"Saat ini BLU diberikan kewenangan untuk melakukan penandatangan perjanjian. Adanya hal ini memerlukan analisis mengenai apakah BLU mempunyai kecakapan dalam menandatangani suatu perjanjian khususnya perjanjian KSO menurut hukum perjanjian di Indonesia.  Selain itu juga menganalisis dalam hal perjanjian yang ditandatangani oleh BLU menimbulkan kerugian terhadap pihak ketiga, siapakah yang akan bertanggungjawab. Metode yang digunakan dalam penelitian ini adalah metode yuridis normatif dikarenakan penelitian kali ini akan melakukan analisis atas produk hukum yaitu Perjanjian Kerja Sama Operasi antara BLU di bidang energi dan sumber daya mineral dengan pihak swasta. Penelitian ini akan mencari dasar hukum/aturan, doktrin, teori untuk menjawab rumusan masalah yang diangkat.  Analisis masalah kecakapan akan dimulai dengan melihat teori dan ketentuan yang terdapat dalam hukum Perjanjian di Indonesia serta doktrin dan teori mengenai subyek hukum badan hukum dan teori positivisme. Analisis kedua terhadap pertanggungjawaban BLU apabila Perjanjian KSO mengalami kerugian adalah dengan menganalisis menggunakan aturan pertanggungjawaban dalam hukum perdata serta teori delegasi kewenangan, serta teori positivisme. Hasil penelitian ini menyimpulkan bahwa BLU bukanlah subjek hukum berbentuk badan hukum sehingga tidak mempunyai kecakapan untuk melakukan perbuatan hukum seperti melakukan penandatanganan perjanjian KSO. Selanjutnya apabila timbul suatu kerugian maka berdasarkan hukum perdata, pihak ketiga dapat memintakan pertanggungjawaban hingga kepada instansi induk yaitu Kementerian Negara/Lembaga Pemerintah.

Currently BLU is given the authority to sign the agreement. The existence of this requires an analysis of whether BLU is capable to sign an agreement, especially KSO agreements according to contract law in Indonesia. In addition, it also analyses in terms of the agreement signed by BLU causing harm to third parties, who will be responsible. The method used in this study is a normative juridical method because this research will analyse a legal product, namely the Joint Operation Agreement between BLU in the field of energy and mineral resources and the private sector. This research will look for legal/rule bases, doctrines, and theories to answer the formulated problems raised. The analysis of skills issues will begin by looking at the theories and provisions contained in treaty law in Indonesia as well as doctrines and theories regarding the subject matter of legal entities and the theory of positivism. The second analysis of the accountability of BLU if the KSO Agreement suffers a loss is by analysing using the accountability rules in civil law and the theory of delegation of authority, as well as the theory of positivism. The results of this study conclude that BLU is not a legal subject in the form of a legal entity, so it cannot take legal actions, such as signing a KSO agreement. Furthermore, if a loss occurs, based on civil law, a third party can hold accountability up to the parent agency, namely the State Ministry/Government Agency."

"Tesis ini membahas tentang penyelenggaraan pemerintahan yang baik (good governance) oleh pemerintah daerah memalui pelaksanaan pelayanan publik dalam Undang-Undang Nomor 25 Tahun 2009 tentang Pelayanan Publik yang dimaksudkan dapat memberikan perlindungan dan kepastian hukum dalam pelayanan publik. Penyelenggaran pelayanan publik di lingkup pemerintah Indonesia saat ini masih menghadapi berbagai tantangan dan kendala dalam implementasinya. Berdasarkan Laporan Tahunan Ombudsman Tahun 2021 dengan tema Mengawasi Kepatuhan dan Kesigapan Penyelenggara Pelayanan Publik Dalam Menghadapi Ketidakpastian. Pada tahun 2021, jumlah laporan publik yang disampaikan kepada Ombudsman RI sebanyak 7.186 laporan dan instansi yang paling banyak dilaporkan adalah pemerintah daerah (Pemda) sebesar 40,99%. Hal yang menjadi dasar laporan pengaduan masyarakat yaitu kualitas pelayanan publik yang masih kurang baik dan pelaksanaan pelayanan publik yang masih dirasa kurang efisien dan efektif dalam hal prosedur atau mekanisme yang berbelit-belit, belum terwujudnya transparansi, kurang informatif dan akomodatif serta tidak terjaminnya kepastian hukum akan waktu dan biaya pelayanan. Penelitian dilakukan secara yuridis normatif, analisis data secara kualitatif dilakukan dengan cara analisis dan olah data berdasarkan pemahaman peneliti terhadap data yang diperoleh dan selanjutnya dinarasikan untuk memperoleh simpulan penelitian. Penelitian ini digunakan untuk mengetahui dan menganalisis standar pelayanan publik dan pengelolaan pengaduan pelayanan publik di pemerintah daerah serta implementasi pelayanan publik dalam rangka mewujudkan pemerintahan yang baik (good governance) di Provinsi Jambi. Standar Pelayanan Publik dan Pengelolaan Pelayanan Publik di Daerah belum dilaksanakan secara menyeluruh. Masih terdapat instansi di daerah yang belum memiliki standar pelayanan publik dan tingkat kepatuhan yang rendah terhadap standar pelayanan publik. Implementasi Pelayanan Publik Dalam Rangka Mewujudkan Pemerintahan Yang Baik (Good Governance) di Provinsi Jambi pada tahun 2021 mendapatkan kategori zona hijau dengan tingkat kepatuhan tinggi yang dinilai oleh Ombudsman RI. Ternyata zona hijau yang didapatkan oleh pemerintah provinsi Jambi tidak mencerminkan pelayanan yang berkualitas dan prima, hal ini dikarenakan bahwa penilaian yang dilakukan oleh Ombudsman RI terbatas pada objek penilaian yaitu hanya pada atribut pelayanan publik.

This thesis discusses the implementation of good governance by local governments through the implementation of public services in Law Number 25 of 2009 concerning Public Services which is intended to provide legal protection and certainty in public services. The implementation of public services within the scope of the Indonesian government is currently still facing various challenges and obstacles in its implementation. Based on the 2021 Ombudsman Annual Report with the theme Monitoring Compliance and Alertness of Public Service Providers in Facing Uncertainty. In 2021, the number of public reports submitted to the Indonesian Ombudsman was 7,186 reports and the agencies that reported the most were the local government at 40.99%. The basis for public complaint reports is that the quality of public services is still not good and the implementation of public services is still felt to be inefficient and ineffective in terms of convoluted procedures or mechanisms, lack of transparency, lack of information and accommodation and no guarantee of legal certainty. service time and costs. The research was carried out in a normative juridical manner, qualitative data analysis was carried out by means of data analysis and processing based on the researcher's understanding of the data obtained and then narrated to obtain research conclusions. This research is used to identify and analyze public service standards and the management of public service complaints in local governments and the implementation of public services in the framework of realizing good governance in Jambi Province. Public Service Standards and Management of Public Services in the Regions have not been fully implemented. There are still agencies in the regions that do not yet have public service standards and a low level of compliance with public service standards. Implementation of Public Services in the Context of Realizing Good Governance In Jambi Province in 2021 will receive the green zone category with a high level of compliance as assessed by the Indonesian Ombudsman. It turns out that the green zone obtained by the Jambi provincial government does not reflect quality and excellent service, this is because the assessment conducted by the Ombudsman of the Republic of Indonesia is limited to the object of assessment, namely only the attributes of public services."
