Nowadays, the conditions of regulation in Indonesia, from quantity perspective, are within over-regulated position or in another word, number of regulation which exist is too excessive. Moreover, within quality perspective, there are many inconsistent regulation, overlapping and contradicted each other. Those conditions has negative significant especially in its relationship with the investation climate and business competition in Indonesia. In last 2014, The President Joko Widodo has mandated the ministriesto apply simplification of regulation through the pruning about 50% from 42000 regulations simplification in Indonesia by draw the success implementation of regulation simplification in South Korea. This article also discusses the steps which should be applied by the Indonesia government in order to implement the regulation simplification. In the last chapter, this article will portray the potencial obstacles that will be faced by the government during the process of implementation of regulation simplification in Indonesia and also suggest the solution to answer those prob"

"Penyederhanaan birokrasi merupakan salah satu prioritas kerja presiden Jokowi pada masa pemerintahannya di tahun 2019 - 2024. Penyederhanaan birokrasi dilakukan dengan tiga tahap yaitu melalui transformasi organisasi dengan penyederhanaan struktur organisasi, transformasi SDM melalui pengalihan jabatan, dan transformasi sistem kerja melalui penyesuaian mekanisme sistem kerja baru setelah penyederhanaan. Penyederhanaan birokrasi pada awalnya hanya dianggap sebagai formalitas dan tidak dapat dilakukan dengan optimal karena banyak aspek yang perlu diperhatikan dan disesuaikan kembali terutama pada aspek SDM yang memiliki peran penting dan Kementerian PANRB merupakan kementerian yang bergerak di arah reformasi birokrasi sehingga harus menjadi contoh pelaksanaannya. Penelitian ini bertujuan untuk menganalisis dan mengidentifikasi pelaksanaan transformasi organisasi melalui penyederhanaan struktur organisasi di Kementerian PANRB. Pendekatan yang digunakan pada penelitian ini adalah post-positivist dengan Teknik pengumpulan data berupa wawancara dengan pihak terkait dan melalui studi pustaka. Hasil penelitian ini menunjukkan bahwa pelaksanaan transformasi organisasi melalui penyederhanaan struktur organisasi yang dianalisis dengan dimensi reframing, restructuring, revitalization dan renewal pada dasarnya sudah berjalan di Kementerian PANRB yaitu telah melakukan restrukturisasi dengan memangkas struktur menjadi dua level, melakukan pembaruan dengan pihak lain dengan baik, meningkatkan kemampuan SDM dengan baik. Namun, dalam pelaksanaannya perlu dioptimalkan kembali terutama terkait dengan peran pemimpin yang kurang memperhatikan pegawai. Adapun hambatan yang terjadi yaitu pada motivasi SDM yang perlu lebih diperhatikan akibat jenjang karir serta kesenjangan jumlah beban kerja dan jumlah pegawai yang tersedia. Hal ini dapat disiasati dengan pembentukan agen perubahan, memperkuat peran pemimpin, membangun kembali reward system untuk meningkatkan motivasi pegawai dan memperbaiki penataan SDM agar semakin optimal.

Simplifying the bureaucracy is one of President Jokowi's work priorities during his reign in 2019 - 2024. Simplifying the bureaucracy is carried out in three stages, namely through organizational transformation by simplifying the organizational structure, human resource transformation through position transfers, and work system transformation through adjustment of the new work system mechanism after simplification. Initially, the simplification of the bureaucracy was only considered as a formality and could not be carried out optimally because there were many aspects that needed to be considered and readjusted, especially in the HR aspect which had an important role and the Ministry of Administrative and Bureaucratic Reform is a ministry that moves in the direction of bureaucratic reform so it must be an example of its implementation. This study aims to analyze and identify the implementation of organizational transformation through simplification of the organizational structure at the Ministry of Administrative and Bureaucratic Reform. The approach used in this study was post- positivist with data collection techniques in the form of interviews with related parties and through literature study. The results of this study indicate that the implementation of organizational transformation through simplification of the organizational structure analyzed by the dimensions of reframing, restructuring, revitalization and renewal has basically been running at the Ministry of Administrative and Bureaucratic Reform, restructuring by cutting the structure into two levels, updating with other parties well, increasing good HR skills. However, in practice it needs to be optimized again, especially related to the role of leaders who pay less attention to employees. The obstacles that occur are the motivation of human resources which needs more attention due to career paths and the gap in the number of workloads and the number of available employees. This can be circumvented by forming agents of change, strengthening the role of leaders, rebuilding the reward system to increase employee motivation and improving human resource management to make it more optimal."

"Skripsi ini membahas mengenai regulatory reform perizinan mendirikan bangunan di DKI Jakarta yang diwujudkan dalam penyelenggaraan perizinan terpadu melalui Dinas Penanaman Modal dan Pelayanan Terpadu Satu Pintu (DPMPTSP). Peneliti menggunakan konsep Interactive Governance dalam melihat regulatory reform dari sisi kelembagaan. Penggunaan konsep interactive governance didasari oleh kompleksitas regulasi yang melibatkan berbagai aktor lintas sektor baik di lingkungan pemerintah maupun nonpemerintah dalam proses regulatory reform perizinan mendirikan bangunan. Peneliti menggunakan paradigma post-positivist, serta teknik pengumpulan data dilakukan dengan wawancara mendalam dan studi kepustakaan. Kemudian analisis disajikan secara deskriptif yang menghasilkan temuan bahwa regulatory reform perizinan mendirikan bangunan di DKI Jakarta melalui DPMPTSP telah meningkatkan interaksi antaraktor. Kesadaran akan keterbatasan terutama dari sisi sumber daya memaksa aktor pemerintah untuk memobilisasi sumber daya didukung koordinasi yang lebih intensif. Faktor yang menentukan regulatory reform perizinan mendirikan bangunan dari perspektif interactive governance adalah institusionalisasi yang belum dibangun secara matang sehingga meskipun komitmen pimpinan di tingkat daerah (Jakarta) telah terbangun, regulatory reform yang diimplementasikan tidak sesuai dengan kondisi ideal yang diinginkan. Untuk itu salah satu saran yang diberikan adalah peningkatan kapasitas kelembagaan didukung konsistensi kebijakan di level pusat yang mendorong perbaikan tata kelola perizinan di daerah.

This thesis discusses the regulatory reform of building construction permits in DKI Jakarta, which is realized in the implementation of integrated licensing through the One Stop Investment and Services Office (DPMPTSP). Researchers use the concept of Interactive Governance in looking at regulatory reform from an institutional perspective. The use of the interactive governance concept is based on the complexity of the regulations involving various cross-sector actors both the government and non-government in the process of regulatory reform building construction permits. Researchers used the post-positivist paradigm, data collection techniques were carried out with in-depth interviews and literature studies. Then the analysis is presented descriptively which results in the finding that regulatory reform of building construction permits in DKI Jakarta through DPMPTSP has increased interaction between factors. Awareness of limitations especially in terms of resources forces government actors to mobilize resources supported by more intensive coordination. Factors that determine licensing regulatory reform to build construction from an interactive governance perspective are institutionalization that has not yet been fully developed, even though the commitment of leaders at the regional level (Jakarta) has been built, the regulatory reform implemented is not in accordance with the desired ideal conditions. For this reason, one of the suggestions given is to increase institutional capacity supported by policy consistency at the central level that encourages improved licensing governance in the regions."

"Konteks reformasi regulasi secara tepat menjadi penting untuk menunjang agenda
reformasi birokrasi di Indonesia. Eksistensi regulasi di Indonesia saat ini tidak terlepas
dari isu tumpang tindih yang tidak menjamin kepastian hukum terutama di sektor
pertambangan, mineral, dan batu bara. Adapun hal ini dapat dibenahi melalui strategi
reformasi regulasi sebagai upaya dalam mencapai tujuan nasional. Maka dari itu, skripsi
ini bertujuan untuk menganalisis regulatory reform pada sektor pertambangan, mineral
dan batubara di Indonesia menggunakan konsep Modern Mining Code yang
dikembangkan oleh Nguyen, Boruff & Tonts (2019). Penelitian ini menggunakan
paradigma post-positivist dengan teknik pengumpulan data yang dilakukan melalui
wawancara mendalam dan studi kepustakaan. Temuan penelitian menunjukkan bahwa
regulatory reform pada sektor pertambangan, mineral, dan batubara telah memberikan
beberapa manfaat mengenai kepastian investasi, hukum, dan simplifikasi permasalahan
yang ada sebelumnya. Hasil penelitian menunjukkan hanya terdapat 5 indikator yang
tidak sesuai dengan regulatory reform perspektif modern mining code yaitu Foreign
exchange access, Elimination of political pressure, Arbitration of impacts on local
peoples, Address indigenous issues, dan Stipulate rights of regulatory authority,
sedangkan 24 indikator sisanya dari 10 dimensi yang ada pada teori Modern Mining code
sudah sesuai dan terakomodir pada upaya regulatory reform sektor mineral dan batubara.

The proper context of regulatory reform is important to support the bureaucratic reform
agenda in Indonesia. The existence of regulations in Indonesia today is inseparable from
overlapping issues that do not guarantee legal certainty, especially in the mining, mineral,
and coal sectors. This can be addressed through a regulatory reform strategy as an effort
to achieve national goals. Therefore, this thesis aims to analyze regulatory reform in the
mining, mineral, and coal sector in Indonesia using the Modern Mining Code concept
developed by Nguyen, Boruff & Tonts (2019). This study uses a post-positivist paradigm
with data collection techniques carried out through in-depth interviews and literature
study. Research findings indicate that regulatory reform in the mining, mineral, and coal
sectors has provided several benefits regarding investment certainty, law, and
simplification of previous problems. The research results show that there are only 5
indicators that are not by regulatory reform from the perspective of modern mining code,
namely Foreign exchange access, Elimination of political pressure, Arbitration of impacts
on local peoples, Address indigenous issues, and Stipulate rights of regulatory authority,
while the remaining 24 indicators are from The 10 dimensions in the Modern Mining
code theory are appropriate and accommodated in the regulatory reform efforts of the
mineral and coal sector.
