"Skripsi ini membahas tentang pengaturan dan penerapan Upah Minimum di Indonesia beserta penerapan Upah Minimum pada Kasus Putusan Pengadilan Hubungan Industrial pada Pengadilan Negeri Surabaya Nomor 87 /G/2015/PHI.SBY. Pada kasus tersebut, terjadinya pelanggaran terhadap ketentuan Upah Minimum Indonesia dalam bentuk pembayaran Upah terhadap Pekerja yang tidak memenuhi ketentuan Upah Minimum Kota Surabaya pada tahun 2014 dan 2015. Tujuan dari penelitian ini adalah untuk mengetahui apakah putusan dalam kasus tersebut sudah sesuai dalam melaksanakan ketetentuan upah minimum indonesia dan ketentuan lain yang berkaitan seperti mengenai Skala dan Struktur Upah . Penelitian ini menggunakan metode penelitian yuridis normatif.

This thesis delves on the topic of Regulation and Implementation of Minimum Wage in Indonesia as well its implementation on Industrial Relations Court Decision in District Court of Surabaya No.87 G 2015 PHI.SBY. within that court decision, there have been violations of minimum wage regulation in form of wage payment for the workers that do not satisfy the requirements of Kota Surabaya Minimum Wage Regulation in year 2014 and 2015. The purpose of this thesis is to understand whether the decision in that case is in accordance to the Indonesian Minimum Wage Regulations and another related regulations such as the requirements of the scale and the structure of the wages . This research will be conducted by using the judicial normative research method."

"ABSTRAKTesis ini membahas perlindungan upah bagi pekerja di Indonesia pasca berlakunya Peraturan Pemerintah No. 78 Tahun 2015. Kondisi pasar kerja yang timpang di Indonesia menyebabkan lemahnya posisi pekerja dalam perundingan upah. Untuk itu pemerintah berperan memberikan perlindungan melalui kebijakan pengupahan. Selanjutnya dibahas mengenai penerapan Peraturan Pemerintah No. 78 Tahun 2015, yang dikhususkan pada penetapan upah minimum dan struktur skala upah di perusahaan. Penelitian menggunakan metode penelitian normatif-empiris dengan mengkaji aspek perlindungan upah dalam pasal-pasal pada Peraturan Pemerintah No. 78 Tahun 2015 dan penerapan ketentuan formula penetapan upah minimum dan struktur skala upah. Jenis data yang digunakan bersifat sekunder dari bahan hukum yang sifatnya perimer, sekunder dan tertier. Hasil dari penelitian memperlihatkan bahwa Peraturan Pemerintah No. 78 Tahun 2015 belum sempurna memenuhi aspek perlindungan upah pekerja dan dalam penerapannya belum secara maksimal dapat dilaksanakan.

ABSTRACTThis thesis discusses wage protection for workers in Indonesia after the enactment of Government Regulation number 78 year 2015. The unfair labor market conditions in Indonesia lead to weaker workers 39 position in wage negotiations. The government has a role in providing protection through wage policy. Further discussed of its implementation devoted to the determination of the minimum wage and structure and scale of wages. This Thesis used normative empiric research method in examining the aspects of wage protection in the articles on Government Regulation no. 78 of 2015 and the application of the provisions of the formula of minimum wage determination and wage scale structure. The result of the research showed that Government Regulation number 78 Year 2015 has not been perfectly fulfilling the wage protection aspect of the workers and in its implementation has not been maximally implemented."
