"This book is an effort to consolidate several different perspectives on antitrust law. First, Professor Hylton presents a detailed description of the law as it has developed through numerous judicial opinions. Second, the author presents detailed economic critiques of the judicialopinions, drawing heavily on the literature in law and economics journals. Third, Professor Hylton integrates a jurisprudential perspective into the analysis that looks at antitrust as a vibrant field of common law. "Kartel dalam pengaturan Undang-Undang No. 5 tahun 1999 tentang Larangan Praktek Monopoli dan Persaingan Usaha Tidak Sehat dinyatakan sebagai salah satu kegiatan yang dilarang. Larangan tersebut berkaitan dengan penetapan harga melalui kartel yang dapat mengakibatkan kerugian kepada konsumen atau masyarakat. Terdapat empat (4) perusahaan importir yang Komisi Pengawas Persaingan Usaha telah duga melakukan penetapan harga melalui kartel, mengganggu stabilitas persaingan usaha yang sehat, yakni PT. Cargill Indonesia, Teluk Intan, Liong Seng, dan Gunung Sewu. Penelitian hukum ini adalah penelitian hukum yuridis normatif yang dilakukan secara deskriptif analitis melalui bahan-bahan kepustakaan dan analisis terhadap kasus.Hasil menunjukkan adanya kegiatan penetapan harga melalui kartel yang dilakukan oleh PT. Cargill Indonesia, Teluk Intan, Liong Seng dan Gunung Sewu, juga menunjukkan bahwa kebijakan-kebijakan yang pemerintah tetapkan justru mendistorsi pasar dan menjadi sarana persaingan usaha tidak sehat.

Cartels in the regulation of Law No. 5 of 1999 concerning The Prohibition

of Monopolistic Practices and Unfair Business Competition declared as one of the

prohibited activities. Such prohibition regarding price fixing through cartels can

result in losses to consumers or the public. There are four (4) importers that the

Commission for the Supervision of Business Competition has been suspected

price fixing through cartels, disrupt the stability of fair competition, namely PT.

Cargill Indonesia, Teluk Intan, Liong Seng, and Mount Sewu. This research is

normative juridical legal research which conducted by descriptive analysis

through literature and an analysis of the case.

Results indicate that there are price

fixing through cartel activities conducted by PT. Cargill Indonesia, Teluk Intan,

Liong Seng and Mount Sewu, also the result showed that the government policies

actually could distort markets and set it into a tool of unfair competition."
