"Netralitas Aparatur Sipil Negara (ASN) dalam penyelenggaraan Pemilihan Kepala Daerah (Pilkada) menjadi isu krusial yang banyak mendapat perhatian publik. ASN mempunyai hak pilih namun dalam melaksanakan tugasnya harus netral dan bebas dari pengaruh politik. ASN wajib memberikan layanan publik yang profesional sesuai dengan prinsip-prinsip netralitas ASN. Pemilihan Kepala Daerah di Indonesia 2024 digelar secara serentak untuk daerah-daerah yang masa jabatan kepala daerahnya berakhir pada tahun 2022, 2023, 2024, dan 2025. Sistem pemilihan kepala daerah secara serentak pada tahun 2024 merupakan yang kelima kalinya diselenggarakan di Indonesia, serta merupakan yang pertama kalinya melibatkan seluruh provinsi, kabupaten, dan kota di Indonesia terkecuali Provinsi Daerah Istimewa Yogyakarta. Terdapat beberapa hal yang harus diperhatikan dan dianalisis lebih lanjut dalam Pilkada. Pertama, penggunaan fasilitas dan sumber daya negara termasuk anggaran oleh ASN untuk kepentingan politik tertentu. Netralitas ASN dalam kontestasi politik merupakan kajian hukum kepegawaian. Prinsip netralitas dalam pemerintahan menegaskan bahwa seluruh organ pemerintahan tidak boleh memihak dalam melaksanakan tugasnya, dan tidak boleh terpengaruhi oleh pihak-pihak dari organ pemerintah lainnya. pengunduruan diri pejabat ASN dilakukan sejak pendaftaran hingga ditetapkan sebagai calon, bukan saat terlibat negosiasi dalam rangka mencari rekomendasi partai politik, hal inilah yang menimbulkan masalah baru, aktivitas mencari rekomendasi partai politik secara langsung dianggap bertentangan dengan kewajiban untuk bersikap netral. Lebih lagi jika aktivitas politik praktis tersebut dilakukan langsung oleh Sekretaris Daerah yang merupakan pimpinan tertinggi birokrasi daerah. Sekretaris Daerah dalam Jabatan Pimpinan Tinggi (JPT) Madya memiliki posisi strategis di pemerintahan yang diatur oleh Undang-Undang Nomor 20 Tahun 2023 tentang Aparatur Sipil Negara (ASN), jabatan tersebut setara dengan Deputi, atau Direktur Jenderal di kementerian, JPT Madya biasanya dijabat oleh ASN dengan pangkat golongan IV/d atau IV/e. Netralitas Sekretaris Daerah dalam Pilkada merupakan komponen penting untuk memastikan bahwa proses pemilihan berjalan adil tanpa keberpihakan dari aparatur pemerintah daerah.

The neutrality of the State Civil Apparatus (ASN) in the administration of Regional Head Elections (Pilkada) has become a crucial issue that has garnered significant public attention. While ASN have the right to vote, they must remain neutral and free from political influence in carrying out their duties. ASN are required to provide public services professionally in accordance with the principles of ASN neutrality. The 2024 Regional Head Elections in Indonesia will be held simultaneously for regions where the term of office of regional heads ends in 2022, 2023, 2024, and 2025. The simultaneous election system in 2024 will be the fifth time it has been implemented in Indonesia, and it will be the first time it involves all provinces, regencies, and cities in Indonesia, except for the Special Region of Yogyakarta. There are several issues that need to be observed and analyzed further in the Pilkada. First, the use of state facilities and resources, including budgets, by ASN for specific political interests. ASN neutrality in political contests is a matter of civil service law. The principle of neutrality in government emphasizes that all government organs must not take sides in carrying out their duties and must not be influenced by parties from other government organs. The resignation of ASN officials should occur from the time of registration until they are officially declared candidates, not while negotiating to seek political party recommendations. This creates a new issue, as the activity of directly seeking political party recommendations is considered to be in conflict with the obligation to remain neutral. This issue is further exacerbated if such political activities are carried out by the Regional Secretary, who is the highest-ranking bureaucrat in the region. The Regional Secretary, holding the position of Middle High Leadership (JPT Madya), has a strategic position in the government, as regulated by Law No. 20 of 2023 on the State Civil Apparatus (ASN). This position is equivalent to a Deputy or Director-General in a ministry. JPT Madya is typically held by ASN with a rank of group IV/d or IV/e. The neutrality of the Regional Secretary in the Pilkada is a key component to ensure that the election process proceeds fairly, without bias from regional government apparatus."

"Proses migrasi digital televisi di Indonesia telah berlangsung sejak tahun 2007. Selama lebih dari satu dekade, tenggat waktu analogue switch off/ASO di Indonesia terus mundur meskipun International Telecommunication Union (ITU) melalui The Geneva 2006 Frequency Plan (GE06) Agreement telah memberikan target bagi negara-negara di dunia untuk melakukan migrasi dari analog ke digital (analogue switch off/ASO) paling lambat pada tahun 2015. Pada tahun 2022, dengan dasar hukum UU No. 11 Tahun 2020 tentang Cipta Kerja, pemerintah memutuskan bahwa pada November 2022 Indonesia akan melaksanakan ASO. Penelitian ini bertujuan untuk mengkaji kontestasi terkait proses digitalisasi penyiaran televisi. Tanpa dilandasi oleh UU Penyiaran yang harusnya menjadi dasar hukum kebijakan penyiaran di Indonesia, ASO di Indonesia menghadapi berbagai permasalahan mendasar, seperti pengaturan multiplexing, pembagian set top box (STB), dan pengelolaan digital dividend. Penelitian ini menemukan bahwa di dalam pelaksanaan digitalisasi penyiaran, pemain besar industri pertelevisian adalah pihak yang paling diuntungkan. Sementara industri pertelevisian skala kecil terhimpit dan termarjinalkan. Selain menguntungkan konglomerat media, proses digitalisasi di Indonesia juga semakin menghilangkan peran representasi masyarakat sipil, seperti akademisi, dan organisasi profesi penyiaran lainnya. Melalui Kementerian Kominfo, pemerintah mengambil seluruh wewenang dalam proses digitalisasi penyiaran televisi.

The process of television digital migration in Indonesia has been going on since 2007. For more than a decade, the analogue switch off/AS deadline in Indonesia continues to fall back even though the International Telecommunication Union (ITU) through the Geneva 2006 Frequency Plan (GE06) Agreement has provided targets for countries in the world to migrate from analogue switch off/ASO no later than 2015. In 2022, with the legal basis of Law No. 11 of 2020 regarding job creation, the government decided that in November 2022 Indonesia would implement ASO. This research aims to examine the contestation related to the process of digitalization of television broadcasting. Without being based on the Broadcasting Law, which should be the legal basis of broadcasting policy in Indonesia, ASO in Indonesia faces various fundamental problems, such as regulating multiplexing, distributing Set Top Boxes (STB), and managing digital dividend. This study found that in the implementation of digitalization of broadcasting, the big players of the television industry are the most beneficial parties. Meanwhile, the small-scale television industry is squeezed and marginalized. Beside of benefiting media conglomerates, the digitalization process in Indonesia is also increasingly eliminating the role of civil society representatives, such as academics, and other broadcasting professional organizations. Through the Ministry of Communication and Information, the government takes all authority in the process of digitalizing television broadcasting."
