"[Skripsi ini menjelaskan akibat hukum dari pengalihan objek jaminan fidusia
serta upaya hukum yang dapat dilakukan oleh kreditur terhadap objek jaminan fidusia
yang telah dialihkan kepada pihak lain secara sepihak. Selain itu, dijelaskan pula
akibat hukum dari adanya cidera janji debitur. Pengalihan ini dilakukan berulangkali
ke beberapa pihak lain dari waktu ke waktu untuk melanjutkan pelunasan debitur
lama tanpa sepengetahuan krediturnya. Tujuan penulisan ini untuk mengetahui akibat
dan kewajiban hukum dari perbuatan tersebut. Berdasarkan penelitian ini diketahui
berbagai permasalahan kurangnya perlindungan hukum dan kepastian hukum yang
terdapat dalam undang-undang jaminan fidusia yang diberikan kepada para pihak
dalam proses jaminan fidusia.;This thesis explains about the legal consequences arising from the transfer of

found in the Law No. 42 of 1999 concerning Fiduciary given to the parties in

"ABSTRAK
Notaris dalam menjalankan tugas dan kewajibannya, ada saja notaris yang sengaja atau lalai yang mengakibatkan kerugian terhadap pihak yang berkepentingan. Pihak yang berkepentingan yang mengalami kerugian tersebut dapat menuntut notaris yang dengan sengaja atau karena kelalaiannya dalam menjalankan tugas dan kewajibannya dengan berdasarkan peraturan-peraturan yang berlaku. Permasalahan yang penulis bahas adalah perlindungan hukum terhadap pembeli yang beritikad baik atas kelalaian notaris yang memberikan sertifikat kepada pihak yang tidak berkepentingan dan akibat hukum atau sanksi yang diberikan kepada notaris yang membuat akta kuasa menjual tanpa didukung bukti kepemilikan yang sah. Metode penulisan tesis ini menggunakan bentuk penelitian hukum yuridis normatif, metode analisis data kualitatif dan tipe penelitian deskriptif analitis. Dari penelitian ini dapat diambil kesimpulan bahwa kelalaian notaris dalam putusan nomor 196/Pid.B/2019/PN.Dps. Notaris melanggar ketentuan dalam Pasal 15 ayat (2) huruf e, Pasal 16 ayat (1) huruf a dan Pasal 17 ayat (1) huruf i. Notaris tidak melakukan pengecekan legalitas dokumen, memberikan keterangan palsu dengan tidak memberitahukan keberadaan sertipikat, memberikan sertipikat kepada pihak yang tidak berkepentingan dan tidak memberikan penyuluhan hukum, maka menimbulkan akibat hukum yang dapat dikenakan sanksi administratif, perdata dan pidana.

ABSTRACT

Notary in carrying out its duties and obligations, there is a deliberate or negligent notary that resulted in the loss of the concerned trust. The interested persons who suffer from such losses can prosecute the notary intentionally or because of their negligence in carrying out their duties and obligations under the prevailing regulations. The issue that the author discusses is legal protection against buyers who are in good faith for notary negligence that gives the certificate to the unconcerned and the consequences of the law or sanctions given to the notary who makes the deed of the Sfera sell without the supported evidence of legitimate work. The Pura method of writing this thesis utilizes normative juridical legal research forms, qualitative data analysis methods and types of analytical descriptive research. From this study can be concluded that the negligence of notary in the decision number 196/PID. B/2019/PN. Dps. Notary in violation of article 15 clause (2) Reduce E, Article 16 paragraph (1) reduce A and article 17 paragraph (1) reduce I. Notary does not conduct SVLK checking of documents, giving false information by not informing the existence of a Sertipikat, giving a Sertipikat to the disinterested and not providing legal counseling, hence the legal consequences that can be imposed by administrative, civil and criminal sanctions."

Banyak orang tidak mengenal istilah Perwakilan, Kuasa dan Pemberian Kuasa dengan benar. Tidak hanya masyarakat umum tetapi dari kalangan profesi seperti Advokat, Notaris, Penyidik, Jaksa dan Hakim juga masih kurang memahami arti dari istilah tersebut. Kekurangpahaman mereka ini lebih banyak karena kurangnya waktu yang dipergunakan untuk meneliti arti dari istilah-istilah tersebut.
Hadirnya tesis ini diharapkan dapat membantu pembaca yang membutuhkan pengertian yang sesungguhnya akan arti dari penggunaan istilah Perwakilan, Kuasa dan Pemberian Kuasa. Tidak hanya pengertian teoretis yang disajikan, tetapi disampaikan juga contohcontoh kasus yang sudah menjadi kasus di pengadilan berikut dengan analisa solusi dari penulis.
Dengan segala keterbatasan yang ada, penulis telah berupaya secara maksimal untuk meneliti penggunaan istilah tersebut, sehingga diharapkan setelah membaca tesis ini, pembaca akan mengerti arti dari istilah tersebut dan penggunaannya dapat dilakukan oleh pembaca secara tepat.

Abstract
Many people do not familiar with the terms of Representation, Authorization and Authorization Provision correctly. Not only the public but also the professions as an Advocate, Notary, Investigator, Prosecutor, and Judge still do not understand the meaning of the term. Their lack of understanding is more due to lack of time needed to examine the meaning of those terms.
The presence of this thesis is expected to help the reader who requires a real understanding of the meaning of using the term Representation, Authorization and the Authorization Provision. Not only presented a theoretical sense, but also presented examples of cases that have been the case in court along with the analytical solution of the author.
With all the limitations that exist, the authors have attempted to investigate the use of the terms in maximum, so hopefully after reading this thesis, the reader will understand the meaning of these terms and the reader can make their use exactly.

"Perlindungan hukum terhadap pekerja adalah pemenuhan hak dasar dan dilindungi oleh konstitusi. Perlindungan pekerja bertujuan untuk menjamin kesamaan kesempatan, perlakukan tanpa diskriminasi dan mewujudkan kesejahteraan pekerja dan keluarganya. Perlindungan hukum bagi pekerja adalah perlindungan waktu kerja, keselamatan dan kesehatan kerja, pengupahan dan kesejahteraan. Penelitian ini bertujuan untuk mengetahui pelaksanaan jaminan sosial pekerja pada kantor Notaris di Kabupaten Merauke, untuk mengetahui perlindungan hukum bagi pekerja pada kantor Notaris di Kabupaten Merauke dan untuk mengetahui upaya yang dilakukan oleh pekerja apabila perlindungan hukum baginya tidak mengikuti jaminan sosial sesuai dengan yang diperjanjikan. Penelitian ini adalah penelitian hukum yuridis normatif, yaitu penelitian lapangan untuk mengumpulkan data-data yang berkaitan dan penelitian hukum normatif yaitu mengkaji hukum sebagai norma didasarkan penelitian kepustakaan. Data yang diperoleh dianalisis secara kualitatif selanjutnya disajikan dalam bentuk uraian yang bersifat analisis. Hasil penelitian menunjukan bahwa proses pengikatan hubungan kerja pekerja pada kantor Notaris di Kabupaten Merauke adalah dengan perjanjian secara lisan sesuai dengan Pasal 1320 KUHperdata dan pelaksanaan jaminan sosial, perlindungan hukum bagi pekerja pada kantor Notaris di Kabupaten Merauke adalah perlindungan waktu kerja, perlindungan keselamatan dan kesehatan, perlindungan upah dan perlindungan kesejahteraan dan upaya yang dilakukan oleh pekerja apabila perlindungan hukum baginya tidak sesuai dengan yang diperjanjikan adalah pekerja Notaris tidak dapat melakukan upaya hukum karena pekerja Notaris tidak membuat perjanjian kerja tertulis, sehingga tidak memiliki pegangan untuk melakukan upaya hukum.

Labour is an inseparable part of national development based on Pancasila and the 1945 Constitution of the Republic of Indonesia. Legal protection for workers is the fulfillment of basic rights and is protected by the constitution. Worker protection aims to guarantee equal opportunity, treat without discrimination and realize the welfare of workers and their families. Legal protection for workers is protection of working time, occupational safety and health, wages and welfare. This study aims to determine the implementation of workers' social security In the Notary office in Merauke Regency, to find out the legal protection for workers at the Notary office in Merauke Regency and to find out the efforts made by workers if legal protection for them does not follow social security in accordance with promised. This research is normative juridical legal research, namely field research to collect related data and normative legal research, namely studying law as a norm based on literature research. The data obtained were analyzed qualitatively and then presented in the form of a descriptive description. The results of the study show that the process of binding employment relations in the Notary office in Merauke Regency is by verbal agreement in accordance with Article 1320 of the Civil Code and the implementation of social security, legal protection for workers at the Notary office in Merauke Regency is protection of working time, protection safety and health, protection of wages and protection of welfare and the efforts made by workers if the legal protection for them is not in accordance with what was agreed, namely the Notary worker cannot take legal action because the Notary worker does not make a written work agreement, so he does not have a handle on take legal action."

Tesis ini membahas mengenai perlindungan hukum bagi pemegang Hak Milik Atas Satuan Rumah Susun yang hak atas tanah bersamanya berada diatas tanah Hak Pengelolaan, dengan analisa kasus Apartemen Mangga Dua Court yang dalam hal ini para pemegang Hak Milik Atas Satuan Rumah Susun baru mengetahui status tanah bersama dari Apartemen yang mereka miliki adalah Hak Guna Bangunan diatas tanah Hak Pengelolaan bukan Hak Guna Bangunan diatas tanah Negara. Digunakan metode penelitian kepustakaan yang bertujuan untuk menemukan masalah (problem finding) untuk kemudian menuju pada suatu penelitian untuk mengatasi masalah (problem solution). Permasalahan timbul pada saat para pemegang Hak Milik Atas Satuan Rumah Susun dari Apartemen Mangga Dua Court akan memperpanjang hak atas tanah bersamanya, dan dalam proses perpanjangan hak tersebut, mereka diwajibkan untuk mendapatkan Rekomendasi dari pemegang Hak Pengelolaan dengan membayar Uang Pemasukan yang jumlahnya jauh lebih besar dari Uang Pemasukan yang dibayarkan kepada Negara. Pemegang Hak Milik Atas Satuan Rumah Susun dari Apartemen Mangga Dua Court yang diwakili oleh Perhimpunan Penghuninya mengajukan gugatan perdata pada Pengadilan Negeri Jakarta Pusat dengan Nomor Perkara 205/Pdt.G/2007/PN.Jkt.Pst dan telah mendapatkan Putusannya. Penelitian ini membahas mengenai perbedaan antara rumah susun yang tanah bersamanya berada diatas tanah Negara dengan rumah susun yang tanah bersamanya berada diatas tanah Hak Pengelolaan, hal-hal yang harus diperhatikan dalam rangka pembangunan rumah susun yang yang tanah bersamanya berada diatas tanah Hak Pengelolaan dan perlindungan hukum bagi pemegang Hak Milik Atas Satuan Rumah Susun yang tanah bersamanya berada diatas tanah Hak Pengelolaan.

ABSTRACT
This thesis deals with legal protection for the Holder of Ownership Right on Apartment Unit whose Joint Land Rights is upon the Land having the status of Management Rights, with a case analysis of Mangga Dua Court Apartment which in this case the Holders of Ownership Right on Apartment Unit has recently known the Joint Land status of Apartment is Building Rights on the Land having the status of Management Rights instead of Building Rights upon the State Land. Bibliographical research method is applied with the purpose of problem finding which then heading toward a research to resolve the problem (problem solution). The problem arises when the Holders of Ownership Right on Apartment Unit of Mangga Dua Court Apartment extend their Joint Land Rights, and during the process of said rights extension, and in the process of the right renewal, they are obliged to get a recommendation from the Management Right owner by paying revenue money which mounted bigger than Revenue Money that are paid for the government. The Holders of Ownership Right on Apartment Unit of Mangga Dua Court Apartment who was represented by its Occupants Association filed a civil suit to the District Court of Central Jakarta under Case Number 205/Pdt.G/2007/PN.Jkt.Pst and has obtained its Verdict. This research deals with the difference between Apartment whose Joint Land is on the State Land and Apartment which Joint Land is on Land having the status of Management Rights, the matters that must be taken into consideration within the framework of building Apartment whose Joint land is on Land having the status of Management Rights and legal protection for the Holder of Ownership Right on Apartment Unit whose Joint land is on land having the status of Management Rights.

"Penelitian ini membahas mengenai pertanggungjawaban hukum perusahaan asuransi atas terjadinya pemalsuan polis yang dilakukan oleh agen asuransinya. Penelitian ini ditulis dengan menggunakan metode doktrinal. Yang menjadi permasalahan dalam penelitian ini adalah bagaimana hubungan hukum antara perusahaan asuransi dan agen asuransi, serta bagaimana bentuk tanggung jawab perusahaan asuransi dalam hal terjadi pemalsuan polis yang disebabkan oleh agen asuransinya. Agen asuransi berperan sebagai pihak yang mewakili perusahaan asuransi dalam memasarkan produk asuransi. Untuk itu, peran agen asuransi merupakan peran yang krusial. Dari hasil penelitian dapat disimpulkan bahwa terdapat hubungan hukum yang didasarkan pada sebuah perjanjian kerjasama antara perusahaan asuransi dan agen yaitu Perjanjian Keagenan. Hubungan hukum yang timbul adalah kontraktual. Perusahaan asuransi memberikan kuasa kepada agen asuransinya untuk bertindak dan berwenang atas nama perusahaan. Untuk itu, kesalahan ataupun pelanggaran yang dilakukan oleh agen dalam menjalankan wewenangnya menjadi tanggung jawab perusahaan asuransi yang mereka wakili. Adapun, bentuk tanggung jawab perusahaan asuransi dapat berupa tanggung jawab perdata dan tanggung jawab pidana. Tanggung jawab perdata disebut juga dengan tanggung jawab pihak ketiga yang berdasar pada Pasal 1367 KUHPerdata atau dikaitkan dengan asas vicarious liability. Selain itu, juga terdapat pidana korporasi yang dapat dijatuhkan berdasarkan pada Pasal 81 Ayat (1) UU Perasuransian.

This research discusses the legal liability of insurance companies for the occurrence of policy forgery committed by their insurance agents. The article is written using a doctrinal method. The issues addressed include the legal relationship between the insurance company and its agents, as well as the extent of the insurance company's responsibility in cases of policy forgery by its agents. Insurance agents act as representatives of the insurance company in marketing insurance products, making their role crucial. The research concludes that there exists a legal relationship based on a cooperation agreement between the insurance company and its agents, as known as Agency Agreement. This legal relationship is contractual. The insurance company grants authority to its agents to act on its behalf. Therefore, any errors or violations committed by agents in exercising this authority are the responsibility of the insurance company they represent. The forms of responsibility of insurance companies can take the form of civil liability and criminal liability. The insurance company's liability can include civil liability, also known as third-party liability under Article 1367 of the Civil Code or under the principle of vicarious liability. Additionally, corporate criminal liability can be imposed under Article 81 (1) of the Insurance Law.

"ABSTRAK
Tesis ini membahas mengenai penjaminan fidusia atas objek yang berupa
bangunan dalam perspektif teori pemisahan horizontal. Pada tesis in akan dibahas
mengenai dua hal. Pertama, pembahasan mengenai penerapan asas pemisahan
horizontal terhadap bangunan yang didirikan di atas tanah milik orang lain sebagai
objek jaminan fidusia dalam teori dan praktik. Kedua, pembahasan mengenai
permasalahan-permasalahan yang selama ini terjadi dalam praktik pemberian
fidusia atas objek berupa bangunan. Penelitian ini menggunakan metode
penelitian yuridis normatif, dimana data penelitian ini sebagian besar berasal dari
studi kepustakaan dan wawancara dengan beberapa narasumber. Hasil dari
penelitian ini menyatakan bahwa Fidusia atas bangunan dapat terjadi karena
hukum tanah di Indonesia menganut asas pemisahan horizontal yang merupakan
warisan dari hukum adat. Asas pemisahan horizontal bertujuan untuk melindungi
pihak yang hanya memiliki bangunan tanpa memiliki tanah. Meskipun dalam
hukum tanah nasional menganut asas pemisahan horizontal, namun dalam
praktiknya fidusia atas bangunan bukanlah suatu pilihan hukum bagi pemilik
tanah atau bangunan yang ingin menjaminkan asetnya sebagai jaminan utang
secara terpisah. Karena pengaturan fidusia atas bangunan ini telah diatur
sedemikian rupa sehingga hanya bangunan yang didirikan di atas hak atas tanah
tertentu (yang bukan merupakan objek Hak Tanggungan) yang bisa dijadikan
objek jaminan fidusia. Sedangkan kendala-kendala yang banyak menimbulkan
permasalahan dalam praktinya, antara lain disebabkan karena belum adanya
sertipikat atas bangunan sebagai tanda bukti kepemilikan, fidusia didaftarkan
dengan sistem online sehingga rawan terjadinya fidusia ulang, belum terdapat
suatu peraturan yang terintegrasi antara peraturan-peraturan dalam bidang hukum
jaminan, kebendaan, dan tanah mengenai fidusia atas bangunan, serta objek
jaminan yang hanya mengenai bangunan, maka akan ada kendala ekseskusi.

ABSTRACT
This thesis is concerning about building that is built on the land owned by other as
fiduciary object from horizontal separation principle perspective. This thesis is
mainly focusing about two problems. Firstly, the horizontal separation principle
that is applied to a building that built on the land owned by other as a fiduciary
object in theory and practice. Secondly, issues that occurred from fiduciary of the
building that built on the land owned by other. This study uses a normative
research, whereby the research data is largely derived from the literature study and
interviews. The results of this research stipulates that fiduciary of the buildings
can be conducted according to Indonesian land law which is adopting the
horizontal separation principle, inherited from Indonesian customary law. The
horizontal separation principle aims to protect those who only have a building
without having the land. Although the national land law embraces horizontal
separation principle, in practice, fiduciary of building is not an option for the
owner of the land or buildings who wanted to collateralize their assets separately.
Because the fiduciary of the building regulations has been arranged in a way that,
only buildings which built on certain land rights (which is not a Mortgage object)
that can be classified as fiduciary object. Meanwhile the constraints that cause a
lot of problems in practice, is partly due to the absence of the buildings certificate
as the proof of ownership. Fiduciary, which registered with the online system, is
so prone to re-fiduciary, yet there is no rule that integrates all regulations in the
field of security law, material, and land law, furthermore, to the object itself which
is only a building that built on the land owned by other, there will be problems in
