"Dalam suatu pekerjaan yang dilakukan pada dasarnya terdapat dua pihak yang terkait yaitu pihak pengusaha sebagai pemberi kerja dan pekerja yang melaksanakan pekerjaan tersebut. Yang tentunya diantara dua pihak ini mempunyai kepentingan yang berbeda, bila pihak pengusaha mempunyai kepentingan agar pekerja menyelesaikan pekerjaan yang diberikan pengusaha sedangkan pihak pekerja mempunyai kepentingan untuk mendapat imbalan atas pekerjaan yang mereka lakukan maka secara tidak langsung timbul suatu hak dan kewajiban diantara mereka. Dengan adanya hak dan kewajiban yang timbul maka tercipta perjanjian diantara mereka dalam hal ini adalah tercipta perjanjian kerja dimana seseorang atau lebih mengikatkan diri pada orang lain untuk melaksanakan suatu pekerjaan.
Pada saat sekarang implementasi dari perjanjian ini dibuat dalam bentuk Perjanjian Kerja Bersama atau PKB, yang pada intinya mengatur mengenai hak dan kewajiban dari masing-masing pihak Hal ini tentunya mempunyai tujuan karena dalam pelaksanaan perjanjian kerja ini tentunya diharapkan tidak terjadi permasalahan, akan tetapi pada praktekya tidak selalu demikian, Pelanggaran terhadap pelaksanaan perjanjian kerapkali terjadi dan paling sering pelanggaran dilakukan oleh pengusaha yang berkaitan dengan hak-hak pekerja dan mengakibatkan terjadinya perselisihan perburuhan antara pengusaha dengan pekerja Berkaitan dengan ini penyusun mencoba untuk mambahas permasalahan mengenai isi dan pelaksanaan terhadap PKB di Bank "X " yang ternyata dalam pelaksanaannya terdapat beberapa penyimpangan yang merugikan bagi pekerja di Bank "X". Dan penyusun juga membahas peran dari PKB dalam menciptakan kepastian hukum bagi pekerja dalam perselisihan perburuhan di Bank "X"."

"Latar Belakang Pembahasan kebebasan berkontrak dalam perjanjian kerja dari segi yuridis menjadi penting, mengingat hal tersebut merupakan masalah yang kontroversial. Di satu sisi terdapat perjanjian kerja yang didasarkan pada kebebasan berkontrak melalui proses tawar menawar (negosiasi) antara pekerja dan pengusaha. Di sisi Iain, terdapat perjanjian kerja yang sudah ditentukan pengusaha (Take it or ieave it) atau tanpa melalui proses tawar menawar (negosiasi). Perundingan tawar menawar terhadap jasa pekerjaan yang dihasiikan oleh pekerja dan pihak pengusaha/pemberi kerja, terlihat sangat menitik-beratkan pada free choice."

"[Sebuah perjanjian pada dasarnya harus memperinci secara tegas hak dan kewajiban dari para pihak. Jika tidak, akan menimbulkan banyak sekali celah yang dapat mempengaruhi pelaksanaan dari perjanjian tersebut. Perjanjian kerja waktu tertentu yang dilakukan oleh pemberi kerja dengan penerima kerja umumnya sama dan biasanya tanpa uraian secara terperinci. Untuk itu perlu dilakukan analisis lebih lanjut apakah isi perjanjian tersebut sudah memenuhi syarat sah perjanjian. Dan apakah perjanjian itu telah melindungi kepentingan dari para pihak. Penelitian ini pada dasarnya bertujuan untuk mengetahui dan memahami keberadaan Perjanjian kerja dan perjanjian kerja waktu tertentu di PT.X apakah sudah memenuhi syarat sah perjanjian dan perlindungan kepentingan para pihak. Selain itu penelitian ini juga bertujuan untuk mengetahui dan memahami bentuk penyelesaian yang dapat dilakukan jika terjadi wanprestasi terhadap pelaksanaan perjanjian kerjasama. Metode yang digunakan dalam penelitian ini adalah yuridis normatife dan wawancara dengan mengutamakan
data sekunder baik berupa bahan hukum primer, bahan hukum sekunder dan bahan hukum tersier. Dari penelitian yang dilakukan diperoleh hasil bahwa kedudukan pekerja pada Perjanjian perjanjian kerja waktu tertentu telah memenuhi syarat sah perjanjian;An agreement basically have to explicitly specify the rights and

Hubungan kerja antara guru dan Jembaga tersebut, terutama lembaga swasta (Yayasan) dilakukan dengan suatu perjanjian kerja ya ng dibuat secara tertulis dan memenuhi syarat-syarat sah nya suatu perjanjian menurut Undang-Undang. Di Yayasan Tarakanita, sebagai suatu lembaga swasta di bidang pend idikan, perjanjian kerja antara Guru dan Yayasan dilakukan dengan .eKWT yang diklasifikasikan ke dalam dua status yaitu PKWT karyawan edukatif puma waktu dan PKWT karyawan edukatif penggal waktu. Hal ini dilaku kan untuk mendapatkan tena ga-tenaga pendid ik yang profesional. Yang masih perlu mendapat perhatian adalah perlindunga n hukumnya yang dicantu mkan dalam PKWT, sehingga karyawa n yang bersangkuta n terl indungi hak-haknya dan merasa aman dalam menjalankan tugas-tugasnya.

A teacher is a professional worker and is a part of the main element of the quality of education. Teachers work in a state institu tion or private institution. Working relationship between teacher and her/his institution, especially private institution (Foundation) is bounded i n a written employmen t agreement accordi ng to the laws. In Tarakanita Foundation. as a private school (that ru ns private schools), employment agreemen t between teacher and Foundation is called Tem porally Employment Agreement, which divided into two categories: Full time educational employees agreement and Part time educational employees agreement. It is the way of Foundation to get professional teachers. The issues are the legal protection of the employees regarding the purpose of the Temporally Employment Agreement, which is to protect the rights of the employees and to make them comfort doing their duties (to give a better place to work)."

"PT. Schering Indonesia adalah sebuah perusahaan industri farmasi dalam bentuk kerja sama pengusaha Indonesia dan Jerman yang telah berdiri sejak tahun 1970 di Jakarta dalam rangka Undang-Undang No.I tahun 1967 tentang Penanaman Modal Asing. Bentuk kerja sama hanyalah dalam hal permodalan dan pemasaran. Sedangkan mengenai hal lain yang menyangkut operasional perusahaan dilaksanakan langsung oleh induk perusahaan yang berkedudukan di Berlin, Jerman. Berdirinya perusahaan ini bersamaan dengan masuknya puluhan jenis industri yang sama namun demikian masing-masing perusahaan memiliki pangsa pasar sedikit berbeda karena hasil produksinya memiliki ciri tersendiri. Dengan demikian perkembangan perusahaan berjalan cukup baik hingga dapat bertahan sampai sekarang. Seiring dengan perkembangan perusahaan ternyata memberikan dampak lain pada perusahaan yaitu timbulnya permintaan perbaikan kesejahteraan oleh para pekerja sesuai ketentuan peraturan yang berlaku di Indonesia. Para pekerja yang sebelumnya hanya sekedar bekerja untuk mendapatkan upah akhirnya menyadari bahwa perusahaan telah menerapkan sistim perjanjian kerja yang menyimpang dari ketentuan undang-undang mengenai ketenagakerjaan yang dikeluarkan oleh Pemerintah Indonesia. Penyimpangan yang dilakukan diantaranya adalah adanya perjanjian kerja waktu tertentu yang seharusnya tidak boleh lebih dari tiga tahun ternyata diantara pekerja sudah banyak yang bekerja lebih dari sepuluh tahun dengan status kontrak secara terus menerus. Oleh karena itu penulis melakukan penelitian atas penerapan perjanjian kerja yang diterapkan di PT. Schering Indonesia yang kemudian dibandingkan dengan perjanjian kerja menurut undang-undang dan peraturan-peraturan lain yang berlaku. Hal ini sangat menarik perhatian seiring dengan semakin meningkatnya kesadaran hukum para pekerja secara khusus dan masyarakat secara umum."

"ABSTRAK
Perusahaan sangat membutuhkan iklan sebagai alat yang
efektif untuk memperkenalkan, menginformasikan dan membujuk
konsumen untuk membeli produknya. Dalam proses pembuatan
iklan, perusahaan yang memproduksi suatu barang
membutuhkan perusahaan agency sebagai perusahaan jasa model
dan agen model. Demi kepastian hukum persetujuan antara
perusahaan dan model iklan (perusahaan agency)
diaplikasikan dalam bentuk perjanjian secara tertulis.
Untuk itulah dalam tesis ini dibahas mengenai bentuk
perlindungan hukum yang diberikan perusahaan dalam membuat
perjanjian dengan pihak model iklan dan upaya hukum yang
dapat dilakukan model iklan bila perusahaan melakukan
wanprestasi. Secara khusus penelitian dalam tesis ini hanya
dibatasi pada perjanjian nomor 007/SPKM/MBSMA/
MIRABELLA/IV/2005 yang diselenggarakan pada tanggal 1
April 2005, dengan para pihak PT. Martina Berto sebagai
pihak pertama dan model iklan Donna Agnesia yang diwakili
Salsa Model Agency sebagai pihak kedua. Metode penelitian
yang digunakan adalah metode penelitian kepustakaan yang
bersifat normatif. Sedangkan data yang digunakan ialah data
sekunder. Data sekunder terdiri dari bahan hukum primer,
sekunder dan tersier, yang didapatkan dengan studi
kepustakaan. Teknik wawancara yang dipergunakan adalah
wawancara terarah dengan bantuan pedoman wawancara
{interview guide) dengan manager legal perusahaan kosmetik
PT. Martina Berto. Setelah mendapatkan data dilakukan
analisis data secara deskriptif kualitatif sehingga dapat
memberikan gambaran yang jelas, sistematis dan logis
mengenai masalah yang dikaji serta dapat dirumuskan
kesimpulan dan saran. Berdasarkan analisa yang telah
dilakukan, disimpulkan bahwa bentuk perlindungan hukum yang
diberikan PT. Martina Berto pada model iklannya ialah
dengan membuat perjanjian kerja sama yang mengacu pada
ketentuan-ketentuan Kitab Undang-Undang Hukum Perdata (KUH
Perdata), Hak atas Kekayaan Intelektual (HaKI) tentang Hak
Cipta dan doktrin para sarjana hukum. Sedangkan upaya hukum
yang dapat dilakukan model iklan bila PT. Martina Berto
wanprestasi ialah dengan mengajukan perselisihan tersebut
ke BANI (Badan Arbitrase Nasional Indonesia)."
