"Masyarakat hukum adat sebagai suatu masyarakat yang tetap dan teratur telah berkembang secara internasional hal ini di dukung dengan adanya pembentukan United Nations Declaration on the rights of Indigenous People (UNDRIP) yang telah disahkan oleh PBB pada tahun 2007. Di Indonesia ketentuan mengenai masyarakat hukum adat telah tertuang pada Pasal 18 B ayat (2) UUD 1945. Tulisan ini disusun dengan menggunakan metode penelitian doktrinal. Dengan menganalisis bagaiman a pembentukan Rancangan Undang – Undang (RUU) tentang Masyarakat Hukum Adat berpengaruh terhadap upaya pemenuhan dan perlindungan hak asasi manusia bagi masyarakat hukum adat. Rencana pembentukan RUU tentang masyarakat hukum adat tersebut telah ada sejak tahun 2004, dan pada tahun 2016 hingga 2018 RUU tersebut sudah masuk kedalam Program Legislasi Nasional (Prolegnas) di dalam DPR. Namun hingga saat ini RUU tersebut belum juga dilakukan pengesahan oleh pemerintah. Senyatanya pembentukan RUU tersebut sudah ada masuk dalam tahap urgensi seperti banyak kasus perampasan wilayah yang menimpa masyarakat hukum adat, pelanggaran hak atas free, prior, dan informed consent (FPIC) yang dimiliki oleh masyarakat hukum adat terhadap pernyataan persetujuan atas suatu agenda, pelanggaran terhadap hak konstitusional termasuk hak politik, serta perempuan adat yang sering dihadapkan terhadap permasalahan diskriminasi. Dalam RUU tentang Masyarakat Hukum Adat yang saat ini masuk dalam tahap pembahasan DPR juga tak luput dari permasalahan, beberapa pasal menimbulkan kerancuan dalam implementasinya misalkan Pasal 11 hingga Pasal 17 yang memuat mengenai proses identifikasi dan verifikasi, Pasal 6 terhadap ketentuan persyaratan, Pasal 22 terhadap ketentuan perlindungan, dan Pasal 20 terhadap ketentuan evaluasi. Beberapa pasal dan ketentuan tersebut belum mencerminkan tujuan utama pembentukan RUU tentang Masyarakat Hukum Adat, namun secara nyata hal tersebut justru banyak mengurangi hak yang seharusnya diperoleh oleh masyarakat. Hal inilah yang menjadikan pengesahan RUU tentang Masyarakat Hukum Adat menjadi hal yang penting disahkan untuk melakukan pemenuhan dan perlindungan hak asasi manusia bagi masyarakat hukum adat.

Indigenous Peoples, as stable and organized societies, have developed internationally, supported by the establishment of the United Nations Declaration on the Rights of Indigenous Peoples (UNDRIP), which was ratified by the UN in 2007. In Indonesia, provisions concerning indigenous peoples are outlined in Article 18B, Paragraph (2) of the 1945 Constitution. This paper is composed using doctrinal research methods. It analyses how the drafting of the Draft Law on Indigenous Peoples impacts efforts to fulfill and protect human rights for indigenous legal communities. The plan to establish the Draft Law on Indigenous Peoples has been in place since 2004, and from 2016 to 2018, the draft law was included in the National Legislation Program (Prolegnas) within the House of Representatives (DPR). However, to date, the draft law has not yet been enacted by the government. In fact, the drafting of this draft law has reached an urgent stage due to numerous cases of territorial seizures affecting indigenous legal communities, violations of the right to free, prior, and informed consent (FPIC) regarding their approval of certain agendas, violations of constitutional rights including political rights, and indigenous women often facing issues of discrimination. The Draft Law on Indigenous Peoples currently under discussion in the DPR is not without problems. Several articles cause confusion in their implementation, such as Articles 11 to 17, which cover the processes of identification and verification. Article 6, which pertains to the requirements. Article 22, which concerns protection provisions. And Article 20, which deals with evaluation provisions. These articles and provisions do not yet reflect the main objectives of forming the Draft Law on Indigenous Peoples. In fact, they often diminish the rights that should be granted to the communities. This underscores the importance of enacting the Draft Law on Indigenous Peoples to ensure the fulfillment and protection of human rights for Indigenous Peoples."

"[Ekspresi Budaya Tradisional (EBT) adalah kekayaan warisan budaya yang
menceminkan nilai-nilai, tradisi, dan kepercayaan suatu bangsa dan masyarakat
adat. Setiap bangsa memiliki kekayaan EBT masing-masing, terutama negaranegara
berkembang, dimana Indonesia termasuk ke dalam salah satu negara yang
kaya akan keanekaragaman hayati luar biasa (mega biodiversity). EBT rentan
terhadap penyalahguaan (misappropriation dan misuse) terutama dari negaranegara
maju karena memiliki potensi ekonomi, sehingga penting agar dapat
segera terbentuk suatu sistem perlindungan EBT di Indonesia. Pendekatan yang
umum diaplikasikan untuk perlindugnan EBT adalah melalui rezim hukum HKI
konvensional yang bersifat individualistis sehingga tidak sesuai untuk
diaplikasikan pada EBT. Penulisan ini akan mengkaji efektifitas praktik

"Tesis ini membahas mengenai jual beli hak atas tanah berdasarkan hukum adat yang dijadikan dasar untuk pendaftaran tanah dengan menganalisa suatu putusan pengadilan Negeri Cibinong. Penelitian ini menggunakan metode penelitian normatif dengan pendekatan kualitatif, sehingga penelitian ini dapat memberikan gambaran tentang kedudukan jual beli tanah yang dilakukan berdasarkan hukum adat dalam pandangan hukum positif di Indonesia dan bagaimana perlindungan hukum serta penyelesaian hukum terhadap pemegang hak terakhir yang mengalami kesukaran untuk melakukan pendaftaran tanah akibat jual beli berdasarkan pada hukum adat, dari hasil penelitian disarankan bahwa jual beli hak atas tanah hendaknya dilakukan dihadapan PPAT yang berwenang, dan Kantor Pertanahan berikut PPAT sebagai mitra Kantor Pertanahan selalu memberikan informasi serta melakukan penyuluhan tentang Hukum Tanah Nasional kepada masyarakat setempat agar terciptanya kepastian hukum dan adanya perlindungan hukum terhadap hak-hak atas tanah.

This thesis discusses the sale and purchase of land rights based on customary law wich is made the basis for land registration by analyzing a decision of the Court Cibinong. Research using this method of research with a qualitative approach normative, so that this research can provide a snapshot of the sale and purchase is based on customary law in the positive law in Indonesia and how the protection and legal settlement of the last holder of the rights that are difficult to perform the registration of land in onder maintenance data. Based on the results of research suggested that the sale and purchase rights to the land should be done before the authorized PPAT and PPAT office land below as a patner of the Land Office land below as a patner of the Land Office should always be to provide information and conduct espionage on national land law to the local community in order to to create legal certainty and the protection of the law rights over land."

"Masyarakat hukum adat memiliki hubungan keterikatan yang kuat dengan wilayah tempat mereka tinggal. Banyak dari masyarakat hukum adat ini telah mendiami suatu wilayah secara turun-temurun sejak zaman pra-kolonisasi yang pada akhirnya wilayah yang mereka diami tersebut tidak jatuh ke dalam wilayah satu kedaulatan negara saja. Perbatasan negara, tidak hanya menjadi pembatas kedaulatan antar negara saja, tapi juga membelah masyarakat hukum adat yang wilayah tradisionalnya dilalui garis batas negara tersebut. Dalam upaya untuk memenuhi kebutuhan ekonomi, sosial, budaya dan spiritual dan juga melanjutkan serta menjaga tradisi dan kebudayaan yang telah dijalankan secara turun temurun, masyarakat hukum adat yang dipisahkan oleh batas negara tidak dapat lepas dari kegiatan lintas batas tradisional. Untuk melihat perlindungan terhadap masyarakat hukum adat yang dipisahkan oleh batas negara, penelitian ini meninjau praktik dari Amerika Serikat, Norwegia dan Indonesia yang menunjukkan variasi perlindungan terhadap masyarakat hukum adat yang dipisahkan oleh batas negara berdasarkan posisi serta sikap masing-masing negara menanggapi permasalahan masyarakat hukum adat secara umum.

Indigenous peoples maintain a strong relationship with their homelands, not just based on social-economy needs, but more to cultural and spiritual connection. Long before colonialism came to the new world and divide the world into sovereign-state territory, indigenous peoples call it home, and some of their traditional homelands did not fall within one sovereign-state territory. International border, not only become the boundaries between state soverignty, but also split indigenous peoples whose traditional homelands crossed by those borders. In the effort to fulfill their social, economy, cultural and spiritual needs, those indigenous peoples can not be separated from the traditional cross-border activities. To help us understand about the protection of indigenous peoples whose homelands are separated by international border, this research describe and analyse the practices in the United States, Norway and Indonesia, which potrays the variety based on the country?s position and response to the problems of indigenous peoples in general.
