"Permasalahan klasik public administration di Indonesia terkait perbedaan nomenklatur Administrasi Negara (AN) dan Administrasi Publik (AP) merupakan hal yang menarik untuk diteliti. Perbedaan nomenklatur public administration ini hanya terjadi di Indonesia. Oleh karena itu, penelitian dengan judul ?Perbedaan Administrasi Publik dan Administrasi Negara dalam Konteks Indonesia? ini mencoba memberikan jawaban atas permasalahan klasik tersebut. Melalui sejarah perkembangan ilmu public administration secara global yang dikaitkan dengan sejarah public administration di Indonesia serta menganalisa pendapat beberapa ilmuwan public administration Indonesia, tulisan ini menjelaskan secara faktual perbedaan nomenklatur yang ada. Menggunakan paradigma konstruktivis dengan pendekatan kualitatif, penulis menjelaskan alasan terjadinya perbedaan nomenklatur antara AP dan AN. Faktor sejarah, faktor bahasa, dan ekologi administrasi merupakan temuan penulis yang menjadi tiga faktor dasar penyebab perbedaan nomenklatur public administration di Indonesia.

The classical problem of public administration in Indonesia related to nomenclature differences between State Administration (AN) and Public Administration (AP) are interesting topic to be conducted as a research. Interestingly, these differences happen only in Indonesia. Therefore, the study entitled "The Differences of Public Administration and the State Administration in the Context of Indonesia" will elaborate the answers regarding this classical problem. Through the history of the global public administration science associated with the history of public administration in Indonesia by analyzed opinion of some Indonesian public administration scientist, this research describes the factual differences of the nomenclature. Using constructivist paradigm with qualitative approach, it explains the reasons of the differences between the AP and AN nomenclature. History, language, and ecological is the three basic factors causing differences in nomenclature of public administration in Indonesia."

"Otoritas Jasa Keuangan adalah lembaga yang independen dan bebas dari campur tangan pihak lain, yang mempunyai fungsi, tugas, dan wewenang pengaturan, pengawasan, pemeriksaan, dan penyidikan terhadap industri jasa keuangan. Penelitian ini menggunakan metode yuridis normatif, menganalisis lembaga Otoritas Jasa Keuangan, kedudukan lembaga Otoritas Jasa Keuangan dalam struktur ketatanegaraan termasuk hirarkhinya terhadap lembaga Negara lainnya serta kedudukan lembaga Otoritas Jasa Keuangan dalam struktur administrasi Negara Republik Indonesia termasuk melakukan analisis mengenai independensi lembaga Otoritas Jasa Keuangan sebagai lembaga independen baik dari aspek institutional independence, functional independence meliputi goals independence dan instrument independence, serta administrative independence meliputi financial independence dan personeel independence. Otoritas Jasa Keuangan adalah lembaga Negara, dalam struktur ketatanegaraan digolongkan sebagai lembaga Negara lapis kedua, sedangkan dalam administrasi Negara, merupakan lembaga Negara yang berada di luar pemerintah dan bukan bagian dari kekuasaan eksekutif. Otoritas Jasa Keuangan merupakan lembaga Negara independen yang memerlukan perhatian pada aspek administrative independence.

The Indonesia of the Financial Services Authority is an independent of the other party, which has function, duties, and authority to manage, control, examine, and investigate the financial service industries. This research adopts a normative juridical method, analyzing the Financial Services Authorities Institution, the position of Financial Services Authorities Institution in State Administration structure including its hierarchy to the other State institutions and the position of the Financial Services Authorities institutions in the administrative structure of the Republic of Indonesia including conducting analysis regarding the independence of the Financial Services Authorities institution, functional independence aspects including goals independence and instrument independence and administrative which includes financial independence and personnel independence. This study concludes that the Indonesia Financial Services Authority is a State institution, classified in the state organization as the second stratum State institution, whereas in the State administration, it is a State institutionoutside the Government and not constituting the part of the executive power. The Financial Serivices Authorities is an Independent State institution whose administrative independence shall be observed."

"Penelitian ini akan membahas tentang Kajian Terhadap Undang-Undang No. 30 Tahun 2014 Tentang Administrasi Pemerintahan Dalam Rangka Memperkuat Eksekusi Tata Usaha Negara dengan menggunakan metode hukum normatif dengan pendekatan perundang-undangan menggunakan teknik studi dokumen dan wawancara. Perubahan tentang pelaksanaan eksekusi peradilan tata usaha negara menjadi tanda bahwa masih banyaknya pejabat publik yang tidak melaksanakan tata usaha negara. Perubahan dalam undang-undang peradilan tata usaha negara ini memiliki caranya masing-masing untuk mengatur agar para pejabat publik taat pada putusan pengadilan tata usaha negara. Ketidaktaatan pejabat publik dalam melaksanakan putusan tata usaha negara memberikan dampak yang tidak baik salah satunya adalah keraguan masyarakat akan ketaatan pejabat publik. Periode 2016 sampai dengan 2018 dicatatkan ada lima puluh enam kasus yang dimohonkan oleh penggugat agar putusan tersebut dilaksanakan. Undang-Undang Administrasi Pemerintahan setelah diundangkan menjadi induk hukum materil di bidang administrasi negara. Selama ini, Undang-Undang Peratun tidak hanya mengatur hukum formil administrasi tetapi juga mengatur hukum materil administrasi. Undang-Undang Adminsitrasi Pemerintahan telah memperluas kompetensi absolut dari peradilan tata usaha. Kekosongan hukum formal untuk menunjang Undang-Undang Adminsitrasi Pemerintahan ini diatur dalam peraturan intern mahkamah agung. Perubahan paling mendasar adalah adanya upaya administrasi sebelum gugatan diajukan ke pengadilan. Hal ini menjadi nilai tambah karena segala sesuatunya diselesaikan terlebih dahulu secara intern. Upaya administrasi ini dirasa cukup karena dalam beberapa kasus perubahan menjadi alasan utama sulitnya dilaksanakan putusan Tata Usaha Negara. Sehingga, peradilan tata usaha memeriksa gugatan yang memang sudah terlebih dahulu diselesaikan dengan upaya adminstrasi.

This study will discuss the Study of Law no. 30 of 2014 concerning Government Administration in the Framework of Strengthening the Execution of State Administration by using the normative legal method by statutory approach using document study techniques and interview. Changes in the execution of state administrative courts are a sign that there are still many public officials who do not carry out state administration. This change in the state administrative court law has its own way of regulating public officials to obey the decisions of the state administrative court. The disobedience of public officials in implementing state administrative decisions has a bad impact, one of which is public doubts about the obedience of public officials. For the period 2016 to 2018, there were fifty-six cases that were requested by the plaintiff so that the decision was implemented. The Government Administration Act after its promulgation becomes the parent material law in the field of state administration. So far, the Administrative Law does not only regulate formal administrative law but also regulates administrative material law. The Government Administration Act has expanded the absolute competence of administrative courts. The void of formal law to support this Government Administration Act is regulated in the internal regulations of the Supreme Court. The most basic change is the existence of administrative efforts before the lawsuit is filed in court. This is an added value because everything is done internally first. This administrative effort is considered sufficient because in some cases changes are the main reason for the difficulty of implementing State Administrative decisions. Thus, the administrative court examines claims that have already been resolved through administrative efforts."

"Agenda Reformasi Birokrasi yang dicanangkan pemerintah Republik Indonesia menempatkan manajemen pengetahuan sebagai salah satu pilar dalam pencapaian visi reformasi birokrasi. Knowledge management system sebagai alat bantu teknologi informasi, dapat dimanfaatkan untuk mengelola pengetahuan dalam mendukung proses inovasi pelayanan publik. Penelitian ini bertujuan mengusulkan kerangka kerja pengembangan knowledge management systems yang mendukung inovasi pelayanan publik dengan studi kasus pada Kementerian Pendayagunaan Aparatur Negara dan Reformasi Birokrasi, serta Lembaga Administrasi Negara sebagai instansi pembina inovasi publik. Kerangka kerja usulan merupakan hasil modifikasi Fernandez’s methodology yang dipilih dari hasil evaluasi 5 (lima) metode pengembangan knowledge management systems menggunakan teknik Analythical Hierarchy Process (AHP). Metode tersebut selanjutnya digabungkan dengan komponen kerangka kerja dalam tahapan siklus pengembangan sistem mulai dari perencanaan, analisis, desain, dan implementasi sebagai kerangka kerja usulan. Penelitian ini menggunakan metodologi penelitian campuran (mixed-method) dengan tahapan penelitian meliputi evaluasi kandidat metode pengembangan KMS menggunakan teknik AHP, menentukan target pengetahuan yang dibutuhkan dalam inovasi pelayanan publik, dan menggabungkannya kedalam satu siklus pengembangan sistem yang kompeherensif. Penilaian pakar (expert judgement) dilakukan untuk memvalidasi kerangka kerja yang diusulkan. Hasil dari penelitian ini adalah sebuah kerangka kerja pengembangan knowledge management systems yang mendukung inovasi pelayanan publik.

The Bureaucratic Reform Agenda launched by the Republic of Indonesia's government places knowledge management as one of the pillars in achieving the vision of bureaucratic reform. Knowledge management systems as a tool for information technology can be used to manage knowledge in supporting public services' innovation process. This study proposes a framework for developing knowledge management systems that support public service innovation with case studies at the Ministry of Administrative Reform and Bureaucratic Reform and the State Administration Institute as a public innovation fostering agency. The proposed framework is a modified Fernandez's methodology selected from the evaluation of the 5 (five) methods of developing knowledge management systems using the Analytical Hierarchy Process (AHP) technique. These methods are then embedded into the systems development cycle stages as a proposed framework for developing knowledge management systems. This study uses a mixedmethod research methodology with research stages, including evaluating KMS development method candidates using AHP techniques, determining target knowledge needed in public service innovation, and combining them into a complete system development cycle. An expert judgment is carried out to validate the proposed framework. This research is a framework for developing knowledge management systems, which includes the stages of planning, analysis, design, and implementation."

"Attempting political democratization, strengthening macroeconomic condition, and developing independent judiciary have been three sector paid more concerns in Indonesia. Beside, administrative reform in Indonesia is considered another sector that is so worth to perform since it plays significant role as prerequisite infrastructure in which other reform efforts are preceded as well as dealing with daily life public services. In doing so, taking administrative procedure law in other well-developed countries, such as the U.S, Germany, and the Netherland, Indonesia government are about to make draft of Government Administration Law. By using point of view as a practicioner of German public servant, this article emphasizes fundamental aspect of this effort in comparison to what has been preceded in Germany as well. That is distinguishing as well as separating administration from branch of political power, especially the executive, in order to maintain its independence and neutrality. It is what the respective legal draft is supposed to afford."
