"Perkembangan hukum merek saat ini tidak terbatas hanya pada tanda yang dapat dilihat secara visual. Saat ini tanda yang tidak dapat dilihat secara visual seperti aroma bisa didaftarkan menjadi sebuah merek dalam hukum merek di beberapa negara. Aroma belum diatur dalam hukum merek Indonesia. Permasalahan yang dianalisis dalam skripsi ini adalah mengenai kendala pendaftaran aroma sebagai merek dan pengaturan dari aroma sebagai merek dalam hukum merek di Indonesia. Metode penelitian yang digunakan dalam penelitian adalah metode studi kepustakaan. Hasil penelitian terhadap permasalahan tersebut adalah terdapat kendala dalam pendaftaran aroma sebagai merek dan hukum merek di Indonesia belum mengatur mengenai aroma sebagai merek. Dengan demikian, hukum merek di Indonesia harus diubah agar dapat mengakomodir perkembangan dari hukum merek saat ini.

The development of the current trademark law is not limited to signs that can be seen visually. Today marks that cannot be seen visually as scent can be registered as a mark within the trademark law in some countries. Scent as a trademark is not set in Indonesia?s trademark law. The problems analyzed in this thesis is the registration constraints as a mark and regulation of scent as a trademark in Indonesia. The research method used in this research is a method of literary study. The study of the problem is that there are obstacles in the registration of scent as a mark and trademark law in Indonesia has not been set up on the scent of a mark. Thus, the trademark law in Indonesia must be changed in order to accommodate the development of the law of the trademark today."

"Skripsi ini menjelaskan mengenai penerapan perlindungan indikasi geografis di Indonesia dan membandingkan dengan sistem yang diterapkan di Uni Eropa dan Amerika Serikat. Untuk itu dalam rangka mengetahui jenis perlindungan yang diterapkan di Indonesia maka penulis menguraikan implementasi dari perlindungan indikasi geografis di Indoneisa serta membandingkan dengan penerapan yang ada di Uni Eropa dan Amerika Serikat. Skripsi ini disusun dengan metode penulisan hukum komparatif yang menghasilkan data berupa perbandingan penerapan suatu sistem hukum di ketiga negara tersebut.Hasil penelitian menyimpulkan bahwa penerapan indikasi geografis di Indonesia mirip dengan penerapan di Uni Eropa namun disertai dengan kendala pada sistem pendaftaran yang rumit. Oleh karena itu perlu suatuu instrumen perlindungan yang lebih efektif untuk melindungi komoditas khas misalnya menggunakan merek kolektif atau merek sertifikasi, ataupun ketegasan pemerintah dan pelaku usaha untuk menerapkan fair trade practice dalam kegiatan perdagangan.

This mini-thesis describes the implementation of the protection of geographical indication in Indonesia and compare with the system applied in the European Union and the United States. In order to know what kind of protection of geographical indications in Indonesia and compares with the existing implementation in European Union and United States. This research is prepared by the method of comparative law writing that produced the data is a comparison of the application of a legal system in those three countries.

The conclusion is the application of geographical indications in Indonesia similar to the implementation of the European Union but it is followed by constraints on the complicated registration system. Protection also does not bring the positive impact of increased exports of registered product. Therefore, to solve those problems, an instrument of protection which is more effective is needed to protect specific commodities of the government and businessmen to implement fair trade practices in trading activity."

"ABSTRAKPenelitian ini bertujuan untuk mengetahui pengaruh Negara asal (country of origin) terhadap sikap konsumen dalam memilih merek MUJI. Country of origin adalah asosiasi dan kepercayaan mental seseorang akan suatu produk yang dipicu oleh negara asal produk. Aspek-aspek penting yang terdapat pada country of origin yaitu innovativeness, design, prestige, dan wormanship. Penelitian ini menggunakan pendekatan kuantitatif dan teknik purposive sampling, dengan menyebarkan kuesioner kepada 100 konsumen MUJI di pusat perbelanjaan di Jakarta. Berdasarkan hasil penelitian ditemukan bahwa country of origin memiliki pengaruh positif terhadap sikap konsumen dalam memilih merek MUJI.

ABSTRACTThis research purposed to discover leverage between country of origin to consumer's attitude toward choosing MUJI. Country of origin formed by individual associations dan mental beliefs towards the product within the country of the product. Country of origin has an important aspects such as innovativeness, design, prestige, and workmanship. This research used quantitative approach and purposive sampling technique, and spreads 100 questionnaires to MUJI‟s consumer on shopping center in Jakarta. The results of the research found that country of origin has positive influenced to consumer's attitude toward choosing MUJI."

"Sertifikasi Indikasi Geografis merupakan sertifikasi yang mempunyai tujuan untuk memberikan perlindungan hukum terhadap nama daerah asal terhadap suatu produk. Pada penelitian ini, Indikasi Geografis yang dikaji adalah Indikasi Geografis Kopi Robusta Temanggung. Penelitian ini bertujuan untuk menganalisis pengaruh sertifikasi Indikasi Geografis terhadap rantai nilai kopi robusta dan bagaimana pola rantai nilai yang terbentuk dari penerapan sertifikasi tersebut di lokasi berbeda, yaitu Kecamatan Kandangan, Bejen, dan Gemawang. Metode yang dipakai adalah metode kualitatif dengan analasis komparasi spasial dan deskriptif. Hasil dari penelitian menunjukkan bahwa peran dari setiap institusi sosial yang berkaitan dengan sertifikasi Indikasi Geografis berbeda-beda dan memiliki pola hubungan kerja sama dimulai dari pemerintah kemudian dilanjutkan kepada institusi sosial yang bekerja sama untuk mengajukan sertifikasi Indikasi Geografis Kopi Robusta Temanggung. Pengaruh sertifikasi Indikasi Geografis tidak berdampak pada simpul distribusi rantai nilai, tetapi menimbulkan peningkatan kualitas produk kopi dan pertambahan pasar yang dipengaruhi SOP dari MPIG.

Geographical Indication Certification is certification that have purpose for give law protection to place origin’s name of product. In this research, Geographical Indication is Temanggung Robusta Coffee. The purpose of this research is analize the impact of Geographical Indication to Robusta Coffee value chain and how the pattern of value chain formed from application of that certification in diferrent places, there are Kandangan District, Bejen, and Gemawang. Method of this research is qualitative method with spatial comparative analize and descriptive. The result of this research show that function of each social institution that work together for initiate the Geographical Indication certification of Temanggung Robusta Coffee. The impact of Geographical Indication is not impact the adding of the value chain distribution, but increase the quality of the coffee product and impact market adding from basic standard of MPIG."
