"This paper attempts to model the process of militarization of developing countries, based upon the so-called "fungibility" problems, i.e., a possibility of an official development assistance intended to promote productive activities to be actually transffered for non-productive activities. An econometric analysis using the panel data from African countries show that the level of fungibility, in particular that in military sector, depends on sectors targeted by official development assistance. For example, official development assistance for public health turns out to have low funbility."

"Umumnya pengukuran demokrasi bersifat global dan lintas negara, padahal demokrasi lokal tak kalah menarik diamati. Indonesia mengembangkan Indeks Demokrasi Indonesia (IDI) mengukur dinamika demokrasi lokal berbasis provinsi. Nusa Tenggara Barat (NTB) adalah provinsi dengan capaian demokrasi terburuk (2009-2014), ditandai oleh banyaknya kejadian yang melanggar kebebasan sipil, aksi kekerasan massa, tidak maksimalnya peran DPRD, serta macetnya kaderisasi partai politik. Penelitian ini mengajukan pertanyaan pokok: Mengapa kondisi demokrasi  Provinsi NTB pada tahun 2009-2014 relatif buruk? Studi ini merupakan pendalaman IDI melalui pengumpulan dan analisis data sekunder serta wawancara mendalam, difokuskan di tiga kabupaten/kota dengan tingkat kasus kekerasan tertinggi: Kabupaten Bima, Kabupaten Dompu, dan Kota Mataram. Temuan penting studi ini, era otonomisasi memberi keleluasaan yang sangat luas kepada pemerintah daerah mewakili aktor negara dalam memunculkan berbagai pengaturan ekstensif yang mengatur kehidupan beragama sehingga mengancam kebebasan sipil. Banyaknya kasus kekerasan dan tindakan main hakim sendiri menunjukkan keadaban sipil dan budaya politik belum tumbuh baik di masyarakat. Padahal, keadaban sipil dan budaya politik adalah fondasi penting yang diperlukan dalam membangun demokrasi. DPRD sebagai lembaga demokrasi lokal tidak berperan maksimal dalam menjalankan peran dan fungsi pokoknya dalam hal legislasi, penganggaran, dan pengawasan, selain keterwakilan perempuan di DPRD yang rendah. Partai politik lokal tidak berhasil menjalankan kaderisasi sebagai fungsi tradisionalnya yang penting.

Usually, the measurement of democracy is conducted in a global context and involves cross-country comparisons. In fact, local democracy can also become an interesting object of study. This research examines the Indonesia Democracy Index (IDI) as a province-based local democracy measurement. West Nusa Tenggara (NTB) has been chosen a focus of this research because in the period of 2009-2014, it is the country’s province with poorest democratic achievements, which were marked by a high number of challenges to civil liberties, incidents of mass violence, weak of DPRD’s role, and the stalled regeneration of local political parties. This is an advance of the study of IDI through the collection and analysis of secondary data and in-depth interviews, focused on the three districts/cities with the highest levels case of violence, namely: Bima District, Dompu District, and Mataram City. The key finding of this study is: The regional autonomy era in Indonesia has pushed forward an extensive religious life control, which tends to be discriminatory and contradicts the principles of democracy. The number of cases of violence and vigilantism shows that civil virtues and political culture have not grown well in the society. In fact, these are important foundations needed in building democracy. DPRD does not play a maximum role in carrying out its main roles and functions in terms of legislation, budgeting, and supervision. In addition to the low representation of women in DPRD. Local political parties have not succeeded in carrying out regeneration as their important traditional function."

"Beberapa tahun terakhir, populisme menjadi fenomena politik yang terjadi di berbagai negara di dunia, tak terkecuali di Indonesia. Hal ini dapat dilihat pada fenomena politik menjelang kontestasi Pilkada 2017 DKI Jakarta. Hadirnya kelompok massa yang menamakan dirinya sebagai Aksi Bela Islam membentuk populisme yang dilandaskan pada agama Islam, yang kemudian disebut dengan populisme Islam di Indonesia. Hal ini dapat dilihat sebagai instrumen penting atas terjadinya krisis representasi dalam perkembangan demokrasi representatif di Indonesia. Meski begitu, alih-alih menjadi jawaban atas krisis representasi yang ada, dampak dari hal ini justru dapat menimbulkan krisis representasi bagi warganegara yang bukan merupakan bagian kelompok tersebut, serta berpotensi menjadi penghambat atas perkembangan demokrasi. Guna merespons hal tersebut, penulis akan mengangkat demokrasi deliberatif demi menjaga nilai-nilai demokrasi atas hadirnya populisme Islam di Indonesia.
ABSTRACT
In recent years, populism has become a political phenomenon that occurs in various countries in the world, including in Indonesia. This can be seen in the political phenomenon ahead of the regional election 2017 DKI Jakarta.. The presence of a mass group that calling itself the Action to Defend Islam formed populism based on Islam, which is later called Islamic populism in Indonesia. This can be seen as an important instrument for the crisis of representation in the development of representative democracy in Indonesia. Even so, instead of being the answer to the existing crisis of representation, the impact of this can actually create a crisis of representation for citizens who are not part of that group, and have the potential to become an obstacle to the development of democracy. In response to this, the author will raise deliberative democracy in order to maintain democratic values over the presence of Islamic populism in Indonesia."

Dua perkara yang dianalisis adalah perkara Tom Beanal v. Freeport-McMoran Inc, and Freeport MrMoran Copper and Gold, Inc., Civil Action No.96-1474 section "K", United States District Court For the Eastern District Court of Lousiana dan Doe v. Exxon Mobile Corp., No. Civ.A 01-1357 (LFO), United States District Court of Columbia. Hasil penelitian ini menunjukkan metode penentuan hukum yang berlaku yang digunakan oleh hakim tidak memuaskan.

ABSTRACT
This thesis analyzes the Tort in the form of the violation of human rights occurred in Indonesia but litigated before the Federal Court of United States of America using Alien Tort Statute. The Cases discussed in this thesis are Tom Beanal v. Freeport-McMoran Inc, and Freeport MrMorran Copper and Gold, Inc., Civil Action No.96-1474 section "K", United States District Court For the Eastern District Court of Lousiana and Doe v. Exxon Mobile Corp., No. Civ.A 01-1357 (LFO), United States District Court, District Court of Columbia. The Result of this research shows that the method used by the Judge in determining applicable law is unsatisfying."
