"Existing international law is capable to govern the ?war on terror? also in the aftermath of September 11, 2001. The standards generally applicable to targeted killings are those of human rights law. Force may be used in order to address immediate threats, preventive killings are permitted under strict preconditions but targeted killings are prohibited.
In the context of armed conflicts, these standards are complemented by international humanitarian law as lex specialis. Civilians may only be targeted while directly taking part in hostilities and posing a threat to the adversary. Also in Israel and the occupied territory, these standards apply. Contrary to the Israeli supreme court?s view, international humanitarian law is not complemented by human rights law, but human rights law is, to some degree, complemented by international humanitarian law. According to these standards, many killings which would be legal according to the Israeli Supreme Court violate international law."

"Skripsi ini membahas mengenai Operasi Militer Aceh yang dilaksanakan pada tahun 2003-2004 dengan dikeluarkannya Keputusan Presiden No. 28 Tahun 2003 pada masa Presiden Megawati Soekarnoputri. Pertama, dibahas mengenai pengaturan konflik bersenjata non-internasional dalam Hukum Humaniter Internasional. Kedua, akan dilihat pengaturan perlindungan terhadap penduduk sipil dalam Hukum Humaniter Internasional dan Hukum HAM. Ketiga adalah relevansi Hukum Humaniter Internasional dan Hukum HAM tersebut dengan Operasi Militer Aceh, yaitu mengenai pengkategorian jenis konflik bersenjata dan perlindungan penduduk sipil dalam Operasi Militer tersebut. Kemudian akan dilakukan evaluasi terhadap pelaksanaan Operasi Militer Aceh paada periode 2003-2004.

This thesis discusses about Aceh Militar Operation held on 2003-2004 based on the issuance of President Decree No. 28 of 2003 in the period of President Megawati Soekarnoputri. First, will be discussed about non-international armed conflict in International Humanitarian Law. Second, will be discussed about the civilians protection in situation of non-international armed conflict. Third is about relevance of International Humanitarian Law and Human Rights Law with Aceh Military Operation, i.e. about categorization on type of armed conflict and civilians protection in Aceh Military Operation. Further, there would be evaluation Aceh Military Operation."
