditarik secara khusus sektor perbankan, dan adanya metode bail-in dalam pilihan metode resolusi terhadap bank.

This paper analyzes how the law regulates state losses and state losses responsibility in regards to resolution of bank in resolution by the Indonesian Deposit Insurance Corporation as a deposit insurance agency, where the status of the wealth of the Indonesian Deposit Insurance Corporation as a separated state wealth implies that losses in resolution towards bank in resolution can be held accountable as state financial losses. In the event of a resolution towards a bank in resolution by the Indonesian Deposit Insurance Company, losses may be incurred by the Indonesian Deposit Insurance oorporation due to costs of resolution towards bank in resolution via few methods, in which losses incurred must be viewed fully as a part of the implementation of the function and purpose of the Indonesian Deposit Insurance Corporation and cannot accounted as state financial losses. Comparison with the authority held by the equivalent institutions in Singapore can be considered in further developments in regards to the status of the wealth of the deposit insurance agency, funding of resolution schemes and methods of resolution so that liabilities of the Indonesian Deposit Insurance Corporation can be minimalized, with the strict separation between public finance and the finance of the deposit insurance agency, resolution schemes funding using special fees withdrawn from the banking sector, and with the existence of the bail-in method in the options methods of resolution towards bank."

Salah satu fungsi Lembaga Penjamin Simpanan LPS adalah menjamin dana masyarakat yang tersimpan di perbankan. Bank-bank peserta penjaminan harus membayar premi, yang selama ini besarnya sama flat untuk semua. Premi jenis ini memiliki beberapa kelemahan, seperti terjadinya pengalihan risiko risk shifting , subsidi silang cross subsidy , investasi berisiko tinggi excessive risk-taking , dan itikad bisnis yang buruk moral hazard . Berbagai model telah dikembangkan untuk mendukung penggunaan premi yang berbasiskan risiko risk based . Namun semua pendekatan tersebut menggunakan data informasi pasar, sehingga hanya efektif digunakan untuk bank-bank yang sahamnya diperdagangkan secara aktif di bursa efek.Penelitian ini mengusulkan metode perhitungan premi penjaminan simpanan berbasiskan risiko, yang dapat diterapkan untuk semua bank di Indonesia, baik yang sahamnya sudah terdaftar listed di bursa efek, maupun yang belum. Besarnya premi berbasiskan risiko yang seharusnya dibebankan kepada masing-masing bank dihitung dengan model discrete lower barrier option Wibowo, 2007 . Pada pendekatan ini evaluasi nilai aset -dan penutupan bank yang bermasalah- tidak perlu menunggu saat kewajiban liability jatuh tempo. Nilai pasar dari aset bank yang menjadi masukan utama dari model ini diestimasikan dengan menggunakan model arus kas Cooperstein, Pennacchi, dan Redburn 1995 , sementara volatilitasnya diestimasi dengan menggunakan prosedur iterasi Loeffler dan Posch 2007 . Perbedaan tarif premi antar bank kemudian diperiksa kesesuaiannya dengan perbedaan karakteristik serta rasio-rasio keuangan yang menjadi proxy dari risiko bank

ABSTRACT
One function of the Indonesian Deposit Insurance Corporation Lembaga Penjamin Simpanan ndash LPS is to provide insurance to public funds deposited in banks. Banks in Indonesia must participate in the insurance program, which premium has sofar been set equal for all flat rate . This type of premium is known to have several drawbacks, such as causing risk shifting and cross subsidy, as well as encourage bankers to involve in excessive risk taking and moral hazard. Various models have been developed to support use of risk based premiums, in which banks are charged based on their individual risks. Those approaches, however, are based primarily on stock market information. They are thus applicable only for the banks whose shares are actively traded in the stock exchange.This research proposes an alternative method to calculate risk based insurance premium which can be applied to all banks in Indonesia, including those whose shares have not been listed on the market. The varying premiums which should be charged to each bank are calculated with a discrete lower barrier option model Wibowo, 2007 . This model allows that evaluation of bank asset value ndash and decision to close a default bank may be effected at times not coincide with maturity of its liabilities. The model uses market value of bank assets as its primary input, which shall be estimated using a cash flow model set forth by Cooperstein, Pennacchi, and Redburn 1995 . Asset rsquo s volatility as secondary input is estimated using iterative procedure proposed by Loeffler and Posch 2007 . Variation in premium rates between banks have then been reviewed for their correlations with their different characteristics and financial ratios as proxy of the banks rsquo risk."

"Skripsi ini membahas mengenai kewenangan Lembaga Penjamin Simpanan (LPS) dalam melaksanakan resolusi bank gagal (bank resolution) terhadap Bank Selain Bank Sistemik yang mengalami permasalahan solvabilitas. Dalam hal ini, berdasarkan Undang-Undang Nomor 24 Tahun 2004 tentang Lembaga Penjamin Simpanan, LPS memiliki tugas yang salah satunya adalah melaksanakan penyelesaian bank gagal bank selain bank sistemik. Setelah berlakunya Undang-Undang Nomor 9 Tahun 2016, dan Undang-Undang Nomor 2 Tahun 2020 menyebabkan kewenangan LPS dalam melaksanakan resolusi bank gagal Bank Selain Bank Sistemik mengalami perbedaan dengan sebagaimana yang diatur di dalam Undang-Undang Nomor 24 Tahun 2004.
Oleh karena terdapat perbedaan tersebut, maka skripsi ini akan membahas mengenai pengaturan yang akan berlaku bagi LPS untuk sebagai pedoman penyelesaian Bank Selain Bank Sistemik dan perbedaan mengenai kewenangan LPS dalam melaksanakan penyelesaian permasalahan solvabilitas Bank Gagal Yang Tidak Berdampak Sistemik baik sebelum dan sesudah berlakunya Undang-Undang Nomor 9 Tahun 2016.
Bentuk penelitian skripsi ini adalah yuridis-normatif yang menghasilkan tipologi penelitian deskriptif. Hasil dari penelitian ini menemukan beberapa perbedaan mengenai kewenangan LPS dalam menyelesaikan masalah solvabilitas Bank Selain bank Sistemik antara pengaturan yang berlaku berdasarkan Undang-Undang Nomor 24 Tahun 2004, Undang-Undang 9 Tahun 2016 dan Undang-Undang Nomor 2 Tahun 2020.

The focus of this research is about the authority of Indonesia Deposit Insurance Corporation (IDIC) in carrying out the resolution of the failing bank (bank resolution) that does not pose systemic risk that has solvency problems. Based on Law Number 24 Year 2004 on Deposit Insurance Corporation, IDIC has duties, that which one of that duties is to formulate, determine and implement the resolution policy for failing banks that do not pose as a systemic risk. After the enactment of the Law Number 9 Year 2016 and the Law Number 2 Year 2020, Duties of IDIC have changed with as regulated in the Law Number 24 Year 2004.
Because there are have differences, this study will also to examine the differences regarding the authority of IDIC in carrying out the resolution of the failing bank (bank resolution) of the bank that does not pose as a systemic risk that has solvency problems, both before and after enactment of Law Number 9 Year 2016.
The research uses the normative-juridical approach with a descriptive typology. This research discover that the Law Number 9 Year 2016 and the Law Number 2 Year 2020 has some different with the Law Number 24 Year 2004

"Penelitian ini membahas mengenai pengaruh program penjaminan simpanan (deposit insurance) oleh LPS terhadap disiplin pasar dengan menggunakan data time series dari 120 bank umum selama kurun waktu Januari 2003 sampai dengan Desember 2013. Dengan menggunakan empat variasi yang menjadi variabel terikat berupa tingkat suku bunga deposito 1 bulan/TD, tingkat suku bunga deposito 3 bulan/TD3, tingkat suku bunga deposito rata-rata 1 dan 3 bulan/MRATE, dan Interbank Call Money, serta dengan variabel bebas berupa : (i) variabel risiko bank yang terdiri dari : NPL, LDR, BOPO, ROA, dan CAR; (ii) variabel kontrol yang terdiri dari Growth GDP dan Inflasi; dan (iii) variabel dummy, diperoleh hasil penelitian Kebijakan program penjaminan simpanan LPS yang di-proxy oleh dummy, efektif menekan tingkat bunga pada lag 4 periode. Dengan kata lain, kebijakan LPS pada saat ini membutuhkan masa tenggang waktu yang relatif lama yaitu 4 triwulan untuk dapat berpengaruh pada kedisplinan pasar.

This research explain about The Impact Analysis of Deposit Insurance Program by The Indonesia Deposit Insurance Corporation to Market Dicipline using the time series data from 120 banks from January 2003 to December 2013. I use Ordinary Least Squares/OLS method with four variations of dependent variables (time deposit rate 1 month, 3 months, average rate in 1 month and 3 months, and interbank call money), as well as the independent variable such as: (i) the bank's risk variables consisting of: NPL, LDR, ROA, ROA, and the CAR Ratios; (ii) the control variables consisting of GDP Growth and Inflation; and (iii) a dummy variable, the result of this research is deposit insurance program by IDIC with proxy by dummy, effectively reduces the interest rate on the lag 4 period. In other words, the policy of IDIC during the grace period requires a relatively long time, that is 4 quarters, to be able to influence the market discipline."

"Tesis ini membahas mengenai perlindungan hak pemegang saham publik dalam pengambilalihan Bank Gagal yang berstatus terbuka oleh Lembaga Penjamin Simpanan. Permasalahan yang diangkat dalam penulisan ini ketika Lembaga Penjamin Simpanan memiliki hak untuk mengambil alih segala hak, wewenang, kepemilikan, kepengurusan dari Bank Gagal bermaksud untuk menjual saham pemegang saham publik. Penulisan tesis ini menggunakan metode kepustakaan dengan data sekunder sebagai sumber datanya. Pengambilalihan Bank Gagal oleh Lembaga Penjamin Simpanan berdasarkan penyerahan hak kepemilikan melalui RUPS oleh para pemegang saham yang menyerahkan, serta Penyertaan Modal Sementara yang kemudian dikonversi menjadi saham. Kedua mekanisme tersebut menjadikan Lembaga Penjamin Simpanan sebagai pemegang saham mayoritas, namun tidak dapat menghilangkan pengakuan terhadap kepemilikan pemegang saham publik. Lembaga Penjamin Simpanan tidak memiliki hak untuk menjual saham pemegang saham publik yang tidak dikuasai oleh Lembaga Penjamin Simpanan apabila tidak diserahkan oleh pemilik hak sebagaimana dimaksud dalam teori property rule. Pengambilalihan yang dilakukan oleh Lembaga Penjamin Simpanan bukan bertujuan untuk menguasai Bank, namun untuk melaksanakan perintah Undang-Undang. Ketentuan take over, mewajibkan untuk dilakukan tender offer terhadap sisa saham. Peraturan No. IX.H.1. mengenai ketentuan tender sukarela mengecualikan tender offer terhadap pengambilalihan yang dilakukan berdasarkan perintah Undang-Undang. Ketentuan ini membuktikan pemegang saham publik tetap memiliki hak terhadap saham yang dimilikinya. Mengingat lamanya waktu untuk melakukan revisi terhadap Undang-Undang, maka Lembaga Penjamin Simpanan dapat meminta dilakukan uji materiil ke Mahkamah Konstitusi untuk meminta penjelasan terhadap siapa yang dimaksud dengan pemegang saham dan apa yang dimaksud dengan seluruh saham.

This thesis describes the protection of public shareholder rights in the takeover process of open-status Failing Bank performed by the Deposit Insurance Corporation. The main focus of this discussion is on the event the Deposit Insurance Corporation posits that it reserves the right to take over all rights, authority, title of ownership and management of the Failing Bank, and generalizes that the liquidation of the stocks includes those belonging to public shareholders. This thesis applies library research method using secondary data as data sources. The handling process of Failing Bank by Deposit Insurance Corporation is performed by surrendering of rights and powers of General Shareholders Meeting in part of the Failing Bank, and provision of temporary capital placement in part of the Deposit Insurance Corporation which is further conversed into shares. The dual mechanisms deems Deposit Insurance Corporation as the major shareholder, however still withstand recognition to the title of ownership of public shareholders. Deposit Insurance Corporation does not reserve the right to sell shares belonging to public shareholders that are not surrendered to the Deposit Insurance Corporation, as described in the theory of Property Rule. The takeover is performed by Deposit Insurance Corporation not for the purpose of acquiring the Bank, but as execution of the Law. The laws governing performance of takeover stipulates that the remaining shares must be disclosed in form of bidding offer or tender offer. Law number IX.H.1. governing voluntary tender excludes tender offer in the event of takeover prescribed by Law. This regulation substantiates that public shareholders reserves rights over their shares. Considering the time taken to conduct revision on the said law, Deposit Insurance Corporation may appeal for judicial review in the Constitutional Court to gain verification as to the reference for shareholder and as to the reference of shares as cited in the law.

Penelitian ini bertujuan untuk mengetahui pengaruh implementasi penjaminan simpanan, rasio kecukupan modal (CAR) dan non performing loan (NPL) terhadap tingkat deposit, risiko moral hazard dan net interest margin (NIM) bank umum di Indonesia periode 2000-2012. Penelitian ini menggunakan metode regresi data panel.Hasil dari penelitian ini menunjukkan implementasi penjaminan simpanan, CAR dan NPL mempengaruhi tingkat deposit bank umum secara negatif.Implementasi penjaminan simpanan terbukti signifikan meningkatkan risiko moral hazard sementara variabel CAR dan NPL berpengaruh negatif terhadap risiko moral hazard. Temuan lain menunjukkan NIM dipengaruhi positif oleh implementasi penjaminan simpanan dan CAR, tetapi dipengaruhi negatif oleh NPL.

ABSTRACT
This study aims to determine the effect of the implementation of deposit insurance, capital adequacy ratio (CAR) and non-performing loan (NPL) towards deposit, moral hazard risk and net interest margin (NIM) of commercial banks in Indonesia from 2000 to 2012. This study uses panel data regression method. The results of this study demonstrate the implementation of deposit insurance, CAR and NPL affects commercial bank deposits negatively. Implementation of deposit insurance were proven significantly increases moral hazard risk while the variable CAR and NPL negatively affect moral hazard risk. Other findings showed NIM is affected positively by the implementation of deposit insurance and the CAR, but negatively affected by the NPL."

Perbankan merupakan sektor yang memiliki peran sangat vital, sebagai lembaga intermediasi industri perbankan mempunyai sifat khusus yang tidak dimiliki oleh sektor jasa keuangan lain. Industri perbankan sebagai penggerak dan jantung dalam suatu perekonomian negara. Saat ini, bank digital tengah berlomba-lomba menawarkan suku bunga simpanan tinggi hingga 10%, untuk menarik minat masyarakat. Hal tersebut berpotensi memiliki risiko yang merugikan bagi para nasabahnya. Dari hasil penelitian ini, perlu menjadi perhatian penting bagi para nasabah karena apabila suku bunga simpanan yang diperjanjikan antara bank dengan nasabah penyimpan melebihi tingkat bunga penjaminan simpanan, maka simpanan nasabah tersebut tidak akan dijamin. Lembaga Penjamin Simpanan pada dasarnya hanya akan menjamin pembayaran simpanan nasabah tersebut hingga Rp2.000.000.000,00 (dua miliar rupiah). Proses penyelesaian sengketa nasabah dalam mengajukan ganti rugi jika mengalami kerugian dapat ditempuh secara non-litigasi dan litigasi. Secara non-litigasi dengan mengajukan permohonan penyelesaian sengketa ke Lembaga Alternatif Penyelesaian Sengketa Sektor Jasa Keuangan (LAPS SJK), sedangkan dengan cara litigasi dengan mengajukan proses penyelesaian sengketa di pengadilan, dimana semua pihak yang bersengketa saling berhadapan satu sama lain untuk mempertahankan hak-haknya di muka pengadilan. Dalam menyelenggarakan dan menawarkan produk dan/layanan digital, Bank Digital wajib memperhatikan risiko-risiko yang ada dan keamanannya guna memenuhi ketentuan pelindungan hukum nasabah. Bank Digital harus dapat memenuhi dan mematuhi prosedur pelaksanaan, yaitu prinsip kepercayaan (fiduciary principle),prinsip kerahasiaan (confidential principle), dan prinsip kehati-hatian (prudential principle), dan prinsip mengenal nasabah. Keempat prinsip tersebut harus ditunjukkan dalam menjalankan kebijakan maupun teknis perbankan.


Banking is a sector that has a very vital role, as an intermediary institution the banking industry has special characteristics that are not shared by other financial services sectors. The banking industry is the driving force and heart of a country's economy. Currently, digital banks are competing to offer high deposit rates of up to 10%, to attract public interest. This has the potential to have detrimental risks for its customers. From the results of this study, it should be an important concern for customers because if the deposit interest rate agreed between the bank and the depositor exceeds the deposit guarantee interest rate, the customer's deposit will not be guaranteed. The Indonesia Deposit Insurance Corporation will basically only guarantee the payment of customer deposits up to Rp2,000,000,000.00 (two billion rupiah). The process of resolving customer disputes in applying for compensation if they experience losses can be pursued in non-litigation and litigation. Non-litigation by submitting a dispute resolution application to the Alternative Dispute Resolution Institution for Financial Services Sector (LAPS SJK), while by litigation by submitting a dispute resolution process in court, where all parties to the dispute face each other to defend their rights before the court. In organizing and offering digital products and services, Digital Banks must pay attention to the existing risks and security in order to fulfill the provisions of customer legal protection. The Digital Bank must be able to fulfill and comply with the implementation procedures, namely fiduciary principle, confidential principle, prudential principle, and know your customer principle. These four principles must be demonstrated in carrying out banking policies and techniques.

"ABSTRAK
Tesis ini membahas mengenai aspek hukum dalam pencabutan izin usaha Bank Perkreditan Rakyat yang dimana kewenangan tersebut dahulu terdapat di Bank Indonesia yang kemudian pada tanggal 1 Januari 2014 berpindah ke Otoritas Jasa Keuangan. Pada tanggal 29 Januari 2014 untuk pertama kalinya Otoritas Jasa Keuangan mencabut izin usaha dalam surat Keputusan Dewan Komisioner OJK Nomor 4/KDK.03/2014BPR VOX Modern Danamitra yang berkedudukan di tangerang. Masalah yang timbul adalah bagaimanakah persayaratan dan prosedur dalam mencabut izin usaha BPR tersebut oleh Otoritas Jasa Keuangan, kemudian akibat hukum setelah dicabutnya izin usaha BPR terhadap nasabah. Untuk menjawab permasalahan tersebut dilakukan penelitian dengan menggunakan metode penelitian studi kepustakaan yang bersifat yuridis normatif.
Kesimpulan dari penelitian ini adalah Pencabutan izin usaha Bank Perkreditan Rakyat Vox Modern Danamitra dikarenakan bank tersebut tidak dapat mengatasi kesulitan yang membahayakan kelangsungan usahanya yang telah dinilai oleh OJK maka OJK sesuai dengan Pasal 37 ayat 2 UU Nomor 7 Tahun 1992 Tentang Perbankan sebagaimana telah diubah dengan UU Nomor 10 Tahun 1998 jo Pasal 9 ayat 2 Peraturan BI Nomor 7/34/PBI/2005 tentang tindak lanjut penanganan terhadap BPR dalam status pengawasan khusus, mencabut izin usaha dari BPR Vox Modern Danamitra dengan surat Keputusan Dewan Komisioner OJK Nomor 4/KDK.03/2014. Akibat hukum bagi nasabah penyimpan di Bank Perkreditan Rakyat yang dicabut izin usahanya dalam UU Nomor 24 Tahun 2004 Tentang Lembaga Penjamin Simpanan sebagaimana telah diubah dengan UU Nomor 7 Tahun 2009 dilaksanakan dalam bentuk penjaminan yang dilaksanakan oleh LPS atas simpanan nasabah BPR tersebut.

ABSTRACT
This examines about legal aspect in revoke the operating license of the Rural Bank that where such authority formerly contained in Bank Indonesia then on 1 January 2014 moved to the Indonesia Financial Services Authority (OJK). On 29 January 2014 for the first time the Financial Services Authority revoke the operating license of BPR VOX Modern Danamitra domiciled at tangerang on the decree of OJK?s board of commissioners No 4/KDK.03/2014. The problem that arises is how the requirement and procedures for revoke the operating license of rural bank by Financial Services Authority (OJK), then the legal consequences after the revocation of operating license rural bank to customers. In order to solve such problem a research is done by using literal study research method having the characteristic of legal normative.
The conclusion of this research is the revocation of the operating license of the BPR VOX Modern Danamitra because the bank could not cope with the difficulties endangering its survival that have been assessed by the OJK, the OJK in accoirdance with article 37 paragraph (2) of Act Number 7 of 1992 concerning Banking as amended by Act Number 10 of 1998 jo article 9 paragraph (2) BI regulation No. 7/34/PBI/2005 regarding the subsequent handling of the rural bank under special surveillance, revoke the operating license of BPR Vox Modern danamitra with the decree of OJK?s board of commissioners No 4/KDK.03/2014. Legal consequences for customer?s saving in rural bank that has been revoke the operating license in Act Number 24 of 2004 concerning the Deposit Insurance Corporation (?LPS?) as amended by Act Number 7 of 2009 implemented in the form of guarantees executed by LPS on customer deposits BPR.
