"ABSTRAK
Penelitian ini membahas mengenai bagaimana proses modernisasi pasar
tradisional jika dilihat dari aspek kejahatan negara serta bagaimana viktimisasi
dan reaksi sosial yang ditimbulkan dari kejahatan tersebut. Kejahatan Negara
dalam penelitian ini tidak menunjuk pada kejahatan yang dilakukan oleh Negara
secara utuh tetapi kejahatan yang dilakukan oleh perpanjangan tangan negara atau
agen-agen pemerintahan. Penelitian ini menggunakan studi kasus proses
modernisasi pasar Tradisional Melawai, Blok M, Jakarta Selatan. Dalam upaya
untuk mendapatkan hasil penelitian yang sesuai dengan tujuannya, maka peneliti
menggunakan metode penelitian kualitatif dengan tipe penelitian deskripitif–
analisis. Informan diambil dari tiga pihak yakni PD. Pasar Jaya, mantan pedagang
pasar tradisional Melawai serta Asosiasi pedagang pasar tradisional Melawai
(TIM 21).
Hasil penelitian yang dilakukan menunjukan bahwa pihak PD. Pasar Jaya
yang seharusnya melayani para pedagang berperekonomian lemah berubah
orientasi dan berfokus pada pencarian keuntungan dalam proses modernisasi pasar
tradisional Melawai sehingga mengabaikan kepentingan dari para pedagang.
Kejahatan yang dilakukan oleh pihak PD. Pasar Jaya lebih banyak berupa
pengabaian-pengabaian terhadap hak-hak para pedagang serta adanya konspirasi
pihak PD. Pasar Jaya dengan pihak swasta dengan tujuan memaksimalkan
keuntungan sehingga semakin mempersulit pihak pedagang untuk
memperjuangkan hak-haknya.

ABSTRACT
This study discusses about how the process of traditional market
modernization if viewed from the aspects of states crime and how victimization
and social reaction caused by that crime. State crime in this study does not refer to
the crime committed by the State as a whole, but the crimes committed by an arm
of the state or government agencies. Researchers used a case study of the
modernization process of Melawai traditional market, Blok M, South Jakarta. In
an effort to get the results of the study in accordance with the purpose, the
researchers used qualitative research methods with descriptive-analysis research
type. Informants drawn from the three subjects wich are PD. Pasar Jaya, Melawai
traditional market ex-traders and Melawai Traditional Market association (TIM
21).
The results of this research showed that the PD. Pasar Jaya are supposed to
serve the traders with weak economic level finally changes the orientation and
focused on finding profit in the process of traditional market modernization. PD.
Pasar Jaya are also ignoring the interests of the traders. The crimes committed by
the PD. Pasar Jaya are in the form of omission the rights of the traders and the
existence of the conspiracy between PD. Pasar Jaya to the private sector or
bussiness with the aim of making the traders more difficult to maximize profits
and to fight their rights. "
