"Dalam perjalanan menuju negara tujuan untuk mendapatkan perlindungan, pencari suaka seringkali melakukan perjalanan melalui laut dengan menggunakan kapal yang tidak laik laut dan seringkali pula dilakukan dengan bantuan kelompok penyelundup migran. Perjalanan yang berbahaya ini mengakibatkan banyaknya kapal pencari suaka yang mengalami kecelakaan di laut sehingga para pencari suaka seringkali berada dalam keadaan bahaya di laut. Hukum internasional mewajibkan negara untuk melakukan SAR untuk menyelamatkan setiap orang yang berada dalam keadaan bahaya di laut, termasuk pencari suaka. Ketentuan SAR secara khusus diatur dalam International Convention on Maritime Search and Rescue. Pelaksanaan upaya SAR bagi pencari suaka terkait pula penentuan place of safety, prinsip non-refoulement dan tindak pidana penyelundupan migran.

The journey to the destination country to seek protection, asylum-seekers frequently take the journey through sea by sea unworthy boats and they are seldom helped by migrant smugglers. This dangerous journey has caused a lot of asylum-seekers faced accident at sea and made them in distress at sea. International law obliges states to do SAR operation to save every person who is in distress at sea, including asylum-seekers. The special provisions related to SAR are consisted in International Convention on Maritime Search and Rescue. SAR operation to save asylum-seekers also related to the determination of place of safety, non-refoulement principle and migrant smuggling."

"ABSTRAKSkripsi ini membahas konteks sosial politik film Istirahatlah Kata-Kata dari perspektif kriminologi konstitutif. Dalam kajian kriminologi konstitutif, pembuat film dan film diposisikan oleh peneliti sebagai agen konstitutif yang menawarkan wacana pengganti dalam isu penghilangan paksa aktivis periode 1997-1998. Penelitian dilakukan dengan metode Critical Discourse Analysis dengan menggunakan tiga proses analisis yang ditawarkan oleh Fairclough. Penelitian ini tidak hendak membahas film saja, melainkan hendak membahas pula konteks sosial politik yang melingkupi film tersebut serta pengaruh yang muncul karenanya. Hasil penelitian menemukan bahwa film Istirahatlah Kata-Kata sebagai medium memiliki potensi untuk menjadi salah satu alat guna menawarkan wacana pengganti dalam pembahasan kasus pelanggaran HAM masa lalu di Indonesia. Sementara Negara menghendaki pembahasan isu pelanggaran HAM ini dilakukan secara tertutup antara pelaku dan korban saja, dalam penelitian ditemukan bahwa salah satu tujuan yang hendak dicapai oleh para agen konstitutif adalah dilakukannya pembahasan atas isu ini di ranah publik hingga selesai, atau dengan kata lain, harus melalui pengadilan HAM.

ABSTRACTThis thesis discusses the social political context of the film entitled Solo, Solitude from the perspective of constitutive criminology. In constitutive criminology studies, filmmakers and the films itself are positioned by the researcher as constitutive agents that offer replacement discourses on the issue of Enforced Disappearance of Activists in the period 1997 1998. The research was conducted by Critical Discourse Analysis using three analytical processes offered by Fairclough. This research does not want to discuss only the film, but rather to discuss the social political context that surrounds the film and the effects that arise because of it. The study found that the film entitled Solo, Solitude mdash as a medium mdash has the potential to be one of the tools to offer replacement discourses in the discussion of past human rights abuses in Indonesia. While the State wants the case resolution of the issue of human rights violations to be conducted in a closed manner which is between the offenders and the victims only, in this research, it was found that one of the goals to be achieved by constitutive agents was to carry out the discussion of this issue in the public sphere to the end, or in other words, through the human rights court."

"Realizing a basic human right's court is not as easy writing or speaking, but it needs a concrete policy that is the commitment of a country to implement basic human rights in the social and political life as the realization of respect to the humanity of human beings. Indonesia is one of the countries which has clear commitment toward the protection of basic human rights as stated in the Preambule of The 1945 Constitution. Such as a commitment has been followed up by a concrete policy in the form of AdHoc Basic Human Right;s Court by the enactment of No. 26/2000 Law which was enacted in May 2002. Considering that Indonesia has not yet ratified the Statuta of International Criminal Court it is hoped that Human Right's Court in Indonesia would be able and willing to bring various cases of heavy violations toward basic human right's occuring in Indonesia nowadays to trial independently and impartialy. In other words The Basic Human Right's Court in Indonesia could convince the world that Indonesian Government is willing and able to settle heavy violations toward Basic Human Rights that so far have occured in Indonesia based on the standard of International Law."
