"Indonesia telah mengalami krisis keuangan terburuk pada tahun 1997/1999. Pemerintah terpaksa melakukan bail-out melalui penerbitan lebih dari Rp550 triliun obligasi untuk merestrukturisasi sistem perbankan nasional. Sejak itu, pemerintah menyadari bahwa resolusi bail-out bukanlah cara yang terbaik untuk menyelamatkan bank-bank yang gagal, terutama yang berdampak sistemik. Pada tahun 2016, pemerintah telah mengeluarkan metode resolusi baru yang menggunakan mekanisme bail-in yang diatur dalam Undang-Undang Pencegahan dan Penanganan Krisis Sistem Keuangan (UU PPKSK). Kehadiran UU PPKSK menandai era baru dalam pencegahan dan penanganan krisis sistem keuangan di Indonesia. Menurut UU PPKSK, mekanisme bail-in akan menjadi prioritas utama dalam penanganan bank sistemik yang gagal, dimana rencana pemulihan untuk mengatasi permasalahan bank gagal akan mengutamakan menggunakan sumber daya dari bank itu sendiri, tanpa melibatkan Anggaran dan Belanja Negara (APBN). Oleh karena itu, permasalahan di atas menimbulkan rumusan masalah yaitu mengapa pemerintah mengganti skema bail-out dengan bail-in dalam menangani bank gagal dan apa implikasi dari substitusi tersebut. Jenis penelitian yang digunakan dalam skripsi ini adalah penelitian yuridis-normatif, tipologi penelitiannya digolongkan sebagai deskriptif, eksplanatori, dan komparatif. Penelitian ini menggunakan data sekunder yang meliputi sumber primer, sumber sekunder, dan sumber tersier. Data yang diperoleh dalam penelitian ini kemudian akan dianalisis melalui pendekatan kualitatif. Secara keseluruhan, dapat disimpulkan bahwa konsep bail-out memiliki efek yang lebih merugikan daripada menyelesaikan permasalahan bank. Salah satu alasan utama mengapa penggunaan resolusi bail-out harus diminimalkan dan diganti dengan resolusi bail-in adalah Moral Hazard. Metode resolusi bail-out juga membebani anggaran negara. Di sisi lain, mekanisme bail-in yang dapat mengalokasikan kerugian yang disebabkan oleh bank kepada kreditur senior atau pemegang saham dan menghindari penggunaan anggaran negara, sehingga meminimalkan dampaknya terhadap stabilitas sistem keuangan. Namun, Indonesia tetap menerapkan mekanisme bail-out melalui Penyertaan Modal Sementara tanpa mengikutsertakan pemegang saham atau dikenal juga sebagai Open Bank Assistance (OBA). UU PPKSK hanya menambah mekanisme baru yaitu bail-in, sehingga menambah kewenangan LPS dalam menyelesaikan bank gagal. Oleh karena itu, terdapat tambahan opsi resolusi namun tidak menggantikannya. Penulis mempunyai saran kepada Pemerintah Indonesia untuk menghapuskan mekanisme bail-out dari peraturan perundang-undangan di Indonesia yaitu Open Bank Assistance. Bahkan Amerika Serikat telah menghapus opsi Open Bank Assistance sejak diberlakukannya Dodd-Frank Act pada tahun 2010.

Indonesia has experienced the worst financial crisis in 1997/1998. The government was forced to bail-out through the issuance of more that Rp550 trillion in bonds to restructure the national banking system. Since then, the government has come to realization that that bail-out resolution is not the best way to save failing banks, especially banks with systemic impacts. On 2016, the government had introduce a new resolution methods using the bail-in mechanism which is regulated under the Financial System Crisis Prevention and Management Act (UU PPKSK). The presence of the UU PPKSK also marks a new era in the prevention and handling of financial system crises in Indonesia. According to UU PPKSK, the bail-in mechanism is a top priority in dealing with failed systemic banks. That means, the recovery plan to overcome the problem of failed banks with financial difficulties will be carried out by involving the bank's own resources, without involving the State Budget and Expenditure (APBN). Hence, the aforementioned issues gives rise to the following research questions that will be discussed within this thesis, namely why did the government substitute the bail-out with bail-in mechanism in managing bank failure and what are the implications from the substitution. The research type used in this thesis is juridical-normative research, the research typology can be classified as descriptive, explanatory, and comparative. This research utilizes secondary data which encompasses primary sources, secondary sources, and tertiary sources. The data obtained in this research will then be analysed through qualitative approach. All in all, it can be concluded that the bail-out concept has more of an adverse effect rather than resolving the troubled bank. One of the primary reason why the use of bail-out resolution should be minimized and replaced with the bail-in resolution is Moral Hazard. Bail-out also burden the state’s budget. On the other hand, the new bail-in mechanism can allocate losses caused by the banks to senior creditors or shareholders and avoid the use of the state’s budget, hence minimizing its impact on the financial system stability. However, Indonesia still implement bail-out mechanism through Temporary Equity Participation (PMS) without involving the shareholders or also known as Open Bank Assistance (OBA). UU PPKSK only add new mechanism which is bail-in, thus this adds the authority of LPS in resolving failing banks. So there are additional resolution option but it does not replace it. The author would like to recommend to the Indonesian Government to abolish the bail-out mechanism from the laws and regulations in Indonesia, which is Open Bank Assistance (OBA). Even the United States of America has eradicate the Open Bank Assistance option since the enactment of the Dodd- Frank Act in 2010."

Penelitian ini merupakan metode penelitian hukum nonnatif (yuridis normatif) dengan pendekatan analisis kualitatif terhadap dan atas informasi atau data yang diperoleh dan diperlukan guna menjawab permasalahan pokok dalam penelitian ini, dengan mengacu kepada norma-norma atau asas-asas hukum baik yang terdapat dalam peraturan perundang-undangan dan Konvensi-konvensi sebagai law in books maupun yang sudah secara konkrit ditetapkan oleh Hakim dalam kasuskasus yang diputuskan di dan oleh pengadilan sebagai law in action, yang tidak selalu ditentukan oleh jumlah (kuantitas) peristiwa yang terjadi atau banyaknya jumlah putusan pengadilan yang dimaksudkan, akan tetapi dilakukan pendalaman atas Peristiwa, Pertimbangan Hukum hakim dan Amar Putusan Pengadilan.
Dari penelitian lapangan yang dilakukan oleh peneiiti, ditemukan beberapa perkara kepailitan menyangkut permohonan pernyataan pailit terhadap pelaku usaha atau badan usaha asing baik berbentuk badan hukum maupun perorangan selaku debitur sebagai Termohon Pailit yang diajukan oleh krediturnya baik pelaku usaha Indonesia ataupun pelaku usaha asing sebagai Pemohon Pailit."

"Monetary crisis, which leads to unstable economic condition, has caused a number of banks being liquidated. This research is conducted by using major accounting ratios in order to identify the characteristics of liquidated and restructured banks, of which are listed in Jakarta Stock Exchange. The growth of bank industry was highly related with Paket Oktober 1988. This condition is marked by increasing number of banks, from 40 companies in 1988 to 240 companies in 1994. This research is conducted based on a three period financial information, commencing 1994 to 1996. Proven hypothesis concludes that the number of restructured banks is greater than of liquidated banks. On the other hand, the hypothesis related to leverage and gain has failed to be proven. However, the big sample that can be analyzed through box plot may be the caused to this result."
