"Untuk dapat bersaing secara efektif, suatu kegiatan bisnis harus mendapatkan atas bisnis beserta barang atau jasanya sebagai strategi nya. Hal tersebut dapat dilakukan melalui yang kuat. Trade dress merupakan salah satu cara untuk memperkuat branding dan dapat memperoleh perlindungan hukum sebagai salah satu bentuk objek kekayaan intelektual Berdasarkan hal tersebut, penulis mengajukan beberapa pokok permasalahan, antara lain apakah perlindungan hukum hak kekayaan intelektual yang tepat terhadap trade dress dan bagaimanakah pengaturan mengenai ruang lingkup trade dress dalam hukum merek Indonesia. Bentuk penelitian ini bersifat yuridis normatif dan tipologi penelitian deskriptif. Kesimpulan yang didapatkan adalah di antara berbagai jenis hak kekayaan intelektual, merek merupakan perlindungan hukum yang sesuai untuk trade dressdan belum adanya pengaturan terkait ruang lingkup trade dress dalam hukum merek Indonesia. Maka, saran yang diberikan adalah pengaturan ruang lingkup trade dress secara eksplisit dalam peraturan perundang-undangan oleh pemerintah untuk menciptakan kepastian hukum dan menghindari persaingan usaha tidak sehat, justify;To be able to compete effectively, the business activity must obtain market recognition of the business along with the products or services as its marketing strategy. This can be done through strong branding. Trade dress is one way to strengthen branding and can obtain legal protection as an object of intellectual property. Based on this, the author proposed several main issues, namely what is the most suitable legal protection of intellectual property rights for trade dress and how is the regulation regarding the scope of trade dress in the Indonesian trademark law. The methods of this research are normative juridical and descriptive research typology. The conclusions obtained are that among the various types of intellectual property rights, trademark is the suitable legal protection for the trade dress and explicit regulation is needed regarding the scope of trade dress within the Indonesian legal framework. Therefore, the advice given is to explicitly regulate the scope of trade dress in statutory regulations by the government to create legal certainty and avoid unfair business competition"

"Skripsi ini membahas mengenai tindakan pemboncengan reputasi atau passing off yang dikenal dalam negara-negara penganut common law system. Passing off dapat terjadi khususnya terhadap merek maupun trade dress suatu produk. Doktrin passing off tidak dikenal di Indonesia. Namun demikian, perbuatan serupa dengan passing off telah banyak terjadi di Indonesia yaitu perbuatan menggunakan merek yang memiliki persamaan pada pokoknya untuk barang dan/ jasa sejenis dan menggunakan merek yang sama pada keseluruhan dengan merek lain untuk barang/dan atau jasa tidak sejenis.

The focus of this study is about passing off which is known in common law system. Passing off may be occurred especially in trademark and trade dress. Passing off doctrine is not recognized in Indonesia. However, there have been some cases similar to passing off happened in Indonesia which are the using of trademark similar to another trademark for the same type of goods and/or services and the using of trademark which is totally identical with another trademark especially well known mark."

"Penelitian ini dilakukan berdasarkan maraknya busana pengantin Jawa yang dimodifikasi kearah religi. Perubahandesain dari busana pengantin yang murni bernuansa budaya lokal Jawa dan kemudian dipadupadankan dengan gayaberbusana muslim ini mengalami proses keberterimaan yang luar biasa sebagai trend fesyen dikalangan masyarakatIndonesia tak terkecuali masyarakat perkotaan seperti halnya Surabaya. Penelitian ini berusaha mengungkapkansimbolisasi dan pemaknaan budaya (budaya Jawa) dan agama (Islam) yang terdapat pada busana pengantin tersebut.Dengan menggunakan teori fashion system, peneliti mengungkap simbol yang terdapat di balik busana pengantin JawaMuslim yang menampakkan dua sisi busana, yaitu busana dari budaya Jawa dan busana bernuansa Islami sebagaisebuah sistem yang saling berkelindang. Hasil penelitian terhadap simbolisasi budaya dan agama dalam busanapengantin Jawa Muslim menunjukkan bahwa busana pengantin Jawa Muslim diproduksi oleh para perias pengantinsebagai bentuk kapitalisme yang menawarkan gaya hidup konsumerisme. Hal ini menunjukkan pula adanya pergeseranpemaknaan dalam busana pengantin Jawa Muslim dari budaya lokal asli Jawa menjadi budaya Jawa kontemporer. Halmenarik lainnya adalah bahwa pilihan dalam memakai busana pengantin Jawa Muslim ini tidak hanya karena alasanagama tetapi juga karena popularitas. Konsep busana muslim dalam busana pengantin Jawa Muslim tidak lagi terkaitdengan pemenuhan akidah Islam melainkan sebuah trend fesyen yang hanya merujuk pada tertutupnya auratThis study is conducted to investigate a popular practice of modifying Javanese bridal costumes based on religiousconsiderations. Transformation from purely traditional Javanese bridal costumes to those with some application ofIslamic clothing style is gaining rapid acceptance and begins to be considered as a popular fashion style by a greatnumber of Indonesians, especially in urban areas like Surabaya. The purpose of this study is to discover cultural (Java)and religious (Islam) symbolisms implied in the modification and to examine the signification involved in the process.By applying the fashion system theory, this paper seeks to unravel the symbolisms in modern Javanese-Moslem bridalcostumes which reveal a thought system built of two intertwining aspects: Javanese culture and Islamic religiousprinciples. Deep observation into the cultural and religious symbolisms reveals that the modern Javanese-Moslem bridalcostumes are actually invented by bridal stylists as a form of capitalism which benefits from a consumerist lifestyle.This fact reflects a shift in the way people signify modern Javanese-Moslem bridal costumes from Javanese localculture to contemporary Javanese culture. Another interesting finding shows that people choose this Javanese-Moslemstyle for their bridal costumes because of not only religious considerations but also its popularity. The application ofIslamic fashion style in the Javanese-Moslem bridal costumes is no longer associated with the obedience to Islamicteachings but is a mere reflection of a growing trend towards more extensive body coverage."
