"ABSTRAK
Tesis ini membahas tentang implementasi kebijakan penanganan deteni lebih dari 10 di Rumah Detensi Imigrasi Jakarta dengan menggunakan teori implementasi kebijakan public George C. Edward, yang terdiri dari faktor, yaitu komunikasi, sumber-sumber, kecenderungan/disposisi dan struktur birokrasi. Penelitian ini menggunakan metode deskriptif kualitatif. Hasil penelitian menunjukkan bahwa komunikasi, sumber-sumber dan struktur birokrasi belum dapat berjalan dengan optimal yang disebabkan belum adanya peraturan yang secara jelas dan tegas mengatur penanganan deteni, sehingga menimbulkan perbedaan persepsi terhadap penanganan, pengawasan dan pelaporan maupun koordinasi penanganan deteni lebih dari 10 tahun.
Penelitian ini menyarankan untuk melakukan komunikasi peraturan sehingga terdapat kejelasan tugas dan wewenang dalam pengawasan dan pelaporan, pemberian pelatihan kerja bagi deteni, pemberian ijin tinggal, kejelasan status identitas diri dan kepastian hukum dalam rangka kehidupan yang layak dan pemenuhan hak asasi manusia serta peningkatan koordinasi internal dan eksternal sehingga mempunyai kesamaan pandangan dalam penanganan deteni lebih dari 10 tahun.

ABSTRACT
This thesis discussed about the implementation policy on handling detainees more than 10 years in Rumah Detensi Imigrasi Jakarta by using public policy implementation theory of George c. Edward. The theory consists of some factors such as communication, resources, disposition and bureaucracy structure. This research used qualitative descriptive method. The results showed that communication, sources, and bureaucracy structure hasn't been able to work optimally which were caused by the absence of clear and strict regulation to handle detainees. It made different perceptions of handling, monitoring and reporting as well as coordination for detainee more than 10 years.
This research suggested to communicate regulations in order to make the clarity of duties and authorities in monitoring and reporting, giving job training for detainees, granting of residence permit, the clarity of self identity and legal status in order to have a decent life and the fulfillment of human rights and also the increase of internal and external coordination so they have same perceptions on handling detainees more than 10 years."

"Upaya pemerintah meningkatkan derajat pendidikan dengan berbagai hal, termasuk peningkatan anggaran pendidikan 20% sebagai amanat Undang-Undang Dasar, adanya undang-undang Otonomi Daerah Nomar 32 Tahun 2004 tentang pemerintahan daerah, secara eksplisit pendidikan bukan hanya tanggung jawab pemerintah pusat tapi sudah menjadi tanggung jawab pemerintah daerah.
Kebijakan Pemerintah Kabupaten Banyuwangi tentang kebijakan pendidikan gratis yang tertuang dalam Instruksi Bupati Nomor I tahun 2005 tentang Penghentian Pungutan Dana Penyelenggaraan Pendidikan Kepada Orang tua/wali murid SD, SMP dan SMAISMK Negeri di Kabupaten Banyuwangi; manual pro dan kontra, termasuk sikap penolakan sebagian masyarakat dengan melakukan aksi protes. DPRD membentuk Panitia Khusus Interpelasi yang menilai kebijakan pendidikan gratis untuk SD, SMP dan SMA/SMK Negeri diskriminatif, hanya memenuhi ambisi politik pemerintah kabupaten semata, sehingga berujung pada usulan pemberhentian Bupati dan Wakil Bupati Banyuwangi.
Penelitian ini dimaksudkan untuk mengkaji lebih dalam tentang Ā°Efektifitas kebijakan pendidikan gratis di kabupaten Banyuwangi meliputi : Penyelenggaraan kebijakan pendidikan gratis Pemerintah Kabupaten Banyuwangi dalam tahapan formulasi, implementasi dan evaluasi kebijakan pendidikan gratis.
Dunn memberikan 5 (lima) tahapan baku dalam keseluruhan proses pembuatan dan pelaksanaan sebuah kebijakan publik. Proses ini dimulai dari kegiatan (1) mengidentifikasi dan menemukan masalah publik (policy issues), (2) memformulasikan berbagai altematif kebijakan (Policy Formulation) yang rasional, (3) memutuskan kebijakan (Policy adoption) yang akan dilaksanakan, (4) melaksanakan kebijakan (Policy implementation) yang telah dipilih dan (5) mengukur dan menilai hasil kebijakan (PolicyAssesmenf) yang telah dilaksanakan.
Efektifitas dalam kebijakan pendidikan, dapat dirumuskan sebagai tingkat perwujudan sasaran yang menunjukkan sejauhmana sasaran kebijakan telah dicapai. Kebijakan pendidikan dapat dikatakan efektif bila kebijakan tersebut dapat sepenuhnya mencapai sasaran yang telah ditetapkan.
Berdasarkan karakteristik tujuan penelitian yang ingin dicapai, maka pendekatan penelitian ini menggunakan penelitian kualitatif naturalistik, karena, peneliti menghendaki kejadian-kejadian yang berkaitan dengan fokus yang alamiah. Dengan menggunakan metode kualitatif, maka informasi yang didapat lebih lengkap, mendalam, dan dapat dipercaya.
Penelitian ini menghasilkan beberapa temuan :
Pertama, dilihat dad efektifitas kebijakan publik, maka pada tahapan formulasi kebijakan, pengambil keputusan berorientasi pada policy initiation dimana pemecahan masalah publik menekankan pada interest aktor pengambil kebijakan yang jangkauannya Iebih pendek. Sehingga memunculkan fragmentasi antar lembaga eksekutif dan legislatif.
Kedua, Kemampuan aparatur pemerintah kabupaten dalam hal ini dinas pendidikan sebagai pelaksana kebijakan, belum efektif karena Iemahnya SDM dan struktur organisasi penyelenggara kebijakan yang sempit sehingga komunikasi antar pelaksana program terdistorsi. Pelaksana program mengalami problem koordinasi karena pengambilan kebijakan dilakukan secara simultan dengan persiapan yang sedikit.
Ketiga, Kecenderungan pelaksana kebijakan lebih terfokus pada capaian program secara prosedural sehingga mengutamakan pencapaian program secara formal, menegasikan capaian tujuan substansial dalam tujuan kebijakannya.
Keempat, Evaluasi kebijakan dan monitoring tidak dilakukan secara holistik oleh badan penyelenggara sehingga kebijakan yang dilakukan dievaluasi berdasarkan laporan stakeholder kebijakan. Sangat mungkin akurasi data menjadi tidak efektif dalam pengembangan program dan optimalisasi pengawasan program yang sedang berjalan.
Kelima, Dampak kebijakan yang diharapkan belum mampu memperlihatkan senyatanya fakta akan keberhasilan program, dimana stakeholder tidak bersikap proaktif karena sosialisasi program belum berjalan secara maksimal.
Hasil Penelitian juga memberikan beberapa saran sebagai berikut :
1. Pengambilan kebijakan Pemerintah Kabupaten dalam merumuskan kebijakan harus dilakukan secara tepat dengan melibatkan lembaga mitra dalam merumuskan kebijakan secara holistik.
2. Kebijakan publik harus mampu mendorong terlibatnya stakeholder dalam maksimalisasi tujuan kebijakan dengan program sosialisasi yang memadahi.
3. Kebijakan publik sedapat mungkin mampu diukur tingkat keberhasilannya oleh badan pelaksana dan lembaga lainnya dalam upaya keberlangsungan dan pengembangan kebijakan mendatang.
4. Kebijakan publik sebagai program prioritas mampu dilaksanakan pelaksana dengan cermat dan meminimalisir fragmentasi dalam pelaksanaannya sehingga kebijakan mencapai sasaran kebijakan secara tepat.
5. Dampak sebuah kebijakan publik dapat mendorong partisipasi aktif stakeholder kebijakan dalam rangka pengembangan kebijakan lanjutan.

Government made a effort to upgrade level of education with some policy, including escalation of education's budget to 20 % as instruction in Undang-Undang Dasar, the existence of Local autonomy canon number 32 year 2004 about local government, explicitly that education is not only centre government's responsibility but also local government.
Policy of Banyuwangi County Government about free of charge education policy is stated in regent's instruction number 1 year 2005 about cancellation of gleanings education implementation fee to parents of student SD, SMP, and SMAISMK public school in Banyuwangi County; get pro and contra, include refusal from some people with commit to protest action. Local Representative Council (DPRD) form interpellation exclusive committee that calculating free of charge education policy for SD, SMP and SMAISMK public school is discriminative, that only fulfil local government's political ambition so at the end, it make a idea to lay off of regent and co-regent of Banyuwangi county.
This research aim to assess more intensive about "Effectiveness of free of charge education policy in Banyuwangi County" embrace: implementation of effectiveness of free of charge education policy in Banyuwangi County in formulation stages, implementation and evaluation of free of charge education policy.
Dunn make 5 (five) standard of stages in process of making and implementation a public policy. This process is started from (1) identify and founding public problem 9 Policy issues); (2) formulate various policy alternative rationally (Policy Formulation), (3) decide to choose policy that will be implemented ( policy adoption), (4) implement the policy which has been chosen ( policy implementation) and (5) measure and assess result of policy that has been implemented ( Policy assessment).
Effectiveness of education policy can be defined as representative level of a target is achieved. Education policy can be said as success if that policy can accomplish a target that has been appointed.
Based on characteristic of this research's objective, approach of this research use qualitative /naturalistic research, cause researcher needs situations that related to focus as natural. Using qualitative method, gathered information is more complete, profound, and reliable.
This research produce some finding:
First, from side of effectiveness of education policy, in formulation policy stage, decision maker's orientation is to policy initiation which solving of public problem emphasize to interest of policy making actor who the reach of their hand is closer. So that causing fragmentation between executive and legislative.
Second, capability of county government employee, especially in Dinas Pendidikan as Policy implementer, has not been effective yet because there is weakness in human resource and organization structure of policy implementer that too narrow so communications between program implementers get distortion. Program implementer get coordination problem because policy making is undergone simultaneously with minimum preparation.
Third, policy implementer tend to more focus to accomplishment of program procedurally so that giving priority to program accomplishment formally, diminishing substantial objective in its objective (policy).
Fourth, evaluation of policy and monitoring aren't undergone holistic way by executants council so that implemented policy is evaluated based on policy stockholder's report. It's possible that accurate of data become ineffective in program development and maximize control of undergoing program.
Fifth, expected policy impact has not been able to show the real of fact of program success. Those stakeholders aren't proactive attitude because program socialization hasn't been maximal.
Results of Research also give some ideas. There are:
1. Policy making by county government in define policy must be right with involving partner institution for define program in holistic way.
2. Public policy must be able to push stakeholder involving for maximize policy objective with program socialization adequately.
3. Public policy must be able to be measured its success level by executants council and other institution regarding sustainable effort and policy development in the future,
4. Public policy as priority program can be able to executed by implementer acutely. And minimalist fragmentation in its implementation so that policy accomplishes policy's objective rightly.
5. Impact of a public policy can push active participation of policy stakeholders regarding the next policy development.

"[Disertasi menguraikan tentang implementasi kebijakan pendidikan agama di Sekolah Katolik Kota Blitar ditinjau dari aspek Content of Policy, Context of Implementation, aspek kegagalan, dan dampak kegagalan implementasi kebijakan. Penelitian menggunakan paradigma postpositivisme, dengan metode kualitatif dan tipe deskriptif.
Penelitian ini menghasilkan beberapa temuan: Pertama, aspek content of policy menunjukkan bahwa rumusan kebijakan pendidikan agama dinilai tidak mewakili agregasi kepentingan kelompok sasaran, sehingga mengalami kegagalan dalam implementasi. Kedua, aspek context of implementation menunjukkan bahwa implementasi kebijakan pendidikan agama tidak semata proses administrasi, namun dipengaruhi oleh 'interpenetrasiā€™ faktor politik dan nilai ideologi keagamaan. Ketiga, kegagalan implementasi kebijakan pendidikan agama disebabkan oleh adanya penolakan halus secara sistemik (sistemic subtle rejection), pendiaman pemegang kebijakan terhadap kendala implementasi (government silent on implementation gap), dan tidak adanya evaluasi terhadap kendala implementasi. Keempat, dampak kegagalan implementasi kebijakan pendidikan agama meliputi dampak pembelajaran, dampak psikologis dan dampak substansi nilai keagamaan.
Implikasi teoritik penelitian ini adalah bahwa nilai ideologi keagamaan (ideological values) merupakan faktor determinan dalam keseluruhan proses kebijakan publik semenjak formulasi, implementasi dan evaluasi. Konteks Indonesia, pada kasus dalam penelitian, ketaatan kepada agama lebih besar daripada ketaatan terhadap kebijakan negara. Nilai ideologi dalam hal implementasi kebijakan selama ini lebih menekankan pada dimensi ideologi politik. Sehingga ideologi dalam konteks keagamaan menjadi ruang koreksi bagi teori implementasi kebijakan.
Berkaitan dengan temuan penelitian, maka sebuah proses implementasi kebijakan memerlukan langkah-langkah. Pertama, optimalisasi sosialisasi isi kebijakan dengan harapan terjadi peningkatan respon masyarakat (citizens partisipation), baik dalam pemahaman rumusan kebijakan maupun partisipasi dalam implementasi sehingga agregasi kepentingan masyarakat maupun nilai-nilai yang berkembang dalam masyarakat terakomodir dalam sebuah proses kebijakan; Kedua, Implementasi kebijakan publik perlu mempertimbangkan pola hubungan struktural antar instansi (the structure of intergovermental relation) agar tidak terjadi konflik kewenangan. Ketiga, Implementasi kebijakan perlu merumuskan strategi pencapaian tujuan sesuai dengan karakteristik lingkungan implementasi dengan pola sintesis yaitu gabungan pendekatan top-down dan bottom up dan melakukan evaluasi dalam setiap tahapan kebijakan.;The dissertation describes the implementation of religious education policy in Catholic schools Blitar review of aspects: Content of Policy, Context of Implementation, aspect failure, and the impact of the failure of policy implementation. This research using postpositivisme paradigm, the qualitative and descriptive methods.
The research produce some finding: First, aspects of the content of the policy indicates that the religious education policy formulation is not considered to represent the interests of the target group aggregation, so that a failure in implementation. Second, aspects of the context of implementation indicate that the implementation of the policy of religious education is not only the administrative process, but were influenced by the 'interpenetration' political factors and the value of religious ideology. Third, religious education policy implementation failure caused by subtle rejection systemically (systemic subtle rejection), the standing of the constraints of implementation of the policy holder (government silent on implementation gap), and the absence of an evaluation of the implementation constraints. Fourth, the impact of policy implementation failure religious education includes learning impact, psychological impact and effects of the substance of religious values.
Theoretical implication of this study is that the value of religious ideology (ideological values) is a determinant factor in the whole process of public policy since the formulation, implementation and evaluation. The case study of Indonesian context, adherence to religion is greater than adherence to state policy. Value of ideology in terms of policy implementation has been more emphasis on the dimension of political ideology. So the ideology in religious context become a space correction to the theory of policy implementation.
In connection with the research findings, a process of policy implementation requires some steps. First, the optimization of content dissemination policy in the hope of an increase in the response community (citizens partisipation), both in understanding participation in policy formulation and implementation so that the aggregation of the interests of society and the values that flourish in a society accommodated in the policy process; Third, policy implementation need to formulate strategies to achieve goals in accordance with the implementation of the environmental characteristics of the pattern of synthesis of a combined top-down and bottom-up evaluation in all stages of policy., The dissertation describes the implementation of religious education policy in Catholic schools Blitar review of aspects: Content of Policy, Context of Implementation, aspect failure, and the impact of the failure of policy implementation.
