"Tesis ini menganalisis bagaimana pengaturan pada saat ini, pelaksanaan dan pengaturan di masa yang akan datang terkait akses terhadap pemulihan non-yudisial korban kecelakaan kerja Industri Nikel di Indonesia berdasarkan UN Guiding Principles on Business and Human Rights. Tesis ini disusun menggunakan metode penelitian doktrinal. Akses terhadap pemulihan non-yudisial korban kecelakaan kerja di industri nikel Indonesia saat ini berdasarkan UU RI Nomor 1 Tahun 1970 tentang Keselamatan Kerja adalah melalui pengawasan ketenagakerjaan setempat dan terdapat jaminan sosial yang dapat diakses oleh korban berdasarkan UU Sistem Jaminan Sosial Nasional, Perpu Cipta Kerja dan UU BPJS. Pelaksanaan akses terhadap pemulihan non-yudisial korban kecelakaan kerja di industri nikel Indonesia berdasarkan UNGPs terdiri dari akses terhadap pemulihan berbasis negara dan non-negara seperti BPJS Ketenagakerjaan, Dinas Ketenagakerjaan, Komnas HAM, perusahaan dan asosiasi bisnis. Masih terdapat banyak tantangan hukum dalam pelaksanaan akses terhadap akses pemulihan non-yudisial korban kecelakaan kerja nikel seperti tidak adanya pengaturan komprehensif mengenai kompensasi dan berbagai resiko terbaru, sistem pengawasan atau mitigasi resiko, koordinasi dalam pemerintahan. Pengaturan akses terhadap pemulihan non-yudisial korban kecelakaan kerja di industri nikel Indonesia yang seharusnya berlaku pada masa yang akan datang adalah mengimplementasikan prinsip bisnis dan HAM secara internasional terhadap perbaikan UU Keselamatan kerja. Perbaikan yang dapat dilakukan terhadap UU Keselamatan kerja yaitu menyusun pengaturan yang komprehensif dengan pendekatan HAM, kewajiban dan membangun uji tuntas industri nikel dan menjamin mekanisme pengaduan terhadap korban.

This thesis analyzes the current regulation, implementation, and future regulation concerning access to non-judicial remedy for victims of workplace accidents in the Nickel Industry in Indonesia based on the UN Guiding Principles on Business and Human Rights. This thesis is compiled using a doctrinal research method. Currently, access to non-judicial remedy for victims of workplace accidents in the Indonesian nickel industry is governed by Law No. 1 of 1970 concerning Occupational Safety, through local labor supervision and social security guarantees accessible to victims under the National Social Security System Law, the Job Creation Omnibus Law, and the Social Security Administrator Law.  Implementation of access to non-judicial remedy for victims of workplace accidents in the Indonesian nickel industry based on the UNGPs includes access to both state-based and non-state-based grievance mechanisms such as BPJS Employment, the Department of Manpower, the National Commission on Human Rights (Komnas HAM), companies, and business associations.  There are still many legal challenges in implementing access to non-judicial recovery for victims of nickel industry workplace accidents, such as the lack of comprehensive regulations on compensation, various emerging risks, risk supervision or mitigation systems, and governmental coordination. Future regulation governing access to non-judicial recovery for victims of workplace accidents in the Indonesian nickel industry should involve implementing international business and human rights principles to improve Occupational Safety Laws. Improvements to Occupational Safety Laws should include drafting comprehensive regulations with a human rights approach, obligations to conduct thorough assessments of the nickel industry, and ensuring complaint mechanisms for victims."

"Kecelakaan kerja merupakan suatu kejadian yang tidak diinginkan yang terjadi saat seseorang sedang menjalankan tugas atau bekerja, baik dalam jam kerja maupun di luar jam kerja. Kecelakaan tersebut dapat mengakibatkan cedera fisik atau kerugian lainnya bagi pekerja, perusahaan, atau bahkan lingkungan sekitarnya. Salah satu hak bagi pekerja adalah hak untuk kondisi kerja yang aman dan sehat. Pekerja memiliki hak untuk bekerja dalam lingkungan yang aman dan sehat tanpa risiko serius terhadap Kesehatan dan Keselamatan kerja (K3). Faktor-faktor yang dapat menyebabkan kecelakaan kerja meliputi kesalahan manusia, kondisi lingkungan kerja yang tidak aman, atau kegagalan sistem keselamatan kerja. Penting bagi perusahaan untuk memiliki program Kesehatan dan Keselamatan Kerja (K3) yang efektif guna mencegah terjadinya kecelakaan dan melindungi para pekerja. Kesehatan dan Keselamatan Kerja (K3) sangatlah penting dalam lingkungan kerja. K3 yang baik dapat membantu melindungi pekerja dari cedera, penyakit, atau bahaya lainnya yang mungkin terjadi saat bekerja. Kepatuhan terhadap peraturan K3 yang berlaku adalah kewajiban bagi perusahaan, mematuhi aturan tersebut tidak hanya membantu melindungi pekerja, tetapi juga menghindari sanksi hukum dan reputasi yang buruk bagi perusahaan. Penelitian ini bertujuan untuk menganalisis ketentuan mengenai Kesehatan dan Keselamatan Kerja (K3), penerapan Kesehatan dan Keselamatan Kerja (K3) di PT MMT, dan mengidentifikasi hak pekerja yang mengalami kecelakaan kerja di PT MMT. Dengan melakukan analisis terhadap hak pekerja yang mengalami kecelakaan kerja di PT MMT, dapat diketahui apakah pekerja mendapatkan hak-haknya sebagai seorang pekerja di suatu perusahaan. Dengan memprioritaskan K3, perusahaan dapat menciptakan lingkungan kerja yang lebih aman, sehat, dan produktif bagi semua orang yang terlibat.

A work accident is an undesirable event that occurs when someone is carrying out their duties or working, either during working hours or outside working hours. These accidents can result in physical injuries or other losses for workers, companies, or even the surrounding environment. One of the rights for workers is the right to safe and healthy working conditions. Workers have the right to work in a safe and healthy environment without serious risks to occupational health and safety (K3). Factors that can cause work accidents include human error, unsafe work environment conditions, or failure of work safety systems. It is important for companies to have an effective Occupational Health and Safety (K3) program to prevent accidents and protect workers. Occupational Health and Safety (K3) is very important in the work environment. Good K3 can help protect workers from injuries, illnesses or other dangers that may occur while working. Compliance with applicable K3 regulations is an obligation for companies, complying with these regulations not only helps protect workers, but also avoids legal sanctions and a bad reputation for the company. This research aims to analyze provisions regarding Occupational Health and Safety (K3), the implementation of Occupational Health and Safety (K3) at PT MMT, and identify the rights of workers who experience work accidents at PT MMT. By analyzing the rights of workers who experience work accidents at PT MMT, it can be seen whether workers have their rights as workers in a company. By prioritizing K3, companies can create a safer, healthier and more productive work environment for everyone involved."

"ABSTRAK
Perilaku keselamatan kerja pada pekerja Usaha Mikro Kecil dan Menengah (UMKM)
khususnya pengolahan kayu di Indonesia masih kurang baik, ditandai dengan masih tingginya
angka disabilitas akibat kecelakaan kerja. Tujuan penelitian ini adalah diketahui dan
diperolehnya faktor-faktor yang mempengaruhi perilaku keselamatan kerja pada pekerja
UMKM pengolahan kayu.
Studi kualitatif menggunakan wawancara mendalam dan kelompok diskusi terfokus dengan
pedoman wawancara semi-struktur pendekatan teori Green di 2 perusahaan informal
pengolahan kayu. Wawancara mendalam dilakukan pada 2 orang bagian manajemen, 2 orang
mandor, 4 orang pekerja. Kelompok diskusi terfokus dilakukan pada 2 kelompok dengan 5
orang pekerja di setiap kelompok.
Pekerja pengolahan kayu memiliki persepsi yang cukup baik mengenai perilaku keselamatan
kerja hal ini dikarenakan memiliki pengalaman bekerja cukup lama meskipun berlatar
belakang pendidikan rendah. Sikap dan perilaku yang belum mencerminkan perilaku
keselamatan kerja dipengaruhi motivasi, minat, role model, kesiapan, kebijakan dan
pengawasan yang masih kurang. Mandor masih kurang ketat bertindak sebagai role model
dan melakukan pengawasan terhadap pekerja di lapangan. Manajemen perusahaan sudah
melakukan penyediaan sarana dan prasarana sesuai standar tetapi tidak diikuti oleh adanya
kebijakan, peraturan, pelatihan serta reward dan punishment.
Persepsi baik berperilaku keselamatan kerja pada pekerja pengolahan kayu dalam mencegah
kecelakaan kerja dipengaruhi oleh pengetahuan, pengalaman dan sarana prasarana standar
yang cukup baik. Tetapi kurangnya motivasi, minat, contoh teladan, kesiapan dan
pengawasan mempengaruhi sikap dan perilaku keselamatan kerja yang kurang baik.
Manajemen dan mandor yang kurang menerapkan kebijakan, peraturan, pelatihan, reward
dan punishment juga mempengaruhi perilaku keselamatan kerja bagi para pekerja pengolahan
kayu.ABSTRACT

identify influencing factors to workers?s safety behavior of carpenter in the micro, small and

Management already provides standar infrastructure and facilities, but lack of policy,
regulation, training also reward and punishment system.

"Semakin meningkatnya angka kecelakaan kerja di Indonesia tentunya harus dapat menjadi perhatian terutama karena dapat meningkatkan pembayaran tunjangan kecelakaan kerja perusahaan yang berimplikasi kepada penurunan keuntungan. Tujuan dari penelitian ini adalah untuk menganalisis determinan dari tunjangan kecelakaan kerja berdasarkan pengendalian terhadap kecelakaan kerja pada industri manufaktur di Indonesia  dengan menggunakan jenis data panel pada rentang tahun 2010-2015 melalui pendekatan siklus bisnis, pasar tenaga kerja, karakteristik perusahaan serta kondisi fisik dan psikologi pekerja. penelitian ini membuktikan tunjangan kecelakaan kerja dipengaruhi secara negatif dan signifikan oleh program perlindungan pekerja, ukuran perusahaan serta berpengaruh positif dan signifikan terhadap jam kerja lembur dan upah. Adapun siklus bisnis berpengaruh negatif dan signifikan terhadap tunjangan kecelakaan kerja, salah satu kemungkinan penyebabnya yaitu pendeknya rentang waktu penelitian.

Accident work increasing in Indonesia should get some attention, because its effect increasing a worker compensation that could affect firm profitability Goals of this research is to analyze determinant of compensation of industrial accident with controlling the amount of accident in manufacturing industry. With using panel data methods in 2010-2015, this research can prove that social worker program, firm size could impact negatively toward work accident compensation, wage and overtime wage impact positively to work accident compensation. Bussines cycle impact negative and significant to work accident compensation, this result is different from previous studies. Short time span of this research could be the major cause of the different result."

"ABSTRAK
Peraturan perundang-undangan K3 ditetapkan untuk melindungi pekerja dari bahaya-bahaya di tempat kerja. Perkembangan teknologi dan modernisasi yang mempengaruhi ketenagakerjaan berdampak pada pelaksanaan K3 di Indonesia. Tesis ini mengkaji bagaimana peraturan perundang-undangan K3 di Indonesia dalam perkembangan zaman sekarang. Penelitian ini merupakan studi kualitatif dengan pendekatan telaah dokumen peraturan perundang-undangan dan wawancara dengan para pemangku kepentingan terkait K3. Hasil penelitian menunjukkan bahwa aturan pokok K3 butuh diperbaharui baik dari sisi terminologi dan sanksi. Pengembangan aturan tentang bahaya psikososial juga masih perlu dilakukan. Permasalahan tumpang tindih pengaturan K3 juga ditemukan.

ABSTRACT
Occupational Safety and Health Legislation is established to protect workers from hazards in the workplace. Technological developments and modernization affecting employment has impact on OSH in Indonesia. This thesis examines how OSH legislation in Indonesia is in today 39 s development. This study is a qualitative study with a lieterature review of legal documents and interviews with related OSH stakeholders. The results showed that the basic rules of OSH need to be updated both in terms of terminology and sanctions. Development of rules on psychosocial hazards is also necessary. Overlapping issues of OSH setting are also found."

"Peraturan Pemerintah (PP) Nomor 50 Tahun 2012 tentang Sistem Manajemen Keselamatan dan Kesehatan Kerja(SMK3) telah berjalan selama lebih dari 10 tahun dan menjadi suatu pedoman atau acuan yang bersifat wajib untuk dilaksanakan bagi perusahaan yang memiliki potensi bahaya besar atau mempekerjakan paling sedikit 100 orang pekerja. Penerapan SMK3 merupakan salah satu upaya preventif yang harus dilakukan akibat meningkatnya risiko kecelakaan kerja. SMK3 adalah penerapan sistem manajemen keselamatan dan kesehatan kerja yang akan dapat meminimalkan risiko kerugian moral dan moneter, kehilangan jam kerja, serta keselamatan orang dan lingkungan. Penelitian ini adalah penelitian gabungan (mixed method). Dalam penelitian ini, teknik pengolahan data secara kuantitatif dilakukan untuk mengukur hasil penerapan SMK3 di industri galangan kapal kecil PT. X, PT. Y, dan PT. Z menggunakan instrumen audit tingkat awal (64 kriteria SMK3) sesuai PP No. 50 Tahun 2012. Penelitian ini dilakukan pada Bulan September 2023 - Oktober 2023 yang dengan pengambilan data observasi pada industri galangan kapal kecil PT X., PT. Y, dan PT. Z digunakan untuk mengukur tingkat pencapaian penerapan SMK3 di 3 industri galangan kapal kecil PT. X, PT. Y, dan PT. Z berdasarkan instrumen audit SMK3 PP No. 50 Tahun 2012 tingkat awal (64 kriteria) Manajer HSE dari setiap perusahaan di PT. X, PT. Y, dan PT. Z merupakan responden yang memberikan dokumen dan keterangan. Hasil penelitian didapatkan fakta bahwa Tingkat kesesuaian penerapan SMK3 PT. X : 21,88%, PT. Y : 3,13%, PT. Z : 21,88%. Tingkat ketidaksesuaian penerapan SMK3 PT. X sebesar 78,12 % dengan temuan mayor sebesar 51 %, temuan minor sebesar 45 %, dan temuan kritikal sebesar 4 %. Tingkat ketidaksesuaian penerapan SMK3 PT. Y sebesar 98,44% dengan temuan mayor sebesar 49,21%, temuan minor sebesar 49,21%, dan temuan kritikal sebesar 1,58%. Tingkat ketidaksesuaian penerapan SMK3 PT. Z sebesar 78,12% dengan temuan mayor sebesar 52% dan temuan minor sebesar 48%.

Government Regulation (GR) Number 50 of 2012 concerning the Occupational Safety and Health Management System (OSHMS) has been running for more than 10 years and has become a mandatory guideline or reference to be implemented for companies that have the potential for major hazards or employ at least 100 workers. The implementation of OSHMS is one of the preventive efforts that must be carried out due to the increased risk of work accidents. OSHMS is the implementation of an occupational safety and health management system that will be able to minimize the risk of moral and monetary losses, loss of working hours, as well as the safety of people and the environment. This research is a mixed method. In this study, quantitative data processing techniques were carried out to measure the results of the application of OSHMS in the small shipyard industry of PT. X, PT. Y, and PT. Z uses an initial level audit instrument (64 OSHMS criteria) according to PP No. 50 of 2012. This research was conducted in September 2023 - October 2023 with observational data taken on the small shipyard industry of PT X, PT. Y, and PT. Z. Used to measure the level of achievement of the application of SMK3 in 3 small shipyard industries of PT. X, PT. Y, and PT. Z based on the audit instrument OSHMS PP No. 50 Year 2012 entry level (64 criteria) HSE Manager from each company at PT. X, PT. Y, and PT. Z is a respondent who provides documents and information. The results of the study found that the level of suitability of the application of OSHMS PT. X : 21.88 %, PT. Y : 3,13 %, PT. Z : 21,88 %. The level of non-conformity in the application of OSHMS PT. X is 78.12% with major findings of 51%, minor findings of 45%, and critical findings of 4%. The level of non-conformity in the application of OSHMS PT. Y is 98,44% with major findings of 49,21%, minor findings of 49,21%, and critical findings of 1,58%. The level of non-conformity in the application of OSHMS PT. Z is 78,12% with major findings of 52 % and minor findings of 48%."

"Pada awal September 2019, Grab dikabarkan tengah dalam pembicaraan untuk menggabungkan perusahaan pembayaran digital OVO dengan DANA. OVO dan DANA dinilai berpotensi mendominasi pasar pembayaran digital Tanah Air dan mengalahkan dominasi Go-Pay yang dimiliki Gojek,  sehingga penggabungan tersebut akan akan memberikan dampak yang besar bagi para pihak terkait serta dicemaskan akan mengarah kepada persaingan usaha yang tidak sehat. Sebelumnya, dalam menentukan dampak penggabungan perusahaan, perlu dianalisis terlebih dahulu terkait pasar bersangkutannya. Hasil penelitian menunjukkan rencana penggabungan OVO dengan DANA dengan menganalisis cara menentukan pasar bersangkutan dalam industri dompet elektronik mengacu kepada Peraturan KPPU No. 3 Tahun 2009 tentang Pedoman Penerapan Pasal 1 Angka 10 tentang Pasar Bersangkutan Berdsasarkan UU No. 5 Tahun 1999 tentang Larangan Praktek Monopoli dan Persaingan Usaha Tidak Sehat, hingga kewenangan Komisi Pengawasan Persaingan Usaha dalam menangani tindak penggabungan perusahaan.

"Program 'Behavior Based Safety' dirancang untuk melindungi pekerja dari risiko bahaya dan mencegah kecelakaan kerja. Meskipun tujuannya positif, implementasi program ini sering dihadapkan pada tantangan, termasuk kurangnya partisipasi dan penolakan oleh beberapa pekerja. Kajian ini bertujuan untuk mengkaji berbagai aspek yang berkaitan dengan program 'Behavior Based Safety' dari Penerapan program, analisis tren kecelakaan, pengaruh sikap dan perilaku pada penerapan program 'Behavior Based Safety' terhadap Kejadian Kecelakaan Kerja. Penelitian ini dilakukan di PT. X dengan lokasi di beberapa wilayah di Indonesia, antara April hingga Juli 2023. Studi melibatkan 299 karyawan dari berbagai jenis layanan di 35 lokasi PT. X. program dinilai dengan menganalisis data kecelakaan selama periode FY15-FY16 dan FY18-FY20. Studi ini menggunakan pendekatan analisis deskriptif dengan melibatkan data primer yang diperoleh melalui kuesioner, mengukur sikap dan perilaku terkait program ini. Data sekunder juga digunakan untuk mendukung penelitian ini. Data dianalisis menggunakan berbagai metode statistik, termasuk analisis univariat dan analisis bivariat dengan uji chi-square. Dalam penerapan program ‘Behavior Based Safety’, responden memiliki beberapa sikap dan perilaku baik/kurang baik yang tidak berbeda secara signifikan maupun yang berbeda secara signifikan. Sebagian besar responden memiliki sikap yang baik terhadap safety walk, safety observation dan nearmissed report serta sebagian besar responden memiliki perilaku yang baik terhadap risk assessment, safe system of work serta training & supervision. Hasil dari penelitian ini membuktikan bahwa program Behavior Based Safety secara statistik berpengaruh terhadap angka kecelakaan kerja, namun sikap dan perilaku pekerja penerapan program tidak ada pengaruh secara signifikan terhadap kejadian kecelakaan kerja. Maka perlu meningkatkan program Behavior Based Safety dan memastikan pekerja konsisten dalam penerapan program Behavior Based Safety.

The 'Behavior Based Safety' program is designed to protect workers from hazards and prevent work accidents. Despite the positive goals, implementation of these programs has often been met with challenges, including lack of participation and resistance by some workers. This study aims to examine various aspects related to the 'Behavior Based Safety' program from program implementation, analysis of accident trends, the influence of attitudes and behavior on the implementation of the 'Behavior Based Safety' program for Occupational Accidents. This research was conducted at PT. X with locations in several regions in Indonesia, between April and July 2023. The study involved 299 employees from various types of services in 35 locations of PT. X. program was assessed by analyzing accident data during the period FY15-FY16 and FY18-FY20. This study uses a descriptive analysis approach involving primary data obtained through questionnaires, measuring attitudes and behavior related to this program. Secondary data is also used to support this research. Data were analyzed using various statistical methods, including univariate analysis and bivariate analysis with the chi-square test. In implementing the 'Behavior Based Safety' program, respondents had several good/bad attitudes and behaviors that were not significantly different or significantly different. Most of the respondents had a good attitude towards safety walk, safety observation and near-missed report and most of the respondents had good attitude towards risk assessment, safe system of work and training & supervision. The results of this study prove that the Behavior Based Safety program statistically has an effect on the number of work accidents, but the attitude and behavior of workers implementing the program has no significant effect on the occurrence of work accidents. Therefore, it is necessary to enchance the Behavior Based Safety program and ensure that employees are consistent in implementing the Behavior Based Safety program."

"Risiko Keselamatan Kesehatan Kerja dan Lingkungan (K3L) merupakan hal penting yang perlu dikendalikan, khususnya pada laboratorium. Kecelakaan kerja harus diminimalisir agar aktivitas laboratorium dapat terus dilaksanakan. Tujuan dari penelitian ini adalah dapat mengidentifikasi karakteristik bahan baku yang digunakan di Laboratorium TPL FTUI dan menganalisis potensi bahaya dan risiko berdasarkan jenis aspek risiko atau jenis kegiatan yang dilakukan di Laboratorium TPL FTUI. Berdasarkan Peraturan Menteri Nomor 5 Tahun 2018 tentang Keselamatan dan Kesehatan Kerja, evaluasi risiko lingkungan kerja dapat ditinjau dari berbagai aspek, yaitu aspek fisika, kimia, biologi, ergonomi dan psikologi. Penelitian ini menggunakan jenis pendekatan kuantitatif dan kualitatif dengan metode sampling, observasi langsung, wawancara, dan survei kuisioner.
Hasil penelitian menunjukkan bahwa aspek fisika memperoleh angka 52,8 dB yang masih memenuhi standar untuk faktor kebisingan, dan 38,2 lux yang tidak memenuhi standar faktor pencahayaan. Untuk aspek biologi ditinjau masih aman dalam hal kualitas udara, namun tidak untuk faktor kelembaban. Pada aspek kimia dapat diketahui bahwa seluruh bahan kimia yang digunakan memiliki karakteristik bahaya dengan angka risiko yang tinggi. Sedangkan pada aspek ergonomi terdapat 8 dari 10 fasilitas telah memenuhi syarat ergonomi dan aspek psikologi diperoleh angka stres kerja laboran pada kategori rendah hingga sedang. Hasil identifikasi bahaya dan penilaian risiko menunjukkan kategori risiko II dan III dari setiap jenis pengujian yang terpilih. Upaya pengendalian dan program K3L perlu ditingkatkan agar bahaya dan risiko dapat dikelola.

Occupational Health and Environmental Safety risk is an important things that needs to be controlled, especially in the laboratory. Work accidents must me minimized so that laboratory activities can continue to be carried out. The aim of this study was to identify the characteristics of the raw materials used in the TPL FTUI Laboratory and analyze the potential hazards and risks based on the type of risk aspects or the type of activity carried out in the TPL FTUI Laboratory. Based on Ministerial Regulation Number 5 of 2018, evaluation of work environment risks can be viewed from various aspects, namely aspects of physics, chemistry, biology, ergonomics and psychology. This research was a quantitative and qualitative study with sampling methods, direct observation, interviews, and questionnare surveys.
The results show that the physical aspect obtained a figure of 52.8 dB which still meets the standard for the noise factor, and 38.2 lux which does not meet the standard for the lighting factor. For the biological aspect, it is considered safe in terms of air quality, but not for the humidity factor. In the chemical aspect, it can be seen that all chemicals used have hazard characteristics with a high risk rate. While in the aspect of ergonomics, there are 8 out of 10 facilities that have met the requirements of ergonomics and from the psychological aspect, the number of laboratory work stress is in the low to medium category. The results of hazard identification and risk assessment indicate risk categories II and III for each type of test selected. OHSE control efforts and programs need to be improved so that hazzards and risks can be managed.
