"[ ABSTRAK
Saham Perseroan Terbatas Tertutup merupakan benda yang dapat dipindahkan
kepemilikannya melalui perjanjian hibah dan/atau perjanjian jual beli.
Pemindahan hak atas saham melalui perjanjian ini harus tunduk pada persyaratan
dan juga tata cara yang diatur dalam peraturan perundang-undangan maupun
Anggaran Dasar Perseroan agar sah secara hukum. Apabila syarat-syarat tersebut
tidak terpenuhi maka pemindahan hak atas saham itu dapat dikatakan sebagai
sebuah perbuatan melawan hukum, sebagaimana dapat ditemui dalam putusan No.
604/Pdt.G/2011/PN.Jkt.Sel. Dua permasalahan utama yang akan dibahas dalam
penulisan ini adalah bagaimana tata cara pemindahan hak atas saham Perseroan
Terbatas Tertutup melalui perjanjian jual beli dan hibah serta bentuk perbuatan
melawan hukum yang terjadi dalam perkara di atas. Penulisan dalam skripsi ini
menggunakan pendekatan yuridis normatif dengan metode penelitian
kepustakaan. Berdasarkan hasil analisis skripsi ini, pelanggaran unsur esensialia
dalam suatu perjanjian pemindahan hak atas saham merupakan sebuah perbuatan
melawan hukum. Oleh karena itu penting bagi para pihak untuk patuh serta
memahami ketentuan umum perjanjian dan juga tata cara pemindahan hak atas
saham yang telah diatur dalam peraturan perundang-undangan.

Penelitian ini merupakan penelitian kepustakaan yang bersifat yuridis normatif dengan memperhatikan teori hukum dengan putusan pengadilan atas permasalahannya. Hasil penelitian ini memberitahukan bahwa surat keterangan waris adalah surat dibawah tangan dan menyarankan bahwa surat keterangan waris ini diatur lebih jelas mengenai kewenangan untuk membuatnya sehingga tercipta unifikasi dalam hukum waris Indonesia."

"Pemberhentian Notaris secara tidak hormat oleh Menteri berdasarkan usulan dari Majelis Pengawas Pusat yang tidak sesuai dengan ketetapan dalam perundang-undangan bisa dikategorikan sebagai perbuatan melawan hukum. hal ini berdasarkan kasus notaris x yang telah diberhentikan dari jabatannya atas dasar surat  keputusan Kementrian Hukum dan Hak Asasi Manusia Nomor AHU.55. AH. 02.04. Tahun 2019 tentang Pemberhentian dengan Tidak Hormat dari Jabatan Notaris dan berdasarkan usulan dari Majelis Pengawas Pusat dalam surat Putusan nomor 11/B/MPPN/XII/2018. permasalahan dalam penelitian ini mengenai prosedur pemberhentian tidak hormat Notaris x sebagaimana terdapat dalam Putusan MPPN nomor 11/B/MPPN/XII/2018 apabila dikaitkan dengan ketentuan yang tercantum  Undang Undang Nomor 30 Tahun 2004 tentang Jabatan Notaris dan korelasi antara keputusan Kementrian Hukum dan Hak Asasi Manusia Nomor AHU.55. AH. 02.04. Tahun 2019 tentang Pemberhentian Dengan Tidak Hormat dari Jabatan Notaris  atas nama X dari jabatan notaris di Kota Y yang telah dikuatkan melalui Putusan 294/K/Tun/2021 dengan unsur perbuatan melawan hukum sebagaimana terdapat dalam Putusan Mahkamah Agung No 294/K/TUN/2021 Metode yang digunakan dalam penelitian ini adalah metode penelitian doktrinal melalui pendekatan kasus putusan pengadilan serta pendekatan perundang-undangan. Kesimpulan dari penelitian ini adalah (i) prosedur pemberhentian tidak hormat Notaris X yang berdasarkan Putusan MPPN 11/B/MPPN/XII/2018 apabila dikaitkan dengan ketentuan dalam pasal 12 dan  13 Permenkumham Nomor 16/2021 tidaklah sesuai dengan penerapannyang seharusnya diterapkan sehingga hal trrsebut merupakan suatu perbuatan melawan hukum yang dilakukan oleh menteri. (ii) korelasi pemberhentian yang dilakukan oleh Menteri atas keputusannya memberhentikan Notaris X secara tidak hormat dengan unsur perbuatan melawan hukum yang tidak di pertimbangkan dalam Putusan 501/Pdt/2020/PT.DKI terkait keputusan pemberhentian yang tidak dihadiri oleh Notaris X pada dasarnya hal tersebut telah melanggar Pasal 12 Permenkumham 16/2021dan hal ini seharusnya dipertimbangkan oleh hakim.

Stamp duty is a tax on documents, basically optimizing state revenue to finance national development independently towards the Indonesian people. The affixing of electronic stamps and digital signatures is actually not related because they have different functions so that the affixing of the two can be done whichever comes first, especially now that the affixing is through electronics. The problem in this thesis is the Urgency of the Use of Electronic Stamp Duty as a Seal on Proving the Authenticity of Electronic Documents and the role of the Government in regulating electronic stamp duties and organizing tracing back proof of the authenticity of electronic documents. The research method used is normative juridical. The results of the study The urgency of using electronic stamp duty on authentic electronic documents is that it functions as a marker that the stamp duty has been paid in full, the purpose of which is to obtain additional state revenue budget. The government in regulating electronic stamp duties functions as a supervisor and policy maker for the distribution and distribution of electronic stamps carried out by building an electronic stamp system, maintaining the system and preparing integration into systems related to this system. then from the tracing system, the registration process is carried out at Peruri by recapitulating the serial number of electronic stamps. Peruri has a central database that records the status of electronic stamps that have been used."

"Dalam pelaksanaan lelang, disyaratkan adanya Nilai Limit yang ditetapkan oleh Penjual (kreditur) dengan nilai pasar sebagai prioritas pertama (batas atas) dan nilai likuidasi sebagai alternatif terakhir (batas bawah). Tidak diaturnya ketentuan mengenai kewajaran penetapan Nilai Limit mengakibatkan banyaknya gugatan perdata yang diajukan oleh pihak tereksekusi untuk menuntut ganti kerugian karena objek jaminannya dijual jauh dibawah harga pasar. Penelitian ini akan menjawab bagaimanakah pemenuhan unsur perbuatan melawan hukum dalam penetapan nilai limit lelang hak tanggungan dalam suatu gugatan perdata dan bagaimanakah metode valuasi objek lelang berupa tanah dan bangunan berdasarkan Appraisal atau
Penilai Publik, dengan menggunakan metode penelitian yuridis-normatif melalui kajian terhadap bahan pustaka maupun data sekunder, serta studi kasus terhadap pertimbangan Majelis Hakim dalam perkara perdata nomor 213/Pdt.G/2020/PN Bdg. Bahwa pemenuhan unsur perbuatan melawan hukum dalam penetapan nilai limit lelang hak tanggungan dalam suatu gugatan perdata seharusnya tidak hanya dilakukan dengan menguji unsur pengertian PMH dalam arti sempit yaitu ada atau tidaknya pelanggaran terhadap hak subjektif orang lain dan/atau pelanggaran atas kewajiban hukum pelaku, namun juga PMH dalam arti luas yakni bertentangan dengan kesusilaan baik, ataupun bertentangan dengan kepatutan, ketelitian, dan kehati-hatian. In carrying out an auction, a Limit Value is required to be determined by the Seller
(creditor) with market value as the first priority (upper limit) and liquidation value
as the last alternative (lower limit). The absence of provisions regulating the
fairness of limit value determination results in many civil lawsuits being filed by
executable parties seeking compensation because the collateral object is sold far
below the market price. This research will answer how the fulfillment of the element
of unlawful acts in determining the limit value of auctions in a civil lawsuit and the
valuation method for auction objects in the form of land and buildings based on
Appraisals or Public Appraiser, using juridical-normative research methods
through a study of literature and secondary data, as well as case studies on the
considerations of the Panel of Judges in the civil case number 213/Pdt.G/2020/PN
Bdg. The fulfillment of the element of unlawful act in determining the limit value of
the mortgage auction in a civil lawsuit should not only be carried out by examining
the element of unlawful act in the narrow sense, namely whether or not there is a
violation of the subjective rights of other people and/or a violation of the
perpetrator's legal obligations, but also unlawful act in a broad sense which is
contrary to good decency, or contrary to propriety, thoroughness, and prudence.
Then, to determine the basic value to be used as the limit value, each
appraiser/appraiser in valuing the auction object must use the guidelines in the
Indonesian Appraisal Standard (SPI) 205 issued by the Indonesian Appraiser

"Perbuatan melawan hukum dalam perkara No. 26/PDT/2012/PTR telah memenuhi unsur perbuatan melawan hukum sebagaimana diatur dalam Pasal 1365 Kitab Undang-Undang Hukum Perdata. Hal ini disebabkan pihak penggugat selaku pihak yang merasa dirugikan telah dapat membuktikan kepemilikan hak atas tanah yang di ajukan ke pengadilan negeri Pekanbaru serta dikuatkan oleh putusan Pengadilan Tinggi Riau Nomor 26/PDT/2012/PTR yang telah mempunyai kekuatan hukum tetap, serta telah memenuhi unsur perbuatan melawan hukum dari segi hukum pidana yang melanggar tergugat melanggar Peraturan Pemerintah Pengganti Undang Undang No. 51 Tahun 1960 Tentang : Larangan Pemakaian Tanah Tanpa Ijin Yang Berhak Atau Kuasanya. Sehingga telah terbukti tergugat telah melakukan perbuatan melawan. Metode yang digunakan dalam penelitian ini adalah metode yuridis normatif, penarikan kesimpulan penelitian ini dilakukan dengan metode logika deduktif.
Kesimpulan yaitu dimana tergugat telah melakukan Penguasaan dan Penggunaan Tanah secara Illegal, yaitu Tergugat telah melanggar pasal 2 Undang-Undang Nomor 51 Prp Tahun 1960 tentang Larangan pemakaian Tanah Tanpa Izin Yang Berhak Atau Kuasannya mengatakan ?Dilarang memakai tanah tanpa ijin yang berhak atau kuasanya yang sah, sehingga sangsi pidana sebagaimana tercantum dalam Pasal 6 Undang-Undang Nomor 51 Prp Tahun 1960 tentang Larangan pemakaian Tanah Tanpa Izin Yang Berhak Atau Kuasannya.

The unlawful act in case No. 26 / PDT / 2012 / PTR has met the elements of unlawful act as provided for in Article 1365 of Civil Code. This is due to the plaintiff as the party who feels aggrieved has been able to prove ownership of land rights in the District Court of Pekanbaru and upheld by the High Court Pekanbaru No. 26 / PDT / 2012 / PTR who already have permanent legal force, and has fulfilled the elements of unlawful act in terms of criminal law that violates. The defendant violated Government Regulation of law No. 51 Year 1960 About: Prohibition of Use of Land Without Permission of The Eligible or The Proxy. So that has been proven that the defendant be liable of unlawful act. The method used in this research is normative juridical methods. At this research, the conclusion draws will be carried out by the method of deductive logic.
It is concluded that the judge did not consider the terms of the criminal law that where the defendant has done Tenure and Land Use in Illegal, that Defendant had violated Article 2 of Law No. 51 Prp of 1960 on Prohibition of Use of Land Without Permission of The Eligible or The Proxy, which mentioned "Banned uses the land without permission entitled or authorized proxy ", so the judges should deciding cases consider this matter with the settlement dispute that the defendant not only got the sanction for damages materially, but exposed to penal sanctions as contained in Article 6 of Law No. 51 Prp Year 1960 on Prohibition of Use of Land Without Permission of The Eligible or The Proxy."

"Maraknya kasus peletakan jaminan fidusia atas benda milik pihak ketiga dalam perjanjian pembiayaan dalam praktik penjaminan fidusia telah menjadi permasalahan krusial terkait perlindungan hukum terhadap para pihak, yakni pemilik asli benda dan kreditur sebagai Penerima Fidusia, salah satunya adalah sebagaimana dalam Putusan No. 975 K/Pdt/2020. Tulisan ini menganalisis bagaimana keabsahan peletakan jaminan fidusia atas benda milik pihak ketiga dalam perjanjian pembiayaan dan bagaimana hakim menyikapi kasus penjaminan fidusia atas benda milik pihak ketiga dalam perjanjian pembiayaan pada Putusan No.975 K/Pdt/2020 serta bagaimana tindakan dalam putusan tersebut dapat dikualifikasikan sebagai suatu perbuatan melawan hukum dalam perspektif hukum perdata. Tulisan ini disusun dengan menggunakan metode penelitian doktrinal dengan pendekatan analitis. Hasil penelitian menyimpulkan bahwa penjaminan fidusia atas benda milik pihak ketiga dalam perjanjian pembiayaan adalah sah apabila dilakukan berdasarkan persetujuan pemilik benda sebagaimana ditafsirkan dari Pasal 1 angka 5 UU Jaminan Fidusia. Kemudian, tindakan Para Tergugat menjaminkan fidusia atas benda milik pihak ketiga dalam Putusan No. 975 K/Pdt/2020 sudah tepat dinyatakan bukan merupakan perbuatan melawan hukum, tetapi alasan pertimbangan hakimnya keliru karena seharusnya yang mendasari perbuatan tersebut dinyatakan bukan melawan hukum adalah karena pada waktu proses pembiayaan dijalankan objek tersebut bukanlah milik Penggugat.

The rise in cases of placing fiduciary guarantees on objects belonging to third parties on financing agreements in the practice of fiduciary guarantees has become a crucial problem related to legal protection for the parties, namely the original owners of the objects and creditors as Fiduciary Recipients, one of which is as in Decision No. 975 K/Pdt/2020. This paper analyzes the validity of placing fiduciary guarantees on objects belonging to third parties in financing agreements and the judges respond to cases of fiduciary guarantees on objects belonging to third parties in financing agreements in Decision No. 975 K/Pdt/2020 and how the actions in this decision can be qualified as tort from a civil law perspective. This article is conducted using doctrinal research methods with an analytical approach. The results of the research conclude that fiduciary guarantees for objects belonging to third parties in financing agreements are valid if carried out based on the agreement of the object owner as interpreted from Article 1 point 5 of the Fiduciary Guarantee Law. Then, the actions of the Defendants in placing fiduciary guarantees to objects belonging to third parties in Decision No. 975 K/Pdt/2020 were rightly declared not to be unlawful, but the reason for the judge's consideration was wrong because the basis for the action to be declared lawful was because at the time the financing process was carried out the object did not belong to the Plaintiff."

"Tesis ini menggunakan penelitian yuridis normatif Jenis datayang digunakan adalah data sekunder tipologi penelitian eksplanatoris jenis bahan hukum adalah bahan hukum primer hukum sekuder dan hukum tersier Metode analisis data yang digunakan digunakan adalah metode analisis data kualitatif Penulisan tesis mengangkat pokok permasalahan pertimbangan putusan pengadilan negeri pengadilan tinggi dan mahkamah agung mengenai perolehan hak atas tanah setelah pembatalan akta jual beli dikaitkan dengan UUPA dan Peraturan Pemerintah Nomor 24 Tahun 1997 tentang Pendaftaran Tanah dan bagaimana akibat hukum batalanya akta jual beli karena adanya perbuatan melawan hukum Berdasarkan Pasal 19 Peraturan Pemerintah Nomor 24 Tahun 1997 tentang Pendaftaran Tanah bahwa akta PPAT hanyalah suatu alat bukti dan tidak menyebut bahwa akta itu adalah suatu syarat mutlak tentang sah tidaknya suatu jual beli tanah Pasal 5 UUPA menyebutkan bahwa Hukum Tanah Nasional kita adalah Hukum Adat yang sifatnya tunai riil dan terang Jual beli adalah merupakan perjanjian maka dalam hal ini berlakulah syarat syarat untuk sahnya perjanjian tersebut sebagaimana ditentukan dalam Pasal 1320 KUHPerdata Jual beli tanah dapat batal demi hukum jika salah satu syarat materil tidak dipenuhi dalam arti penjual bukan merupakan orang yang berhak atas tanah yang dijualnya akibat hukum dari pembuatan akta jual tersebut di atas adalah akta tersebut dianggap tidak pernah ada Adapun sebaiknya jual beli dilakukan dihadapan PPAT dengan dibuktikan dengan AJB dan didaftarkan ke kantor Badan Pertanahan Nasional untuk menjamin kepastian hukum bagi pemegang haknya.

This thesis is a normative juridical research. The type of data that is used is secondary data, explanatory research typology, types of legal materials is the primary legal materials, legal sekuder and tertiary law. Data analysis method used is the method of qualitative data analysis. Thesis raised the subject-matter of judgment ruling court, high courts and the Supreme Court regarding the acquisition of land after the cancellation of the deed of sale associated with the Law and Government Regulation No. 24 of 1997 on Land Registration and how the legal consequences about the cencellation deed of sale due to acts against law. Under Article 19 of Government Regulation No. 24 of 1997 on Land Registration that PPAT deed is only a means of evidence and did not mention that the certificate is a necessary condition of legitimacy of a land purchase. Article 5 of UUPA mentions the National Land Law we are Customary Law that are cash, real and bright. Buying and selling is an agreement, then in this case the operator from the requirements for the validity of the agreement as specified in Article 1320 of the Civil Code. Buying and selling land can be null and void if one of the material requirements are not fulfilled within the meaning of the seller is not the person entitled to the land sold. the legal consequences of the sale deed is the deed mentioned above shall be deemed to have never existed. The purchase should be done before PPAT with evidenced by AJB and registered with the Land Office to ensure legal certainty for rights holders."

"Penyelesaian sengketa konsumen melalui BPSK kerap menimbulkan berbagai permasalahan karena kedudukan BPSK yang acap kali dianggap sebelah mata karena putusan yang dihasilkannya sering dibatalkan dan tidak memiliki kekuatan hukum yang mengikat ketika diajukan keberatan melalui Pengadilan. Padahal, di dalam Undang-Undang Perlindungan Konsumen Pasal 54 Ayat (3) menjelaskan bahwa putusan dari majelis hakim BPSK adalah final dan juga mengikat, tetapi hal tersebut dipatahkan dengan Pasal 56 Ayat (3) Undang- Undang Perlindungan Konsumen yang menimbulkan ketidakpastian hukum terhadap kekuatan hukum tersendiri di dalam putusan BPSK. Rumusan masalah yang digunakan adalah Bagaimana kewenangan yang dimiliki oleh Badan Penyelesaian Sengketa Konsumen sebagai lembaga penyelesaian sengketa alternatif konsumen? Dan Bagaimana analisis hukum terhadap keberadaan Badan Badan Penyelesaian Sengketa Konsumen dalam putusan Pengadilan Negeri Kota Bekasi Nomor 295/Pdt.Sus/BPSK/2020/PN Bks Jo. Putusan Nomor 175K/Pdt.Sus-BPSK/2021? Metode penelitian yang digunakan oleh Penulis adalah yuridis normatif dengan pendekatan perundang-undangan dan kasus. Hasil penelitian menjelaskan bahwa keberadaan putusan Badan Penyelesaian Sengketa Konsumen sebagai lembaga penyelesaian sengketa alternatif ketika putusan yang dikeluarkan oleh BPSK tersebut diajukan keberatan oleh Para Pihak menimbulkan suatu ketidakpastian hukum. Hal tersebut dikarenakan dalam pelaksanaannya putusan BPSK cenderung dibatalkan dan/atau dikatakan BPSK tidak berwenang melakukan mengadili atas sengketa konsumen yang diajukan. Padahal dalam pelaksanaan dan fakta di lapangannya bahwa tidak sedikit Pengadilan Negeri membatalkan Putusan BPSK yang dapat dibuktikan hubungan hukum dari para pihak yang bersengketa adalah hubungan antara pelaku usaha dan konsumen. Putusan Pengadilan Negeri Kota Bekasi Nomor 295/Pdt.Sus/BPSK/2020/PN Bks adalah putusan yang kemudian memperkuat Putusan Badan Penyelesaian Sengketa Konsumen Kota Bekasi Nomor 011/BPSK-BKS/2020 yang memberikan sanksi denda administratif kepada Tergugat atau Pelaku Usaha dalam perbuatannya yang menyebabkan tidak sampainya paket barang yang dipesan oleh Penggugat dan adanya kesengajaan yang dilakukan oleh Karyawan Tergugat atau Pelaku Usaha yang mengganti jenis pengiriman dan juga pengurangan berat sehingga adanya selisih harga dan menyebabkan Penggugat atau Konsumen mengalami kerugian. BPSK memiliki kewenangan melakukan penyelesaian sengketa konsumen yang didasarkan pada perbuatan melawan hukum, sebagaimana Putusan BPSK Kota tersebut yang memperkuat karena hakim dalam pertimbangannya menjelaskan bahwa perbuatan yang dilakukan oleh Tergugat adalah perbuatan melawan hukum.

Settlement of consumer disputes through BPSK often gives rise to various problems because BPSK's position is often underestimated because the decisions it produces are often annulled and do not have binding legal force when objections are submitted to the Court. In fact, in the Consumer Protection Law Article 54 Paragraph (3) explains that the decision of the BPSK panel of judges is final and binding, but this is violated by Article 56 Paragraph (3) of the Consumer Protection Law which creates legal uncertainty regarding the power of separate law in the BPSK decision. The problem formulation used is: What is the authority of the Consumer Dispute Resolution Agency as an alternative consumer dispute resolution institution? And what is the legal analysis of the existence of the Consumer Dispute Resolution Agency in the Bekasi City BPSK decision Number 295/Pdt.Sus/BPSK/2020/PN Bks Jo. Decision Number 175K/Pdt.Sus-BPSK/2021? The research method used by the author is normative juridical with a statutory and case approach. The research results explain that the existence of the decision of the Consumer Dispute Resolution Agency as an alternative dispute resolution institution when the decision issued by BPSK is objected to by the Parties creates legal uncertainty. This is because in its implementation BPSK decisions tend to be annulled and/or it is said that BPSK does not have the authority to adjudicate consumer disputes that are submitted. In fact, in practice and in the facts on the ground, quite a few District Courts cancel BPSK decisions which can be proven that the legal relationship of the parties to the dispute is the relationship between business actors and consumers. Bekasi City BPSK Decision Number 295/Pdt.Sus/BPSK/2020/PN Bks is a decision which then strengthens the Decision of the Bekasi City Consumer Dispute Settlement Agency Number 011/BPSK-BKS/2020 which imposes administrative fines on Defendants or Business Actors for their actions. causing the package of goods ordered by the Plaintiff not to arrive and the Defendant's Employees or Business Actors deliberately changing the type of delivery and also reducing the weight, resulting in a price difference and causing the Plaintiff or Consumer to suffer losses. BPSK has the authority to resolve consumer disputes based on unlawful acts, as confirmed by the BPSK City Decision because the judge in his consideration explained that the actions carried out by the Defendant were unlawful."

"Dewasa ini, seringkali dapat ditemukan adanya perbuatan melawan hukum yang dilakukan oleh anak di bawah umur. Sebagai contoh antara lain adalah dalam kasus kecelakaan lalu lintas yang berdasarkan data mayoritasnya melibatkan anak di bawah umur, kemudian adanya keterlibatan anak di bawah umur sebagai pelaku penyerangan warga oleh gangster, dan juga perundungan. Tidak jarang perbuatan melawan hukum ini kemudian menuntut Pertanggungjawaban hukum dari anak di bawah umur, yang padahal jika ditinjau menurut undang-undang, maka karena faktor usianya dan/atau status perkawinannya, ia dianggap belum cakap secara hukum. Di sisi lain untuk menjawab permasalahan tersebut dan juga untuk melindungi pihak yang tidak cakap, undang-undang mengenal adanya lembaga perwakilan bagi pihak yang tidak cakap. Oleh karenanya terhadap Pertanggungjawaban atas perbuatan yang dilakukan oleh anak di bawah umur pada umumnya dilimpahkan kepada orang tua ataupun wali dari anak tersebut, hal ini dimungkinkan mengingat keberadaan Pasal 1367 KUH Perdata yang pada dasarnya menyatakan bahwa seseorang juga bertanggung jawab atas kesalahan pihak lain yang berada dalam tanggungannya. Dalam praktiknya Pertanggungjawaban tersebut menjadi suatu isu yang menarik, oleh karena adanya keberagaman terkait definisi anak berdasarkan ketentuan hukum yang berlaku di Indonesia. Yaitu dimana dalam beberapa ketentuan hukum tersebut terdapat batasan usia yang berbeda yang digunakan sebagai ukuran kedewasaan selain daripada status perkawinan, atau dalam ketentuan hukum lain seperti halnya hukum adat, maka terdapat standar ukuran yang berbeda untuk menentukan kedewasaan seseorang, yaitu dimana dalam hal ini kedewasaan tidak ditentukan berdasarkan usia, melainkan faktor lain. Selain itu, harus dilihat pula sejauh mana orang tua/wali harus bertanggung jawab atas perbuatan melawan hukum yang dilakukan oleh anak di bawah umur yang berada dalam tanggungan mereka, hal ini yang mana berkaitan erat dengan konsep pertanggungjawaban yang berlaku, dimana dalam perbuatan melawan hukum dikenal beberapa konsep Pertanggungjawaban yaitu diantaranya adalah liability based on fault, strict liability dan vicarious liability. Berdasarkan hal tersebut maka dalam menganalisa, penulis menggunakan metode penelitian berbentuk yuridis normatif yaitu dengan studi kepustakaan serta metode perbandingan untuk menemukan persamaan dan perbedaan serta kelebihan dan kelemahan pengaturan dan implementasi dari beberapa negara yaitu Indonesia, Austria, dan California. Kesimpulannya, konsep tanggung jawab yang berbeda menghasilkan kriteria yang berbeda bagi orang tua untuk bertanggung jawab dan hal tersebut memiliki kelebihan serta kelemahannya tersendiri.

Unlawful conduct that are committed by minors could be mainly found in the current times. For examples are in the case of Traffic accidents, in which data shows that majority of it are involving minors, or in the case of gangster attack, and even in the case of bullying that also shows involvement of minors as the perpetrators. Oftentimes, these unlawful conducts then demand legal responsibilities from the minors, whom due to their age and/or marital status, are actually considered to be lacking legal capacity according to the law. On the other hand, serving as an answer to these problems and as a protection towards parties who lacks legal capacity, the law has recognized the existence of legal guardian or deputy for those considered to be lacking legal capacity, including minors. Therefore, legal responsibilities that rises out of minors’ unlawful conduct are generally delegated to the parents or guardians who are entitled to custody of the minors, this is given the existence of Article 1367 of Indonesian Civil Code which regulates that an individual shall be responsible not only for the damage caused by their own deeds, but also those that are caused by the action of the individuals they are responsible for, or caused by those under their supervisions. However, in its practice, the very exact legal responsibilities then had become an interesting issue, these are in regard to the various definition of minors according to Indonesian law. In which, there are different standard of age that are seen as a yardstick to determine one’s maturity in various laws that are available in Indonesia, other than that of marital status. In the other hand, a different standard to determine one’s maturity applies in some regulations such as in  customary law, that determine one’s maturity based on other factors rather than one’s ages. Aside from that, it must also be reviewed to what extent parents or guardians could be held responsible for unlawful conduct which committed by minors who are under their care, this is indeed closely related to the concept of legal liabilities in terms of unlawful conduct. In which, there are several concepts of liabilities that are being recognized, namely liability based on fault, strict liability, and vicarious liability. Based on these very reasons, therefore to analyze in regard to this matter the author uses a juridical-normative research method along with comparative method to find similarities and differences, as well as advantages and disadvantages of the existing regulations along with its implementation on various countries, such as Indonesia, Austria, and California. This research concludes that different concept of liabilities results in different criteria for parental responsibilities, each of which comprised its own advantages and disadvantages."

"Perbuatan Melawan Hukum diartikan sebagai suatu perbuatan yang melanggar hukum tertulis maupun hukum tidak tertulis. Dalam hal ini Notaris telah membuat akta pengikatan jual-beli dengan dasar blanko kosong yang telah ditandatangani para pihak sebelumnya. Dalam hal ini bagaimana prosedur pembuatan akta menurut Undang-Undang dan apa akibat hukum terhadap akta tersebut yang dibuat tidak sesuai Undang-Undang serta apa sanksi yang dikenakan terhadap notaris yang melakukan pelanggaran tersebut - dalam penelitian ini menggunakan metode kepustakaan yaitu metode yang memiliki kegiatan mengumpulkan data sekunder yang dapat berupa bahan hukum primer maupun bahan hukum sekunder. Analisa kasus dilakukan terhadap putusan Mahkamah Agung Repiblik Indonesia Nomor : 211 K/Pdt/2006, dan adapun prosedur pembuatan akta notaris yang dibuat oleh (akta relaas) atau dihadapan (akta partij) Notaris dan akibat dari tidak dibuatnya akta menurut Undang- Undang adalah akta tersebut batal demi hukum. Sanksi yang dikenakan pada notaris tersebut bisa berupa sanksi perdata, sanksi pidana, dan sanksi administratif. Dalam hal ini badan peradilan didalam memeriksa suatu perkara kiranya lebih teliti dalam memperhatikan keterangan para saksi, alat bukti, serta teori-teori yang ada.

In this case how the deed manufacturing procedures according to law and what sanctions are imposed on the notary who commited the offens? In this research literature using the methods that have a secondary data gathering activities that can be either primary law materials and secondary legal materials. In this case analysis to the decisions of the Supreme Court of the Republic of Indonesia Number 211 K/Pdt/2006. and as for making procedure that is created by (deed partij) or presence (announcement notarial) deed, and the consequences of the deed not made under the act is the deed is null and void, and sanctions imposed on the notary which are able to form civil sanctions, criminal sanctions, and administratif sanctions. In justice agencies in examing a case presumably more accurate in regard to witnesses, evidence, and existing theories."
