"Skripsi ini membahas dua pokok permasalahan. Pertama, materi-materi seperti apakah dalam program siaran yang merupakan pelanggaran kesusilaan ditinjau peraturan regulator penyiaran sekaligus merupakan pelanggaran kesusilaan dalam hukum pidana? Kedua, mengenai dapatkah sanksi pidana berjalan apabila sanksi administratif telah dijatuhkan oleh KPI sebagai salah satu regulator penyiaran? Dengan menggunakan metode penelitian kepustakaan yang dipadu dengan penelitian lapangan, skripsi ini bertujuan untuk memberikan penilaian kapan hukum pidana dapat berjalan dalam hal terdapat pelanggaran kesusilaan dalam program siaran. Analisis mengenai peraturan-peraturan yang ada yakni Pedoman Perilaku Penyiaran dan Standar Program Siaran (P3SPS) serta Undang-Undang Nomor 32 Tahun 2002 tentang Penyiaran dapat dijadikan penilaian mengenai hal tersebut. Skripsi ini berkesimpulan bahwa terdapat materi-materi yang dikategorikan sebagai pelanggaran kesusilaan menurut P3SPS juga dikategorikan sebagai materi pelanggaran kesusilaan dalam tindak pidana. Kesimpulan berikutnya adalah sanksi pidana dapat diterapkan walaupun KPI telah menjatuhkan sanksi administratif terhadap perbuatan pelanggaran kesusilaan.

This thesis mainly discuss about two problems. Firstly, what kind of materials in television broadcast program that is breach of broadcasting rules included as a criminal act of offensive against decency? Secondly, can penal punishment be punished if KPI as regulatory body imposed administrative punishment? By using the literature research method that is combined with the field research method, this thesis aims to answer when criminal law can be applied in cases of indecency on television broadcast program. This thesis analyzes rules related such as Broadcasting Code of Conduct and Standard of Broadcast Program (P3SPS) and Broadcasting Act Number 32/2002. This thesis concludes that criminal law can be applied to the cases of indecency in television broadcast program although KPI has imposed administrative punishment to acts against decency"

"The requirements of the community for information presently have become the major requirements in the daily living.
The existing information media, both newspapers and radio broadcast like the television broadcast must be able to meet the requirements on information in accordance with the era. With the sophisticated technology, satellites for broadcast relays, both radio and television broadcast have been developed. Furthermore, telecommunication technology and computer (digital technology) have set up an internet information media.
The competition has occurred between the television broadcasting industries, since the establishment of the television station RCTI in 1989, and later followed by SCTV, Indosiar and so forth. Until 2004, there are already 15 national private television stations.
The development of business industries on television broadcasting conducted competitively among these television broadcasts, had brought forth the issuance of Constitution No. 32 year 2002 on Broadcasting.
With the validity of the constitution, there has occurred a number of responses both pro and contra, due to the impact on the private television industries.
From the results of research, this had motivated the writer to further know the impact of Constitution No. 32 year 2002 on Broadcasting towards the business industries on television broadcast. The writer had carried out a Field Research through the distribution of questionnaires on 30 respondents in the program and technical divisions, and HRD of PT, RCTI.
In order to know the impact on the Constitution on Broadcasting No. 32 year 2002, some articles were considered very crucial, and the questionnaire data showed an independent variable, i.e. the crucial articles that influence the dependent variables (Broadcasting Program) having 15 articles. These articles will influence the development of the broadcasting stations and working outlines (DPK) of RCTI as the National Television.
With the issuance of the Constitution on Broadcasting No. 32 year 2002, this will influence the performance of RCTI, particularly in obtaining the competition of the market segments on advertisements already available. Conversely, Constitution on Broadcasting No. 32 year 2002, will protect the local programs and become a information and entertainment media adjusting with the Indonesian culture in supporting the Regional Autonomy Constitution.

"Perkembangan teknologi komunikasi bermanfaat untuk memproses dan menyampaikan informasi dengan cara yang semakin modern. Salah satu bentuk penyiaran dapat dilakukan melalui siaran televisi. Dalam skripsi ini membahas mengenai putusan pengadilan dalam Perjanjian Penunjukan Pelaksana Siaran Televisi Swasta Umum antara TVRI dan Indosiar. Perjanjian tersebut dimulai dari tahun 1994 sampai dengan tahun 2014, dalam perjanjian tersebut menyatakan bahwa TVRI sebagai pihak pertama menunjuk Indosiar untuk menjadi siaran televisi swasta umum, kemudian Indosiar berjanji untuk memberikan 12,5% dari seluruh penghasilannya kepada TVRI selama 20 tahun. Pada tahun 2000, pemerintah mengesahkan peraturan baru yang mengubah status TVRI dari Yayasan ke Perusahaan Jawatan. Hal tersebut membuat pihak Indosiar merasa tidak perlu lagi melaksanakan prestasinya. Kemudian TVRI mengajukan permohonan gugatan kepada Indosiar karena Indosiar tidak melakukan prestasinya sampai dengan tahun 2000. Namun sampai dengan putusan akhir, hakim menolak permohonan dari TVRI tersebut dan menyatakan bahwa Indosiar tidak melakukan wanprestasi.

Development of communication technology is useful to process and convey information in a way that the more modern. One form of broadcasting can be done via television broadcasts. This thesis concerning judgment of a court in agreement appointment of execution private television broadcast common between TVRI and Indosiar. The deal is started from 1994 until 2014, in the treaty states that TVRI as the first party constitute Indosiar to become a television broadcast of public, then Indosiar promised to give 12.5% of all income is to TVRI for 20 years. In 2000, the government adopt new rules that change the status TVRI from the foundation into the company jawatan. It makes Indosiar feel no longer have to carry out the performance. Then TVRI submit the application for a lawsuit to Indosiar because Indosiar did not do the performance until the end of year 2000. But until the end of the court, with a verdict the judge refused the request of TVRI and expressed that Indosiar not doing the tort."

"Perkembangan Teknologi Informasi dan Komunikasi (TIK) mengarah kepada jaringan pita-lebar yang berbasis Internet Protocol (IP). Dengan jaringan berbasis IP pita-lebar ini, berbagai layanan dapat diantar ke pelanggan tidak terbatas pada layanan berbasis suara saja, namun juga mampu mencakup layanan data dan video dengan kualitas tinggi. Salah satu dari layanan yang menjadi pembicaraan hangat saat ini dan disebut-sebut sebagai sebuah hasil revolusi dari teknologi penyiaran dan konvergensinya dengan teknologi telekomunikasi adalah Internet Protocol Television atau disingkat dengan IPTV. Dengan layanan IPTV, pelanggan dapat menikmati lebih dari sekedar menonton siaran televisi, karena IPTV memungkinkan pelanggan berinteraksi dengan siaran tersebut dengan berbagai fitur-fitur nya.
Di Indonesia, layanan IPTV masih merupakan tahap awal dan masih memerlukan kajian mendalam dan peran serta dari berbagai pihak agar dapat diselenggarakan dalam kondisi yang cocok. Salah satu yang harus dipersiapkan segera oleh pemerintah adalah Regulasi yang dapat menjamin perkembangan bisnis IPTV secara sehat.
Dalam penyusunan tesis ini penulis telah melakukan pengkajian terhadap regulasi yang ada terutama yang berkaitan dengan penyelenggaraan siaran dan telekomunikasi, melakukan studi terhadap regulasi IPTV di negara-negara lain, melakukan survey terhadap pemangku-kepentingan (stake holder), dan terakhir merumuskan usulan tentang regulasi yang dinilai penulis paling cocok untuk diterapkan di Indonesia.

The development of information and communication technology (ICT) is heading to Internet Protocol (IP) based broadband networks. With IP-based broadband networks, various services could be channeled to the customer not only limited to voice based services, but also capable to cover data and video services with high quality. One of new services hotly discussed at present is mentioned as created as a revolutionary result of broadcast technology and its convergence with mergering telecommunication technology is the Internet Protocol Television or abbreviated as IPTV. Through IPTV services, a customer could enjoy more than watching broadcast television, as IPTV would enable customers to interact with the broadcast with various features.
In Indonesia IPTV service is still in its early stage and require indepth discussion and needs and the participation various parties in order that it could be operated in a suitable condition. One which has to be prepared immediately by the government is the Regulation that guarantee the healthy business IPTV growth.
In this thesis the Author has analyzed the existing regulations especially those related to broadcasting and telecommunication, performed a study on IPTV regulation in other countries, performed a survey to the stakeholders and finally compose a proposal for a regulation that the author finds it is most suitable to be implemented in Indonesia."

"[Penelitian ini bertujuan untuk menggambarkan peran Komisi Penyiaran Indonesia (KPI) dalam pengawasan isi siaran televisi lembaga penyiaran swasta sesuai dengan Pedoman Perilaku Penyiaran Dan Standar Program Siaran. Penelitian ini menggunakan pendekatan kualitatif dengan teknik pengumpulan data studi kepustakaan dan wawancara mendalam. Penelitian menggambarkan mekanisme yang diterapkan KPI merupakan pengawasan internal dan eksternal yaitu pemantauan langsung dan menerima aduan masyarakat Peran KPI dalam pengawasan belum maksimal karena sejumlah hambatan antara lain kurangnya sosialisasi kepada pihak terkait sanksi yang kurang tegas kewenangan pemberian Izin tidak dimiliki KPI kurangnya partisipasi masyarakat Lembaga Penyiaran Swasta kurang kooperatif dan rekrutmen komisioner KPI tidak transparan.

"Fungsi pemerintah dalam pelayanan publik diantaranya pemberian ijin termasuk di bidang telekomunikasi yaitu perijinan radio siaran swasta lokal. Dengan semangat otonomi daerah, kualitas pelayanan publik harus memberikan kepuasan dan performansi yang prima. Dalam implementasinya terjadi kendala baik friksi antara pemerintah pusat dan daerah maupun dengan instansi lain seperti KPI mengenai kewenangan perijinan. Kondisi ini merugikan masyarakat karena terjadi ketidakpastian hukum dan pelayanan perijinan terganggu. Pemerintah daerah Jawa Tengah melalui Dinas Hubtel sebagai pemerintah terdekat dengan masyarakat menyelenggarakan perijinan radio siaran swasta lokal dengan tetap berpegang kepada alokasi spektrum frekuensi dari Ditjen Postel sesuai KM 15 tahun 2003 tentang Master plan radio siaran FM. Hal yang melatarbelakanginya ialah untuk mengatasi kevakuman pelayanan publik perijinan radio siaran.
Untuk mengetahui apakah pelayanan publik perijinan radio siaran swasta lokal di Jawa Tengah telah sesuai dengan peningkatan efisiensi, efektifitas dan akuntabilitas, maka perlu mengadakan penelitian penilaian dari tingkat kepuasan publik terhadap pelayanan. Menggunakan metode performance analysis dan importance analysis untuk mengetahui persepsi seberapa puas dan seberapa penting atribut-atribut suatu suatu jasa pelayanan. Kemudian atribut-atribut tersebut dipetakan untuk melihat pemetaan tingkat kepentingan dengan quadrant analysis. Selain menganalisis itu juga akan dianalisis atribut-atribut kelokalan yang menjadi kekhasan radio siaran lokal.
Berdasarkan penelitian diketahui nilai indeks kepuasan pelanggan sebesar 70,95% dengan skala cukup puas kemudian dari aspek lokalitas radio siaran sudah dijadikan sarana aksesbilitas informasi yaitu 45 stasiun radio memberi separuh isi acara daerah, 40 stasiun radio memberikan porsi iklan 75%. Kemudian akses berpengaruh terhadap kemudahan ijin yang diinginkan responden dengan 41 stasiun radio menginginkan perijinan bisa diurus di instansi terdekat.

One of the government functions in public services is to give license including license of local private broadcasting radio. The quality of public services should provide good performance as well as satisfaction under the spirit of region autonomy. Unfortunately, there are some obstacles in its implementation among central and region government and other institutions, such as, KPI regarding license. As a result, this condition, of course, becomes disadvantages for society because of its uncertainty in laws and license services. Then, Central Java government via Dinas Hubtel, as the closest government to the society, arranges license of local private broadcasting radio with strictly referring to frequency spectrum from Ditjen Pastel based on KM 15, 2003 regarding master plan of FM broadcasting radio. This is to overcome stuck on public services of broadcasting radio license.
It is necessary to organize assessment of public satisfaction toward services in order to find out whether public services in local private broadcasting radio in Central Java are in line with increasing efficiency, effectiveness, and accountability. This research analyze satisfaction level of radio stations which have got license from Dinas Hubtel using performance and importance analyses methods to find out perception of satisfaction and other important attributes in services of broadcasting radio license. Then, the attributes are mapped to see the map of necessity level by quadrant analyses. It also analyses attributes of local character which becomes the characteristics of local private broadcasting radio.
Based on this research it is found that customer satisfaction index is 70,95% on satisfaction enough scale then radio station broadcasting has already become information accessibility that 45 stations give a half of the program on local program, 40 stations give 75% on advertisement on local content. The accesbility of licensing is important that 41 stations want the radio licensing could be proceed at the- nearest government institution.
