"Less than 30% of psychologists report familiarity with transgender and gender nonconforming (TGNC) clients' needs. The clients, in turn, report a lack of support in their gender journeys. There is clearly a large gap in knowledge, skill, and competence in this area of practice. This clinical guide aims to fill that gap by providing mental health practitioners with an affirmative approach that emphasizes a collaborative partnership guided by client-driven goals. An expert panel of contributors teaches readers strategies for working with a diverse array of TGNC clients, including adolescents, older adults, parents, and people of color. Client factors, including sexual orientation, religious and spiritual beliefs, and traumatic experiences, are also given special attention. Tesis ini membahas pengaruh gender dalam pembuatan akta Notaris, dengan studi khusus pada transgender dan khuntsa. Ketika Notaris membuatkan akta, terdapat komparisi yang berisikan mengenai identitas para pihak. Saat pihak ini merupakan seorang transgender atau khuntsa, yang biasanya terdapat perbedaan antara fisik yang ditampilkan dan jenis kelamin yang terdapat di kartu identitas, maka penulisan identitas di dalam komparisi akan membingungkan. Penentuan hak para transgender dan khuntsa dalam hal mewaris akan menjadi masalah tersendiri. Permasalahan di dalam penelitian ini adalah mengenai hak mewaris terhadap pelaku seorang berkelamin ganda (khuntsa) dan seorang transgender ditinjau dari Hukum Islam dan KUHPerdata. Selain itu juga mengenai ketentuan pembuatan akta yang dikeluarkan oleh Notaris apabila yang menjadi penghadap adalah seorang berkelamin ganda (khuntsa) dan seorang transgender. Hasil analisa penelitian ini bahwa untuk mewaris, hak mewaris dari seorang khuntsa dilihat dari jenis kelamin dominannya begitu pula untuk hak mewaris dari seorang transgender harus kembali ke jenis kelamin pada saat yang bersangkutan dilahirkan jika ditinjau berdasarkan Hukum Islam. Dalam hal pembuatan akta, Notaris menggunakan identitas dan jenis kelamin terakhir yang tertulis di dalam kartu tanda pengenal, baik penghadap tersebut transgender atau khuntsa.

 


This thesis discusses about the influence of gender in making a notarial deed, in particular of the transgender and khuntsa studies. When a Notary makes a deed, there are comparitie containing the parties identities. In term of the party is a transgender or khuntsa, which there is usually a difference between the physical appearance and the gender mentioned on the identity card, then it will be a confusing to mention the identity on the comparitie. Determining the rights of transgender people and khuntsa will be a problem itself. The problem in this study relates to the inheritance rights of the double infidel (khuntsa) and a transgender according to the Islamic law and KUHPerdata. Moreover about the provisions of making a deed issued by a Notary if the party is a double androgynous person (khuntsa) and a transgender person. The results of the study analysis are in inheritance, the inheritance rights of a khuntsa are seen from the dominant sex as well as the the inheritance rights of a transgender must return to the sex at the time the person was born if viewed based on Islamic Law. In the case of making a notarial deed, the Notary uses the last identity and gender written on the identification card, whether the person is transgender or khuntsa.
