"Penelitian ini membahas mengenai pembatalan akta autentik hibah oleh Pengadilan Negeri Kupang berdasarkan Putusan Pengadilan Negeri Kupang No. 298/Pdt.G/2022/Pn. Kpg. Kasus ini melibatkan pemberi hibah (mertua) yang menggugat penerima hibah (menantu) karena dianggap melanggar asas itikad baik. Penerima hibah diduga telah memanipulasi pemberi hibah untuk menguasai objek hibah sehingga pemberi hibah menganggap akta tersebut cacat hukum karena dalam proses pembuatannya tidak sesuai dengan ketentuan hukum yang berlaku. Adapun permasalahan yang diteliti dalam penelitian ini mengenai keberlakuan asas itikad baik dalam pembatalan akta hibah sesuai Pasal 1688 KUH Perdata dan akibat pembatalan terhadap objek hibah. Penelitian ini menggunakan metode penelitian doktrinal dengan menggunakan data sekunder atau bahan kepustakaan terdiri dari bahan hukum primer, bahan hukum sekunder, dan bahak hukum tersier. Penelitian ini memfokuskan pada penerapan asas itikad baik dalam pembatalan akta hibah berdasarkan Pasal 1688 KUH Perdata, serta akibat hukum atas objek hibah tersebut. Hasil dari penelitian ini adalah akta hibah dibatalkan oleh hakim karena penerima hibah terbukti telah melanggar ketentuan asas itikad baik dalam perjanjian. Akibat dari pembatalan akta hibah tersebut, maka objek hibah walaupun sudah memiliki kekuatan hukum tetap, harus dikembalikan kepada pemberi hibah.

This thesis discusses, the annulment of an auhentic deed of gift by the Kupang District Court based on Decision No. 298/Pdt.G/2022/Pn. Kpg. The case involves the donor (in-law) suing the recipient (son/daughter-in-law) for allegedly violating the principle of good faith. The recipient was suspected of manipulating the donor to gain control over the gifted object, leading the donor to consider the deed legally flawed due to non-compliance with applicable legal provisions during its drafting process. The issue examined in this thesis concerns the applicability of the principle of good faith in the annulment of a deed of gift in accordance with Article 1688 of Indonesian Civil Code and the consequences of annulment on object of the gift. This research employs a doctrinal method, using secondary data or library materials comprising primary, secondary, and tertiary legal sources. This thesis focuses on the application of the principle of good faith in the annulment of the deed of gift under Article 1688 of the Indonesian Civil Code and the legal consequences for the gifted object. The findings reveal that the deed of gift was annulled by the court because the recipient was proven to have violated the principle of good faith in the agreement. As a result of the annulment, the gifted object, despite having legal force, must be returned to the grantor."
