"ABSTRAKKebebasan selalu menjadi isu penting bagi pers di Indonesia, bahkan setelah pasca reformasi di mana demokratisasi berlangsung di segala lini kehidupan. Ancaman sensor oleh pemerintah yang sebelumnya menjadi momok bagi jurnalisme, kini diganti oleh konglomerasi dan konvergensi yang dikhawatirkan mengancam kebebasan pers. Artikel ini merupakan review terhadap dua penelitian yang berfokus pada hal tersebut. Penelitian pertama oleh Anett Keller pada 2004 melihat bagaimana kepemilikan sangat berpengaruh terhadap otonomi redaksi. Sepuluh tahun setelah itu Ross Tapsell juga menyorot kebebasan pers di era konvergensi yang sarat dengan konglomerasi, dan bagaimana teknologi merupakan masalah sekaligus jawaban dari kekhawatiran tentang kebebasan pers. Meskipun berangkat dengan fokus yang berbeda, kedua penelitian berhasil memetakan ancaman dan potensi bagi kebebasan pers Indonesia yang terus bergejolak.

ABSTRACTFreedom of the press has always been a critical issue in the industry, moreover in the post-reform era where democratization is happening on every aspect. The government?s censor that previously being the main problem for journalism, now shift towards conglomeration and convergence that raise concern to freedom of the press. This article is a review to two researches that focus on that issue. The first is Anett Keller?s 2004 research that examine how ownership is significantly affecting newsroom autonomy. After ten years Ross Tapsell also aims to further examine freedom of the press in the convergence era, and how technology works as both threat and solution to freedom of the press. Although focuses differently, both research successfully map the threats and possibilities to Indonesia?s freedom of the press that is an ongoing process."

"One of the most observable achievements in the development of liberal democracy in Indonesia after the fall of the Soeharto?s New Order is the flourishing freedom of the press. One notable case was the Indonesian Playboy magazine and court decisions pertaining to it, which was successful in drawing massive public and even international attention. By thoroughly describing thoughts, feelings, values, and beliefs of various actors involved, this article explains the impacts of liberal democracy experimentation in Indonesia after the amendment of 1945 Constitution. This case has provided an excellent opportunity in observing the rule of law in enforcing the freedom of the press in Indonesia facing social cultural elements strongly adhered to by Indonesian people.

Salah satu pencapaian yang terlihat dalam perkembangan demokrasi liberal di Indonesia pasca runtuhnya Orde Baru Soeharto adalah berkembangnya kebebasan pers. Kasus yang kemudian cukup krusial adalah majalah Playboy Indonesia dan putusan pengadilan yang berkaitan dengannya, yang mana berhasil menarik perhatian publik yang masif dan bahkan perhatian dunia internasional. Dengan benar-benar mendeskripsikan pemikiran, perasaan, nilai, dan kepercayaan dari berbagai pelaku yang terlibat, artikel ini menjelaskan dampak-dampak dari percobaan demokrasi liberal di Indonesia pasca amandemen UUD 1945. Kasus ini telah membuka kesempatan yang sangat baik dalam mengamati rule of law dalam melaksanakan kebebasan pers di Indonesia menghadapi elemen sosial budaya yang sangat ditaati oleh masyarakat Indonesia."

"Tesis ini merupakan penelitian terhadap kebebasan pers di Amerika. Penelitian difokuskan kepada sebuah kasus pengadilan yaitu Onassis v. Galicia di United States District Court, Second Circuit, Southern District of New York. pada tanggal 13 September 1973. Permasalahan dari penelitian ini adalah peliputan berita yang dilakukan dengan melanggar hak pribadi dapat membatasi kebebasan pers. Pembatasan kebebasan pers disini adalah pada peliputan berita terhadap seorang figur publik yang bernama Jacqueline Onassis beserta kedua anaknya.Landasan teori yang digunakan pada penelitian ini adalah landasan teori demokrasi. Metode penelitian yang digunakan adalah metode penelitian kualitatif.Hasil penelitian yang ditemukan pada tesis ini adalah peliputan berita sebagai bagian dari kebebasan pers harus dibatasi pada saat dilakukan dengan melanggar hak pribadi. Pelanggaran ini dibuktikan dengan akibat-akibat yang harus ditanggung oleh seorang figur pubik Jacqueline Onassis beserta kedua anaknya yaitu hilang reputasi, harga diri dan dipermalukan. Pada tesis ini juga ditemukan jawaban posisi kepentingan hak pribadi diposisikan lebih tinggi dibandingkan dengan kebebasan pers. Hal ini yang kemudian menyebabkan kebebasan pers pada isu peliputan berita harus diberikan batasan-batasan.Jawaban ini memperlihatkan berdasarkan filosofi demokrasi penekanan hak ada pada individu dan bukan pada kelompok tertentu. Alasannya adalah kepentingan atau unsur individu adalah yang menghidupi kepentingan atau unsur masyarakat. Maka pada saat kebebasan pers yang merupakan representasi kepentingan masyarakat melanggar hak pribadi, maka secara tidak langsung kepentingan atau unsur masyarakat telah menciderai kepentingan atau unsur individu.The Restrain of The Freedom of the Press in the case Galicia v. Onassis in 1973 at New YorkThis thesis is study on the press freedom in America. The main focus on this research is the case of Galicia v. Onassis at United States District Court, Second Circuit, Southern District of New York, 13th September 1973. The main problem on this research is the newsgathering that violate the right of privacy may restrain the freedom of the press. The freedom of the press restrained by the court to the paparazzi.

The main result of this thesis is the newsgathering as the part of the freedom of the press must be restrained when the freedom of the press violate the right of privacy. The violation can be seen by the risk that have to be accepted by the public figure Jacqueline Onassis, which are the loss of dignity, the loss of reputation and potential to lower his standing in the eyes of the public. On this thesis is also found that the position of the right of privacy is much higher than the position of the freedom of the press. That is the caused why the freedom of the press must be restrain especially in newsgathering. The answer is based on the philosophy of democracy; the right is on the nature of man and not in the nature of society. The reason is the nature of society is been supported by the nature of man. In the conclusion by the time the freedom of the press, which is the representation of the interest of the people, has violated the right of privacy, as a result the nature of society has violated the nature of man."
