"ABSTRAK
Perjudian pada hakekatnya adalah suatu tindakan yang bertentangan dengan agama, kesusilaan, dan moral Pancasila, serta membahayakan bagi penghidupan dan kehidupan masyarakat, bangsa, dan negara. Perjudian awalnya hanya
berlangsung dengan cara konvensional contohnya dengan cara tatap muka, namun seiring dengan berkembangnya teknologi khususnya internet, perjudian kemudian berkembang melalui media internet. Dalam tahap pembuktian tindak pidana perjudian melalui internet di persidangan, selain menggunakan alat bukti sebagaimana diatur secara limitatif oleh Kitab Undang-Undang Hukum Acara
Pidana, juga dibutuhkan adanya alat bukti elektronik dan/atau hasil cetaknya yang merupakan perluasan alat bukti sebagaimana diatur dalam Undang-Undang tentang Informasi dan Transaksi Elektronik. Dalam prakteknya, penerapan proses pembuktian tidak dilakukan sebagaimana mestinya, seperti yang terjadi pada kasus yang diputus dalam Putusan Pengadilan Negeri Jakarta Pusat Nomor.
1672/PID.B/2010/PN.JKT.PST. Proses pembuktian tindak pidana perjudian melalui internet tersebut dianggap sama dengan proses pembuktian tindak pidana perjudian biasa yang dilakukan dengan cara konvensional, dengan hanya menghadirkan alat bukti yang diatur secara limitatif dalam KUHAP. Seharusnya dalam proses pembuktian dalam persidangan dihadirkan pula alat bukti elektronik dan atau hasil cetaknya, seperti hasil cetak situs perjudian dan data transaksi
transfer uang antara para bandar judi dan pemain.

ABSTRACT
The act of gambling is essentially an act which is against religion value, morality, and morale contained in Pancasila, also endangering the livelihoods and lives of the people, nation and state. The act of gambling was originally comitted as conventional manner, as the player meet the bookies in person. By the time of the
technology development, especially the internet, the act of gambling then evolved into online gambling. In the emphasis of criminal procedure on online gambling, aside of the use of the evidence which is limitatively regulated on Indonesian Criminal Procedural Law, it is also required to present the electronic evidence and or printout which is an expansion of evidence as set forth in the Act of Information and Electronic Transactions. In practice, the emphasis of criminal procedure on online gambling is not conducted properly, as happened in the case number 1672/PID.B/2010/PN.JKT.PST. The emphasis of criminal procedure on online gambling via Internet should be regarded equally as conventional gambling, by simply presenting the evidence which is limitatively regulated on Indonesian Criminal Procedural Law. The emphasis of criminal procedure should present the electronic president or printout, such as gambling sites printouts and transaction data transfers money between bookies and players."

"Pada tahun 2010-an, muncul genre baru video game yang berasal dari Jepang. Video game ini hadir dengan fitur baru yang disebut sistem Gacha yang pada dasarnya melibatkan permainan peluang. Penciptaan genre baru ini segera menuai kontroversi, namun keberhasilannya tampaknya telah mengaburkan perhatian sebelumnya dari fitur tersebut. Selain pasar video game Jepang, industri game Gacha telah mencapai tingkat global. Lebih dari setengah dari 100 daftar game iOS terlaris menggunakan Gacha di mekanik mereka. Pada April 2016, sepertiga dari game dari daftar iOS di luar 100 teratas menyertakan bentuk mekanik Gacha. Melihat bahwa industri mobile gaming dikatakan bernilai $48,5 miliar Dolar AS pada tahun yang sama, dan terus meningkat hingga tahun 2020 dengan perkiraan jumlah saat ini menjadi 102,2 miliar Dolar AS pada tahun 2020.

In the 2010s, there arises a new genre of video games coming originally from Japan. These video games come with a new novel feature called the Gacha system which essentially involves a game of chance. The creation of this new genre immediately garners controversy, however its success has seemingly obscured the prior concerns of the feature[1]. Aside from the Japanese video game market, the Gacha gaming industry has reached a global level. Over half of the top grossing 100 list of iOS games use Gacha in their mechanic. As of April 2016, one third of the games from the iOS list outside of the top 100 include a form of Gacha mechanic. Seeing that the mobile gaming industry is said to be worth $48.5 billion US Dollars in the same year, and continues to increase up until 2020 with the current number forecast being 102.2 billion US Dollars in 2020."
