"Penelitian ini membahas mengenai pengaruh program penjaminan simpanan (deposit insurance) oleh LPS terhadap disiplin pasar dengan menggunakan data time series dari 120 bank umum selama kurun waktu Januari 2003 sampai dengan Desember 2013. Dengan menggunakan empat variasi yang menjadi variabel terikat berupa tingkat suku bunga deposito 1 bulan/TD, tingkat suku bunga deposito 3 bulan/TD3, tingkat suku bunga deposito rata-rata 1 dan 3 bulan/MRATE, dan Interbank Call Money, serta dengan variabel bebas berupa : (i) variabel risiko bank yang terdiri dari : NPL, LDR, BOPO, ROA, dan CAR; (ii) variabel kontrol yang terdiri dari Growth GDP dan Inflasi; dan (iii) variabel dummy, diperoleh hasil penelitian Kebijakan program penjaminan simpanan LPS yang di-proxy oleh dummy, efektif menekan tingkat bunga pada lag 4 periode. Dengan kata lain, kebijakan LPS pada saat ini membutuhkan masa tenggang waktu yang relatif lama yaitu 4 triwulan untuk dapat berpengaruh pada kedisplinan pasar.

This research explain about The Impact Analysis of Deposit Insurance Program by The Indonesia Deposit Insurance Corporation to Market Dicipline using the time series data from 120 banks from January 2003 to December 2013. I use Ordinary Least Squares/OLS method with four variations of dependent variables (time deposit rate 1 month, 3 months, average rate in 1 month and 3 months, and interbank call money), as well as the independent variable such as: (i) the bank's risk variables consisting of: NPL, LDR, ROA, ROA, and the CAR Ratios; (ii) the control variables consisting of GDP Growth and Inflation; and (iii) a dummy variable, the result of this research is deposit insurance program by IDIC with proxy by dummy, effectively reduces the interest rate on the lag 4 period. In other words, the policy of IDIC during the grace period requires a relatively long time, that is 4 quarters, to be able to influence the market discipline."

"[ABSTRAK
Sebagai salah satu unsur penting dalam jaring pengaman sistem keuangan khususnya dibidang perbankan, Lembaga Penjamin Simpanan (LPS) memiliki peranan untuk menjaga stabilitas keuangan Indonesia. Krisis ekonomi global pada tahun 2008 mengharuskan LPS meningkatkan Nilai Penjamin Simpanan. Penelitian ini bertujuan untuk mengetahui alasan LPS meningkatkan Nilai Penjamin Simpanan berdasarkan Undang-Undang Nomor 24 Tahun 2004 Tentang Lembaga Penjamin Simpanan sebagaimana telah diubah dengan Undang-Undang No. 7 Tahun 2009 dan peraturan perundang-undangan yang berlaku, menganalisis kemungkinan penurunan Nilai Penjamin Simpanan LPS serta hubungannya dengan penerapan risk-based premium di Indonesia untuk menjaga stabilitas sistem keuangan Indonesia. Penelitian ini merupakan penelitian kepustakaan yang bersifat yuridis-normatif. Data yang dikumpulkan dengan studi kepustakaan. Hasil dari penelitian ini adalah berdasarkan Pasal 11 UU LPS dimungkinkan terjadi penurunan terhadap Nilai Penjamin Simpanan LPS. Berdasarkan alasan peningkatan Nilai Penjamin Simpanan pada tahun 2008, yaitu adanya ancaman krisis ekonomi, UU LPS mengatur apabila alasan tersebut telah teratasi maka besaran Nilai Penjamin Simpanan dapat disesuaikan kembali. Maka berdasarkan hal ini, dimungkinkan untuk menurunkan Nilai Penjamin Simpanan LPS.

As one of the important elements in the financial safety net, especially in banking system, Indonesia Deposit Insurance Corporation (IDIC) has a big role to keep the stability of Indonesia?s financial system. The global economic crisis in 2008 requires IDIC increase the Deposit Insurance Coverage. "Tesis ini membahas program penjaminan polis asuransi berdasarkan peraturan perundang-undangan perasuransian dan Undang-Undang No. 4 Tahun 2023 tentang Pengembangan dan Penguatan Sektor Keuangan (“UU P2SK”) yang telah memberikan fungsi baru untuk melakukan penjaminan polis nasabah asuransi, yang harus dilaksanakan oleh Lembaga Penjamin Simpanan dalam jangka waktu 5 (lima) tahun sejak diundangkan. Permasalahan yang dibahas dalam Tesis ini adalah bagaimana pengaturan program penjaminan polis asuransi dalam peraturan perundang-undangan perasuransian dan UU P2SK serta bagaimana kesiapan Lembaga Penjamin Simpanan untuk melaksanakan fungsi program penjaminan polis asuransi. Metode penelitian yang digunakan adalah yuridis-normatif dengan bahan hukum primer dan sekunder, dengan teknik pengumpulan data melalui studi kepustakaan dan wawancara dengan analisis data secara kualitatif. Berdasarkan hasil penelitian, diperoleh kesimpulan bahwa sebelum diterbitkannya UU P2SK, pengaturan terkait program penjaminan polis hanya diatur secara singkat berdasarkan Undang-Undang No. 40 Tahun 2014 tentang Perasuransian dalam Pasal 53 ayat (1) sampai ayat (4), namun semenjak diundangkannya UU P2SK, pengaturan program penjaminan polis menjadi semakin lengkap. Kesimpulan lain adalah Lembaga Penjamin Simpanan telah melaksanakan persiapan program penjaminan polis yaitu menyusun roadmap yang memuat hal-hal yang harus dilaksanakan dengan target pelaksanaan dibagi per-tahun; melakukan beanchmark atau studi banding ke negara- negara lain yang telah memiliki lembaga penjamin polisnya sendiri; merancang RPP Program Penjaminan Polis, RPLPS tentang Pelaporan Perusahaan Asuransi, RPLPS tentang Penjaminan Polis Asuransi, dan RPLPS tentang Likuidasi Perusahaan Asuransi untuk selanjutnya akan diterbitkan di awal tahun 2024; melakukan pembentukan grup untuk menangani pelaksanaan program penjaminan polis; melakukan penyesuaian susunan dewan komisioner; dan melakukan program rekrutmen pegawai yang terdiri atas penerimaan lulusan baru dan penerimaan pegawai yang telah memiliki pengalaman kerja minimal 5 (lima) tahun. Saran yang dapat diberikan dalam penelitian ini adalah agar partisipasi dari ahli-ahli di bidang perasuransian dapat ditingkatkan dalam internal Lembaga Penjamin Simpanan melalui pelaksanaan rekrutmen terbuka agar pelaksanaan program penjaminan polis ditangani oleh individu-individu yang berpengetahuan baik di bidang perasuransian. Saran lainnya yakni agar persiapan yang dilaksanakan oleh Lembaga Penjamin Simpanan diawasi dengan baik oleh Otoritas Jasa Keuangan selaku lembaga yang mempunyai fungsi, tugas, dan wewenang pengawasan terhadap lembaga- lembaga keuangan termasuk perasuransian.

This thesis discusses the insurance policy guarantee program based on insurance laws and regulations and Law no. 4 of 2023 concerning the Development and Strengthening of the Financial Sector ("P2SK Law") which has provided a new function for underwriting insurance customer policies, which must be implemented by the Deposit Insurance Corporation within a period of 5 (five) years from its promulgation. The problems discussed in this thesis are how the insurance policy guarantee program is regulated in insurance laws and regulations and the P2SK Law and how prepared the Deposit Insurance Agency is to carry out the function of the insurance policy guarantee program as regulated in the P2SK Law. The research method used is juridical-normative using primary and secondary legal materials, with data collection techniques through literature study and interviews with qualitative data analysis. Based on the research results, it was concluded that before the issuance of the P2SK Law, regulations related to policy guarantee programs were only briefly regulated based on Law no. 40 of 2014 concerning Insurance in Article 53 paragraph (1) to paragraph (4), but since the promulgation of the P2SK Law, the regulation of policy guarantee programs has become more complete. Another conclusion is that the Deposit Insurance Corporation has carried out preparations for a policy guarantee program, namely preparing a roadmap containing things that must be implemented with implementation targets divided per year; carry out benchmarking or comparative studies to other countries that have their own policy insurance institutions; draft RPP Policy Guarantee Program, RPLPS concerning Insurance Company Reporting, RPLPS concerning Insurance Policy Guarantee, and RPLPS concerning Liquidation of Insurance Companies to be subsequently issued in early 2024; establishing a group to handle the implementation of the policy guarantee program; make adjustments to the composition of the board of commissioners; and carrying out an employee recruitment program consisting of accepting new graduates and recruiting employees who have a minimum of 5 (five) years of work experience. Suggestions that can be given in this research are that the participation of experts in the insurance sector can be increased internally at the Deposit Insurance Agency through open recruitment so that the implementation of the policy guarantee program is handled by individuals who have good knowledge in the insurance sector. Another suggestion is that the preparations carried out by the Deposit Insurance Agency be properly supervised by the Financial Services Authority as an institution that has functions, duties and supervisory authority over financial institutions including insurance."

Tulisan ini menganalisis tentang strategi manajemen krisis oleh humas Lembaga Penjamin Simpanan LPS dalam melakukan proses penanganan bank gagal, baik dalam bentuk likuidasi maupun penyelamatan bank gagal. Kepiawaian humas LPS dalam melakukan strategi manajemen krisis menjadi krusial karena performa tersebut dapat memengaruhi kepercayaan publik terhadap institusi bank dan industri perbankan secara keseluruhan, yang berdampak pada kondisi stabilitas ekonomi nasional. Dengan menggunakan konsep krisis dan manajemen krisis dari W. Timothy. Coombs, tulisan ini mencoba melihat bagaimana LPS mengimplementasikan strategi manajemen krisis dalam proses penanganan bank gagal, dalam rangka mencegah dan meredam kepanikan publik serta menjaga kepercayaan publik terhadap kinerja LPS dan reliabilitas industri perbankan secara keseluruhan dalam rangka turut berkontribusi untuk menjaga stabilitas ekonomi nasional.
ABSTRACT
This paper analyzes the crisis management strategy by public relations of Indonesia Deposit Insurance Corporation IDIC in handling bank resolution processes, either in the form of bank liquidation or bank recovery. The excellent performance of IDIC rsquo s public relations in crisis management is crucial because it influences public trust toward bank institutions and Indonesian banking industry as a whole, that will affect the condition of national economic stability. Using the concept of crisis and crisis management suggested by W. Timothy Coombs, this paper aims to capture on how IDIC implement the crisis management strategy in bank resolution processes, in order to prevent panic attack of the public and to maintain public trust to IDIC rsquo s performance and to the reliability of banking industry as a whole, as an effort to contribute in maintaining the national economic stability."

"Tesis ini membahas mengenai perlindungan hak pemegang saham publik dalam pengambilalihan Bank Gagal yang berstatus terbuka oleh Lembaga Penjamin Simpanan. Permasalahan yang diangkat dalam penulisan ini ketika Lembaga Penjamin Simpanan memiliki hak untuk mengambil alih segala hak, wewenang, kepemilikan, kepengurusan dari Bank Gagal bermaksud untuk menjual saham pemegang saham publik. Penulisan tesis ini menggunakan metode kepustakaan dengan data sekunder sebagai sumber datanya. Pengambilalihan Bank Gagal oleh Lembaga Penjamin Simpanan berdasarkan penyerahan hak kepemilikan melalui RUPS oleh para pemegang saham yang menyerahkan, serta Penyertaan Modal Sementara yang kemudian dikonversi menjadi saham. Kedua mekanisme tersebut menjadikan Lembaga Penjamin Simpanan sebagai pemegang saham mayoritas, namun tidak dapat menghilangkan pengakuan terhadap kepemilikan pemegang saham publik. Lembaga Penjamin Simpanan tidak memiliki hak untuk menjual saham pemegang saham publik yang tidak dikuasai oleh Lembaga Penjamin Simpanan apabila tidak diserahkan oleh pemilik hak sebagaimana dimaksud dalam teori property rule. Pengambilalihan yang dilakukan oleh Lembaga Penjamin Simpanan bukan bertujuan untuk menguasai Bank, namun untuk melaksanakan perintah Undang-Undang. Ketentuan take over, mewajibkan untuk dilakukan tender offer terhadap sisa saham. Peraturan No. IX.H.1. mengenai ketentuan tender sukarela mengecualikan tender offer terhadap pengambilalihan yang dilakukan berdasarkan perintah Undang-Undang. Ketentuan ini membuktikan pemegang saham publik tetap memiliki hak terhadap saham yang dimilikinya. Mengingat lamanya waktu untuk melakukan revisi terhadap Undang-Undang, maka Lembaga Penjamin Simpanan dapat meminta dilakukan uji materiil ke Mahkamah Konstitusi untuk meminta penjelasan terhadap siapa yang dimaksud dengan pemegang saham dan apa yang dimaksud dengan seluruh saham.

This thesis describes the protection of public shareholder rights in the takeover process of open-status Failing Bank performed by the Deposit Insurance Corporation. The main focus of this discussion is on the event the Deposit Insurance Corporation posits that it reserves the right to take over all rights, authority, title of ownership and management of the Failing Bank, and generalizes that the liquidation of the stocks includes those belonging to public shareholders. This thesis applies library research method using secondary data as data sources. The handling process of Failing Bank by Deposit Insurance Corporation is performed by surrendering of rights and powers of General Shareholders Meeting in part of the Failing Bank, and provision of temporary capital placement in part of the Deposit Insurance Corporation which is further conversed into shares. The dual mechanisms deems Deposit Insurance Corporation as the major shareholder, however still withstand recognition to the title of ownership of public shareholders. Deposit Insurance Corporation does not reserve the right to sell shares belonging to public shareholders that are not surrendered to the Deposit Insurance Corporation, as described in the theory of Property Rule. The takeover is performed by Deposit Insurance Corporation not for the purpose of acquiring the Bank, but as execution of the Law. The laws governing performance of takeover stipulates that the remaining shares must be disclosed in form of bidding offer or tender offer. Law number IX.H.1. governing voluntary tender excludes tender offer in the event of takeover prescribed by Law. This regulation substantiates that public shareholders reserves rights over their shares. Considering the time taken to conduct revision on the said law, Deposit Insurance Corporation may appeal for judicial review in the Constitutional Court to gain verification as to the reference for shareholder and as to the reference of shares as cited in the law.

"Great Depression telah menimbulkan banyak dampak bagi dunia, terutama dalam lingkup industri perbankan. Alhasil, untuk mendapatkan kepercayaan nasabah, pemerintah Amerika Serikat mendirikan korporasi untuk menjamin simpanan nasabah dengan metode Insurance Deposit Schemes bernama Federal Deposit Insurance Corporation (FDIC). Selanjutnya, dengan keberhasilan di Amerika Serikat, banyak negara khususnya Indonesia yang mengikuti jalur tersebut dengan mendirikan perusahaan penjamin simpanan bernama Lembaga Penjamin Simpanan (LPS). Namun dengan membandingkan kedua sistem tersebut terdapat beberapa persamaan dan perbedaan mengenai peran keduanya di kedua negara. Tesis ini dimaksudkan untuk menjawab dua pertanyaan. Pertanyaan pertama bagaimana persyaratan dan ketentuan skema penjaminan simpanan dalam rangka menjaga stabilitas keuangan di Indonesia dan Amerika Serikat dan yang kedua adalah bagaimana persamaan dan perbedaan skema penjaminan simpanan di Indonesia dan Amerika Serikat. Dengan menggunakan metode penelitian hukum normatif, tesis ini menunjukkan regulasi Lembaga Penjamin Simpanan di Indonesia dan Amerika Serikat serta perbedaan dan persamaan aturan dan ketentuan. Dengan membandingkan kedua sistem tersebut, meskipun kedua korporasi bertujuan untuk menjamin simpanan nasabah dan tujuan utamanya adalah untuk menumbuhkan kepercayaan masyarakat terhadap industri perbankan, tidak semua peran kedua korporasi tersebut sama.

The Great Depression has caused many impacts to the world, especially in the scope of banking industry. As a result, in order to gain customers’ trust, the government of the United States of America established a corporation to guarantee customers’ deposits with the method of Insurance Deposit Schemes named Federal Deposit Insurance Corporation (FDIC). Hereafter, by the success in the United States of America, many countries, especially Indonesia followed the path by establishing a deposit insurance corporation named Indonesia Deposit Insurance Corporation (IDIC). However, by comparing both systems there are several similarities and differences regarding their roles in both countries. This thesis intended to answer two questions. The first question is how are the requirements and provisions of the deposit insurance schemes in order to maintain financial stability in Indonesia and the United States of America and the second one is how are the similarities and differences of deposit insurance schemes in Indonesia and the United States of America. Using normative legal research methods, this thesis shows the regulations of Deposit Insurance Corporation in Indonesia and the United States of America as well as the differences and similarities of the rules and conditions. By comparing both systems, although both corporations aim to guarantee customers’ deposits and the main objective is to foster public trust in the banking industry, not all the roles of both corporations are the same.

"Hadirnya Corona Virus Disease 2019 (COVID-19), yang telah ditetapkan sebagai pandemi oleh World Health Organization, menimbulkan adanya penurunan pertumbuhan ekonomi dianggap perlu untuk dilakukan mitigasi oleh Pemerintah dan Komite Stabilitas Sistem Keuangan (KSSK) dengan tujuan untuk menjaga stabilitas sistem keuangan. Dengan itu, KSSK diberikan penguatan kewenangan yang ditetapkan dalam UU No. 2 Tahun 2020. Dalam rangka untuk mendukung pelaksanaan kewenangan KSSK menangani permasalahan stabilitas sistem keuangan, kewenangan dari anggota KSSK juga diperkuat dalam undang-undang tersebut, salah satunya adalah Lembaga Penjamin Simpanan (LPS). Metode penelitian penulisan skripsi ini adalah yuridis-normatif dan menggunakan data sekunder, yaitu bahan hukum primer dan sekunder, dan yang didukung dengan wawancara. Hasil penelitian menunjukkan bahwa kewenangan LPS yang diperkuat adalah LPS dapat meningkatkan intensitas bersama dengan OJK, melakukan beberapa tindakan untuk memenuhi likuiditas dalam penanganan bank, penyelamatan bank selain bank sistemik, dan merumuskan dan melaksanakan kebijakan penjaminan. Namun, dengan adanya penguatan kewenangan LPS tersebut ditemukan adanya beberapa permasalahan hukum, yang salah satunya adalah permasalahan terhadap kewenangan LPS untuk menempatkan dana di bank, perlunya kewenangan LPS untuk dapat mengakses data bank setiap saat, dan potensi moral hazard. Penelitian ini diharapkan dapat memberikan informasi baru serta memberikan masukan untuk menguatkan kewenangan LPS dalam melakukan akses data dan/atau informasi Bank dan menentukan batas waktu yang jelas terhadap keberlakuan kewenangan LPS untuk melakukan penempatan dana.

Corona Virus Disease 2019 (COVID-19), which has been declared as a pandemic by the World Health Organization, causes the decline in economic growth is considered necessary for mitigation by the Government and the Financial System Stability Committee (FSSF) with the aim of maintaining the stability of the financial system. Therefore, the FSSF was given authorities stipulated in Law No. 2 of 2020. In order to support the implementation of FSSF's authority to handle the stability issues of the financial system, the authority of FSSF members is also strengthened by the law, one of them is the Indonesia Deposit Insurance Corporation (IDIC). The method used in this research is a juridical-normative method with using secondary data that include primary and secondary legal material, also supported with interview. This research finds that the aforementioned IDIC's authorities are IDIC can improve the preparations and intensify the preparations with Financial Services Authority, initiate actions to manage and/or increase IDIC liquidity, make loans for other parties, and apply for a loan to the government. However, with the strengthening of IDIC’s authority, there are several legal problems that arise, such as issues regarding the fund placement, the need for IDIC to be able to access bank’s data at any time, and the possibilities of moral hazard. This thesis is aimed to provide new information and suggestions to strengthen IDIC's authority over accessing data and/or information of banks and determining the clear headline of the IDIC's enforceability of fund placement."

"Skripsi ini membahas mengenai kewenangan Lembaga Penjamin Simpanan (LPS) dalam melaksanakan resolusi bank gagal (bank resolution) terhadap Bank Selain Bank Sistemik yang mengalami permasalahan solvabilitas. Dalam hal ini, berdasarkan Undang-Undang Nomor 24 Tahun 2004 tentang Lembaga Penjamin Simpanan, LPS memiliki tugas yang salah satunya adalah melaksanakan penyelesaian bank gagal bank selain bank sistemik. Setelah berlakunya Undang-Undang Nomor 9 Tahun 2016, dan Undang-Undang Nomor 2 Tahun 2020 menyebabkan kewenangan LPS dalam melaksanakan resolusi bank gagal Bank Selain Bank Sistemik mengalami perbedaan dengan sebagaimana yang diatur di dalam Undang-Undang Nomor 24 Tahun 2004.
Oleh karena terdapat perbedaan tersebut, maka skripsi ini akan membahas mengenai pengaturan yang akan berlaku bagi LPS untuk sebagai pedoman penyelesaian Bank Selain Bank Sistemik dan perbedaan mengenai kewenangan LPS dalam melaksanakan penyelesaian permasalahan solvabilitas Bank Gagal Yang Tidak Berdampak Sistemik baik sebelum dan sesudah berlakunya Undang-Undang Nomor 9 Tahun 2016.
Bentuk penelitian skripsi ini adalah yuridis-normatif yang menghasilkan tipologi penelitian deskriptif. Hasil dari penelitian ini menemukan beberapa perbedaan mengenai kewenangan LPS dalam menyelesaikan masalah solvabilitas Bank Selain bank Sistemik antara pengaturan yang berlaku berdasarkan Undang-Undang Nomor 24 Tahun 2004, Undang-Undang 9 Tahun 2016 dan Undang-Undang Nomor 2 Tahun 2020.

The focus of this research is about the authority of Indonesia Deposit Insurance Corporation (IDIC) in carrying out the resolution of the failing bank (bank resolution) that does not pose systemic risk that has solvency problems. Based on Law Number 24 Year 2004 on Deposit Insurance Corporation, IDIC has duties, that which one of that duties is to formulate, determine and implement the resolution policy for failing banks that do not pose as a systemic risk. After the enactment of the Law Number 9 Year 2016 and the Law Number 2 Year 2020, Duties of IDIC have changed with as regulated in the Law Number 24 Year 2004.
Because there are have differences, this study will also to examine the differences regarding the authority of IDIC in carrying out the resolution of the failing bank (bank resolution) of the bank that does not pose as a systemic risk that has solvency problems, both before and after enactment of Law Number 9 Year 2016.
The research uses the normative-juridical approach with a descriptive typology. This research discover that the Law Number 9 Year 2016 and the Law Number 2 Year 2020 has some different with the Law Number 24 Year 2004
