"Jakarta is one of the areas with high urbanization number and its impacts, so it requires Local Government to control the urbanization to minimize its negative impacts. On the other hand, the rights to freedom of movement and residence throughout the territory of Indonesia are guaranteed by the Law. So, this study becomes important to know how the efforts of Jakarta Provincial Government to control the urbanization as seen in human rights perspective. This study uses a qualitative approach and descriptive method. This paper argues that the urbanization control by Jakarta Local Government with orderly administration approach is not effective to control the urbanization and only created constraints of people movement and this policy violates the right to freedom movement and residence. It further sug¬gests that the orderly administration approach should be replaced by the human rights approach in controlling the urbanization in Jakarta if it is to seek better policy."

"Serangan terrorisme yang terjadi pada tanggal 11 September 2001 secara fundamental mengubah pemahaman Amerika Serikat (AS) dan dunia mengenai bahaya yang ditimbulkan oleh terorisme. Pemahaman baru ini direalisasikan dalam berbagai kebijakan keamanan yang lebih ketat berupa, misalnya, peningkatan metode-metode pengumpulan informasi dan penggunaan instrumen intelijen untuk mencegah terjadinya tragedi terorisme di masa yang akan datang.
Kebijakan kontra-terorisme dan legislasi anti-terorism baru di berbagai belahan dunia mengundang keprihatinan. Meskipun tindakan-tindakan kontra-terorisme didukung oleh Resolusi Perserikatan Bangsa-Bangsa (PBB) 1333/2000 dan 1373/2000, kontra-terorisme seharusnya tidak mengancam pemenuhan hak-hak asasi manusia. Dalam Piagam PBB dicantumkan tekad PBB untuk menjaga pemenuhan hak-hak asasi manusia: "...to reaffirm faith in fimrtdamental human rights, in the dignity and worth of the human person, in the equal rights of men and women and of nations large and small." Keamanan kolektif sejatinya tercipta tidak dengan mengorbankan hak-hak dasar individu.
Undang-Undang (UU) Anti-Terorisme Indonesia, disahkan oleh Dewan Perwakilan Rakyat (DPR) dengan syarat bahwa amandemen terhadap UU tersebut diajukan dalam jangka waktu satu bulan sejak tanggal pengesahan, mengundang kontroversi yang luas. UU Anti-Terorisme tersebut seharusnya memiliki fungsi sebagai komponen pendukung prinsip penegakan hukum dan memberikan dasar hukum yang adil, serta secara efektif mencegah terjadinya aksi terorisme.
Tesis ini menguraikan tantangan-tantangan bagi hak-hak asasi manusia yang muncul akibat 'perang melawan teror' yang dikumandangkan sejak terjadinya serangan terorisme pada 11 September 2001 di AS dan peristiwa pengeboman 12 Oktober 2002 di Bali. Dengan UU Anti-Terorisme Indonesia sebagai fokusnya, tesis ini menganalisis bagaimana kontra-terorisme internasional berpengaruh besar terhadap pasal-pasal dalam UU Anti-Terorisme Indonesia, bagaimana hak-hak asasi harus berkompetisi dengan kontra-terorisme internasional untuk menjadi prioritas utama dalam pertimbangan pengambilan kebijakan, dan konstituen-konstituen apa saja yang hadir dalam pembuatan UU Anti-Terorisme Indonesia.

The attacks of 11 September 2001 fundamentally changed the understanding of the United States (US) and the world of the threat posed by terrorism. With this new comprehension has come the realization that significantly improved collection and use of intelligence will be required to prevent catastrophic terrorist attacks in the future.
Growing concerns over terrorism induce stricter counter-terrorism policies and anti-terrorism legislations in parts of the world. Albeit backed up by United Nations (UN) Resolutions 1333/2000 and 1373/2000, counter-terrorism should not degrade the fulfillment of basic human rights at all. UN has even stated their determination "to reaffirm faith in fundamental human rights, in the dignity and worth of the human person, in the equal rights of men and women and of nations large and small" in its charter. Collective security cannot be formed on the cost of individual rights.
The Indonesian Anti-Terrorism Law passed by the Parliament with one condition that the Government would put forward amendment within a month, generated controversy broadly. The Law should have been serving as an important building block in strengthening the rule of law and a fair legal basis, effectively prevented acts of terrorism.
The thesis would take into account the particular challenges raised for human rights by the 'war on terror' declared in the wake of the events of 11 September 2001 terrorist attacks in US and 12 October 2002 bombing blasts in Bali. Taking focus on Indonesian Anti-Terrorism Law, it would analyze on impact of the global wave of combating terrorism to Indonesian Anti-Terrorism Law, how human rights and combating terrorism are contending to claim top priority, and what constituents were present in the making of the Indonesian Anti Terrorism Law.

"This book analyzes, first part describes the soft threats to human rights, derived from the devaluation of the politics and the productive economy with regard to the finance. It entails the concealment of the reality in the shape of exploitation as the tax havens and in the shape of marginalization of the persons with different abilities. The second part include a study of hard threats to human rights and examines two cases of failed states, Afghanistan and Somalia, in which the violence has supplanted the politics and the economy. In view of these situations it is necessary to rethink the force of classic ius gentium and the humanitarian right. The third part presents the European Union as a legal and political space in which conditions of a worthy life are better defended by means of the primacy of practical reason and social state of law, and by the requirement of peace as the main rule of international relations.

This article looks at the issue of enforced disappearances of migrants during their migratory journey or once they have reached their destination, a subject yet to be addressed in the literature. It examines how the legal and analytical framework provided by international human rights law and migration law applies to enforced disappearances of migrants. It then reviews the factors that contribute to this phenomenon in different contexts, including the disappearance of migrants for political reasons, those that take place in detention and deportation processes and those that take place within the context of migrant smuggling and trafficking."

"ABSTRAK
Hubungan antara penyidik dan penuntut umum dalam penanganan perkara
dijembatani dengan prapenuntutan. Dalam prapenuntutan ini tidak ada batasan
berapa kali bisa terjadi bolak-balik hasil penyidikan antara penyidik dengan
penuntut umum. Dampaknya adalah menumpuknya perkara tindak pidana di
Kejaksaan. Sehingga terjadi ketidakpastian hukum baik bagi tersangka maupun
korban, hal inilah yang akan dilihat dalam perspektif hak asasi manusia.
Penelitian ini adalah penelitian yuridis normatif dengan desain preskriptif. Hasil
penelitian menyimpulkan prapenuntutan tidak dilakukan secara maksimal oleh
penuntut umum karena ketidaktegasan penuntut umum menyikapi suatu perkara.
Karenanya perlu ketegasan penuntut umum dalam menyatakan sikap terhadap
suatu perkara yang didukung oleh standar operasional prosedur, dengan demikian
kepastian hukum sebagai salah bentuk satu hak asasi manusia akan dapat
diperoleh oleh korban maupun tersangka.

ABSTRACT
The relation between investigators and prosecutors in case handling abridged with
pre-prosecution. In this pre-prosecution there is no limit how many times can
come back and forth between certified the results of the investigation by the
public prosecutor. The implications of this is the build up the matter of a criminal
offense in prosecutor ' s office. So happen uncertainty law good for the suspect, as
well as victims these matters would be seen in perspective human rights. This
research is research juridical normative with a design prescriptive. The results of
research concludes pre-prosecution not carried out optimally by the public
prosecutor because indecisiveness prosecutors due to a cause. Therefore need to
explicitness prosecutors in declaring attitude toward a cause that is powered by
standard operating procedures, thus legal certainty as any the form of a human
rights will be obtained by the victim, and suspect."

"Penelitian ini memfokuskan kepada kebijakan Australia yang dikenal dengan istilah Operation Sovereign Borders, terutama mengenai faktor-faktor yang menyebabkan Australia memberlakukan Operation Sovereign Borders dan hak-hak yang dilanggar di dalam melaksanakan Operation Sovereign Borders tersebut. Penelitian ini merupakan penelitian kualitatif-deskriptif. Hasil penelitian menyarankan bahwa sebagai negara yang telah meratifikasi dan menjadi negara pihak dalam Konvensi PBB Tahun 1951 tentang Pengungsi dan Protokolnya Tahun 1967, serta ICCPR, maka seharusnya pelaksanaan Operation Sovereign Borders yang dijalankan oleh Pemerintah Australia tetap tunduk pada kewajiban-kewajiban internasional terkait pencari suaka dan pengungsi yang datang ke negaranya dan tidak melanggar hak-hak mereka.

This research focuses on Australia's policy known as The Operation Sovereign Borders. In particular, it emphasizes on the sources of changes (factors) that causes Australia to establish The Operation Sovereign Borders and the human rights that are breached from the implementation of The Operation Sovereign Borders. This is a qualitative-descriptive research design. The results of this thesis suggest that as a country that has ratified and become a state party of The United Nations Convention and Protocol Relating to The Status of Refugees in The Year 1951 and 1967, and The ICCPR, The Operation Sovereign Borders that is carried out by the Australian Government should be align with its international obligation regarding asylum seekers and refugees entering its territory and does not breach its human rights obligation.

"Tourism activities in era globalization bring positive and negative impacts especially for the host countries destination. To minimize the negative impacts it is very important to always promote the sustainable development of tourism including from a human rights perspective. This paper will discuss concerning who have responsibility to promote a human rights related with sustainable development of tourism. To explore the topic in this article, Author will study both international human rights instruments and environmental convention as well as the soft law regarding the tourism sector such as the UN WTO Global Code Of Ethics. The Law No. 10 Year 2009 concerning Indonesia Tourism Law is also part of legal material studied in this paper. There are national, international legal instruments of the human rights as well as UNWTO Global Codes of Ethics which can be utilized to promote sustainable tourism through human rights perspective. It is considered that all stakeholders have responsibility to promote sustainable development of tourism"
