"Existing international law is capable to govern the ?war on terror? also in the aftermath of September 11, 2001. The standards generally applicable to targeted killings are those of human rights law. Force may be used in order to address immediate threats, preventive killings are permitted under strict preconditions but targeted killings are prohibited.
In the context of armed conflicts, these standards are complemented by international humanitarian law as lex specialis. Civilians may only be targeted while directly taking part in hostilities and posing a threat to the adversary. Also in Israel and the occupied territory, these standards apply. Contrary to the Israeli supreme court?s view, international humanitarian law is not complemented by human rights law, but human rights law is, to some degree, complemented by international humanitarian law. According to these standards, many killings which would be legal according to the Israeli Supreme Court violate international law."

"Permasalahan Hak Asasi Manusia (HAM) pasca perang dingin menjadi kian merebak dan tidak lagi menjadi sekedar isu non konvensional yang tidak memiliki pengaruh dalam hubungan internasional. Masyarakat internasional mulai sadar untuk melakukan praktek penghormatan terhadap HAM serta melakukan penegakan hukum internasional sebagai sarana yang dapat mempengaruhi aktor negara-bangsa dalam melaksanakan hubungan internasional. Negara yang selama ini di gambarkan sebagai leviathan yang ganas dan kejam terhadap warga negaranya, kini tidak dapat lagi bebas melakukan pelanggaran HAM berat atau melakukan impunity terhadap pelaku karena akan menjadikan mereka sebagai pariah dalam masyarakat internasional. Peran negara sebagai aktor utama dalam hubungan internasional yang lebih memfokuskan diri pada masalah keamanan (security) dan kekuatan militer kini telah bergeser sangat significant dan saat ini mereka dituntut untuk turut serta menjunjung tinggi moralitas dan hukum sebagai main values dari hubungan internasional.
Keberadaan International Criminal Court (ICC) di tengah-tengah masyarakat internasional yang anarki, merupakan fenomena nyata yang terjadi dalam hubungan internasional. Sehingga peneliti melihat pembentukan ICC merupakan usaha masyarakat internasional untuk membentuk sebuah order. Peneliti menggunakan analisis order yang dikembangkan oleh Hedley Bull dalam bukunya The Anarchical Society: A Study of Order in World Politics. Bull menjelaskan masyarakat internasional yang terdiri dari negara berdaulat memerlukan order untuk mencapai tujuannya. Untuk itu diperlukan tiga hak yaitu common interest, rules dan institutions.
Pada peneltian ini pembentukan ICC dikaitkan dengan pembentukan international order terlihat pada common interest yaitu penghormatan HAM, penegakan hukum internasional dan pencegahan impunity terhadap pelanggaran HAM berat. Pada rules adalah diadopsinya Statuta ICC dan institutionsnya adalah negara dengan memilih hukum internasional sebagai bentuk institutions of international society.
Hukum internasional yang dipilih oleh masyarakat internasional sebagai sarana untuk mencapai tujuan dalam melakukan penghormatan terhadap HAM secara internasional. Fungsi hukum internasional dalam hal ini Statuta ICC selain sebagai guidence juga sebagai sumber tata cara dalam melaksanakan kerjasama (co-operation) antara anggota masyarakat internasional serta mencakup pula prinsip hidup berdampingan (coexistence) yang diartikan sebagai jaminan tetap dihormatinya kedaulatan negara. ICC sebagai international order memiliki pengaruh besar terhadap hukum nasional, kendati ICC memberlakukan yurisdiksi otomatis. Selain itu juga memiliki pengaruh terhadap negara non pihak (non state parties), terlihat mekanisme yang dimiliki DK PBB atau terlihat dari kebimbangan AS dalam keterlibatan militernya dalam pasukan peace keeping operations. Dan terakhir, ICC memiliki pengaruh sebagai pencegah (deterrent) praktek pelanggaran HAM berat yang seringkali dilakukan oleh aktor negara bangsa."

"This study discusses the jurisdiction of International Criminal Court, as the permanent criminal court whose jurisdiction covers international criminal acts, with regard to the conflict between Palestine and Israel in Gaza Strip. Palestine and Israel are often involved in a conflict in Gaza Strip, most notably in 2009 and 2012. The aftermath of the two conflicts suggested several indications of internatioanl criminal acts conducted by two States, however no measures have been taken thus far in response to such indications. On 1 April 2015, Palestine has officialy become the State Party of International Criminal Court. This raises the question of the possibility of International Criminal Court?s jurisdict ion over the two notable conflicts in Gaza Strip. The author concluded that International Criminal Court does not have jurisdiction over the conflict between Palestine and Israel in Gaza Strip.

Skripsi ini membahas mengenai yurisdiksi Mahkamah Pidana Internasional, sebagai pengadilan pidana permanen yang memiliki yurisdiksi terhadap tindak pidana internasional, atas konflik antara Palestina dan Israel di Jalur Gaza. Palestina dan Israel kerap terlibat dalam konflik bersenjata dalam wilayah Jalur Gaza, diantaranya pada tahun 2009 serta 2012. Dalam kedua periode konflik tersebut terdapat beberapa indikasi adanya tindak pidana internasional yang dilakukan oleh kedua negara, namun belum terdapat proses pengadilan apaun terkait dengan indikasi tersebut. Pada 1 April 2015, Palestina secara resmi telah menjadi negara anggota dari Mahkamah Pidana Internasional. Hal tersebut menimbulkan pertanyaan mengenai yurisdiksi Mahkamah Pidana Internasional terkait dengan konflik di Jalur Gaza yang melibatkan salah satu negara anggotanya tersebut. Penulis menyimpulkan bahwa hingga saat ini, Mahkamah Pidana Internasional belum memiliki yurisdiksi atas konflik antara Palestina dan Israel di Jalur Gaza."
