Mekanisme reimbursement Pajak Pertambahan Nilai (PPN) pada industri hulu minyak dan gas bumi mengalami perubahan yang signifikan sejak PMK No. 218 Tahun 2014 diberlakukan. Tambahan persyaratan dokumen pengajuan reimbursement PPN seperti Surat Keterangan Fiskal, Surat Konfirmasi Penerimaan Negara dan konfirmasi faktur pajak dari Direktorat Jenderal Pajak membuat prosedur reimbursement PPN lebih lama dari sebelumnya. Berangkat dari fenomena tersebut, penelitian ini bertujuan untuk menganalisis proses formulasi PMK No. 218 Tahun 2014. Penelitian ini merupakan penelititan kualitatif dengan metode pengumpulan data primer melalui wawancara mendalam dengan beberapa narasumber utama. Hasil penelitian menunjukkan bahwa proses formulasi PMK 218 Tahun 2014 tidak melibatkan seluruh pihak yang berkepentingan dan tidak mempunyai alternatif pilihan kebijakan. Dalam proses formulasi kebijakan yang baik seharusnya mempertimbangkan masukan dari berbagai pihak dan mempunyai alternatif kebijakan.

The reimbursement of Value Added Tax (VAT) mechanism regarding upstream oil and gas industry has found significant change since the The Minister of Finance Decree No. 218/PMK.02/2014 enactment. Additional documents required in order to propose for VAT reimbursement such as Fiscal Certificate, Confirmation Letter, and Tax Invoice administered by the Director General of Taxation has proven make the procedures of obtaining VAT reimbursement is longer than before. Based on this phenomenon, this study is aimed to analyze the formulation process of The Minister of Finance Decree No. 218/PMK.02/2014. This qualitative research uses in-depth interview with numbers key informants as the primary data collection method. The result of this study showed that the formulation process of The Minister of Finance Decree No. 218/PMK.02/2014 does not involve all interested parties and failed to provide alternative policy options. In the process of policy formulation, it would be better to put into consideration inputs from various parties, along with composing a set of alternative policies.

"Dalam usaha minyak dan gas bumi di Indonesia, terdapat perjanjian-perjanjian yang mengikat para pihak seperti Production Sharing Contract dan juga Joint Operating Agreement. Dalam perjanjian-perjanjian tersebut tentunya terdapat klausula-klausula yang mengatur dan salah satunya adalah klausula Sole Risk. Pemahaman klausula Sole Risk ini sangat penting karena dalam contoh kasus antara PT Golden Spike Energi Indonesia dan Pertamina Hulu Energi Raja Tempirai terdapat perbedaan dalam mengartikan klausula Sole Risk yang ada di dalam perjanjian. Persyaratan dan pengaturan yang ada juga harus diperhatikan ketika ingin melaksanakan Sole Risk Operation. Dalam penelitian ini digunakan metode penelitian hukum normatif yang dilakukan dengan cara meneliti bahan pustaka yang ada.

In the oil and gas business in Indonesia, there are agreements that bind the parties such Production Sharing Contract and Joint Operating Agreement. In that agreements, there are clauses that regulate and one of them is a Sole Risk Clause. The understanding of Sole Risk clause is very important because in the case of PT Golden Spike Energi Indonesi and Pertamina Hulu Energi Raja Tempirai, there are differences in interpreting the Sole Risk clause that existing in the agreement. The terms and the regulations that existing should be considered when the parties want to do the Sole Risk Operation. In this research, it used the normative law research that is done by assessing the existing literatures."

"Ditahun 2010 Undang-Undang Migas No. 22 Tahun 2001 ditetapkan akan revisi. Alasannya, diundangkannya undang-undang ini menimbulkan berbagai permasalahan, khususnya diindustri hulu. Tesis ini meneliti ketentuan apa saja dalam undang-undang tersebut yang harus direvisi dan apakah system kontrak PSC harus direvisi karena tidak memiliki asas keadilan. Metode penelitiannya yuridis normative dan mengolah data sekunder. Hasil dari penelitian ini menunjukan bahwa ketentuan dalam UU migas yang harus direvisi menyangkut tiga aspek, yaitu kurang tegasnya ketentuan mengenai preferensi kepentingan dalam negeri; rumitnya birokrasi yang dapat menghambat investasi; dan efektifitas Badan Pelaksana. Penelitian ini juga menunjukan bahwa system kontrak PSC sudah menganut asas keadilan, sehingga sistem ini tidak perlu diubah.

In the year of 2010, natural oil and gas act No.22 year 2001 planned for revision. The reason beyond is this act has been predicted to causing several problems, especially in upstream industry. This study aims to examine on critical points that need revisions of the act and whether the PSC contract system need to be revised to fulfill social justice aspects. This study using juridical normative as research method and processing secondary data. The result of the study indicates that, critical points that need revision consisting of three aspects, the lack of firmness of ruling for domestic preference, complicated bureaucracy which impede investment and the effectiveness of executor body. This study result show also that the PSC contract system has no need to be revised as it already fulfilled social justice aspect."
