"United Nations, as the biggest international organization, is in the middle of doing internal reformation regarding the structure enlargement of the Security Council. Indonesia, as the biggest moderate Moslem country in the world is proposed itself to be seated as one of the permanent member of the Security Council. It is expected that this movement will influence the development of international law either directly or indirectly. This article, contains a discussion about the writer's experiences during his appointments as the representatif of Indonesian government in several international conferences concerning human rights and use of the rule of law to keep world peace and security. The discussion has given a better picture of the strong background of the Indonesian role and participation in peace keeping and in guarding the world law order."

The answer is that the Council may not derogate from those provisions of IHL that are of a specifically humanitarian nature or humanitarian ordre public, that derogations from international law or IHL are in any case not to be presumed and that the Council has not derogated in any way from occupation law in the case of the occupation of Iraq since 2003."

"ABSTRAKTesis ini membahas mengenai kebijakan luar negeri yang diambil Indonesia terkait isu nuklir Iran. Indonesia yang bergabung menjadi anggota tidak tetap Dewan Keamanan PBB pada tahun 2007 turut mendukung resolusi nomor 1747 tahun 2007 tentang penjatuhan sanksi terhadap Iran untuk pengembangan nuklir Iran. Kebijakan luar negeri Indonesia ini mengundang perhatian di dalam negeri terutama dari pihak DPR RI yang berujung pada pengajuan hak interpelasi. Dalam Resolusi DK PBB nomor 1803 tahun 2008, Indonesia memilih untuk abstain.Penelitian ini ingin melihat apakah dan bagaimanakah sikap DPR turut menjadi faktor domestik yang menjadi pertimbangan Pemerintah Indonesia dalam memilih kebijakan luar negerinya. Hasil penelitian menunjukkan bahwa DPR RI pasca reformasi memiliki wewenang untuk turut mempengaruhi kebijakan luar negeri dan hubungan luar negeri Indonesia. Dalam kasus kebijakan luar negeri Indonesia mengenai isu nuklir Iran, DPR telah menunjukkan perannya untuk terlibat di dalam proses yang turut mempengaruhi kebijakan luar negeri Indonesia (KLNI) pada tahap tertentu, namun demikian faktor diplomasi bilateral yang dilakukan antara pemerintah Indonesia- Iran tetap menjadi faktor kunci.

ABSTRACTThis thesis discusses Indonesian foreign policy on Iranian nuclear issue. Indonesia who was a non-permanent member of the United Nations Security Council in 2007 voted in favor for resolution number 1747 year 2007, imposing sanctions against Iran for its nuclear development. This has in turn triggered criticism, particularly from the Indonesian House of Representative (DPR RI) that resulted in interpellation. In the United Nations Security Council Resolution number 1803 year 2008, Indonesia decided to abstain.This research looks into whether and how the Parliament is constituting the so called domestic factors for the Government of Indonesia in determining its foreign policy. The research shows that the DPR RI post-reform era holds the power to influence Indonesian foreign policy and its international relations. In the case of Indonesian foregin policy on Iranian nuclear issue, DPR RI has shown its ever expanding role to be involved in the process of influencing Indonesian foreign policy to a certain extent. Nevertheles, bilateral diplomacy between the Government of Indonesia and Iran plays pivotal role."
