"[PT Pegadaian (Persero) dalam memenuhi kebutuhan masyarakat dalam memperoleh dana yang mereka butuhkan, berusaha untuk meningkatkan layanan dengan menambah program kegiatannya. Selama ini PT Pegadaian (Persero)
hanya dikenal dengan produk jasa gadai. Salah satu bentuk penyaluran pinjaman yang sekarang dijalankan oleh PT Pegadaian (Persero) yaitu perjanjian utang piutang dengan jaminan fidusia. Konsekuensi yuridisnya, PT Pegadaian (Persero) harus mengikuti ketentuan yang diamanatkan dalam UUJF. Perjanjian jaminan fidusia agar mempunyai kepastian hukum bagi kreditur dan debitur, harus dibuat
dengan akta notaris. Perjanjian jaminan fidusia tersebut harus didaftarkan di kantor Pendaftaran Fidusia, supaya apabila terjadi wanprestasi oleh debitur, kreditur tetap dapat menjalankan ketentuan yang diatur dalam UUJF. Sehubungan dengan hal tersebut, penulis melakukan penelitian tentang pelaksanaan jaminan fidusia pada PT Pegadaian (Persero) ditinjau dari fungsi PT Pegadaian (Persero) sebagai lembaga gadai dan untuk mengetahui akibat hukumnya perjanjian jaminan fidusia yang tidak didaftarkan apabila terjadi waprestasi. Untuk mencapai
tujuan tersebut, penelitian dilakukan dengan metode deskriptif analisis dengan menggunakan pendekatan yuridis normatif. Data hasil penelitian dianalisis dengan
menggunakan metode kualitatif. Hasil penelitian diketahui bahwa perjanjian jaminan fidusia pada PT Pegadaian (Persero) dengan nilai penjaminan diatas Rp.10.000.000,- (sepuluh juta rupiah), dibuat dengan akta jaminan fidusia dihadapan notaris dan didaftarkan pada Kantor Pendaftaran Fidusia. Sedangkan nilai penjaminan dibawah Rp. 10.000.000,- (sepuluh juta rupiah) hanya dibuat dengan
perjanjian jaminan fidusia yang dibuat dibawah tangan dan tidak didaftarkan pada Kantor Pendaftaran Fidusia. Perjanjian jaminan fidusia yang tidak didaftarkan pada Kantor Pendaftaran Fidusia, apabila debitur wanprestasi dalam pelaksanaan eksekusi kreditur dapat menerapkan Pasal 15 dan Pasal 29 UUJF. Perjanjian jaminan fidusia yang tidak didaftarkan pada Kantor Pendaftaran Fidusia dalam pelaksanaan eksekusinya, kreditur harus mengajukan gugatan kepada pengadilan dan dapat menerapkan Pasal 1365 KUHPerdata juncto Pasal 365 KUHP. Sebab lain perjanjian jaminan fidusia yang tidak didaftarkan pada Kantor Pendaftaran Fidusia adalah karena biayanya yang mahal dan jarak Kantor Pendaftaran Fidusia yang sangat jauh, karena hanya ada di Ibukota Propinsi DKI Jakarta. Seharusnya,
Kantor Pendaftaran Fidusia mempunyai kantor perwakilannya pada setiap Kabupaten/ Kotamadya di Indonesia.

All this time, at PT Pegadaian (Persero) as known for pand service products. One of the on the go loan programs from PT Pegadaian (Persero) is promissory notes receivable by fiduciary transfer of ownership. As a
juridical consequence, PT Pegadaian (Persero) should follow the provisions as mandated by the Fiduciary Act (UUJF). To be able to have a legal certainty for the debtor and the creditor, the agreement of fiduciary transfer of ownership should be made in notarial decree. The agreement of fiduciary transfer of ownership should be registered in Fiduciary Registering Office, so that in case of default done by the debtor, the creditor may use the provisions in the UUJF. Inconnection with that, the writer researched the unregistered agreement of fiduciary transfer of ownership by PT Pegadaian (Persero) to find out the implementation of fiduciary transfer of ownership in PT Pegadaian (Persero) related to the function of PT Pegadaian (Persero) as a pand institution and to find
out legal consequences on unregistered agreement of fiduciary transfer of ownership toward the return and in the case of default. To achieve the objective above, the study was conducted with the analytical descriptive method using normative juridical approach. Data of the research was analyzed by using qualitative method. Based on the research, the result revealed that agreement of
fiduciary transfer of ownership of PT Pegadaian (Persero) with the value of guarantee above Rp. 10.000.000,- (ten millions rupiah), then made with the fiduciary deed before a notary and registered at Fiduciary Registration Office. If the value of guarantee below than Rp.10.000.000,- (ten millions rupiah), then only be made with agreement of fiduciary transfer of ownership and not be registered. In a registered agreement of fiduciary transfer of ownership, if the debtor are in default in the implementation of the execution, the creditor can apply Article 15 and Article 29 of UUJF. In a unregistered agreement of fiduciary transfer of ownership, to the execution, the creditor must must file a lawsuit to the court and could apply Article 1365 of the Civil Code juncto Article 365 of the Book of Criminal Law. There is a factor when an agreement of fiduciary transfer of ownership is not registered, its is due to expensive cost and great distance of Fiduciary Registration Office, because its only located in the Provincial Capital. The Fiduciary Registration Office shoulc have representatives in every Regency/City.

"Usaha jasa gadai adalah usaha jasa simpan pinjam
dengan memberikan jaminan benda kepada orang yang
meminjamkan. Usaha ini telah lama sekali dikenal oleh
masyarakat, yang dijalankan secara perorangan. Bahkan sejak
jaman Rasullulah SAW usaha gadai telah ada dan dikenal
dengan baik. Masyarakat Indonesia mengenal usaha gadai
sebagai sebuah lembaga keuangan pada saat dijajah
pemerintah Belanda dan setelah Indonesia merdeka usaha ini
dijalankan oleh pemerintah, yang sekarang ini bernama Perum
Pegadaian. Usaha gadai berkembang sesuai dengan
perkembangan jaman pada saat Indonesia sedang berkembang
usaha berbasis syariah, Perum Pegadaian bekerja sama dengan
Bank Muamalat Indonesia mendirikan pegadaian syariah. Dan
berdasarkan Keputusan Direksi Perum Pegadaian No:
06.A/UL.3.00.22.3/2003 tentang Pemberlakuan Manual
Operasional Unit Layanan Gadai Syariah, pegadain syariah
secara resmi bediri. Setelah berjalan kurang lebih dua
tahun gadai syariah pada Perum Pegadaian berkembang dengan
pesat, ditargetkan pada tahun kedua ini telah berdiri 40
cabang pegadaian syariah diseluruh Indonesia. Perkembangan
tersebut sedikit membawa pengaruh terhadap pegadaian
konvensional yang antara lain dapat dilihat dari penurunan
jumlah nasabah dan barang gadai yang diterima pegadaian
konvesional menurun dari tahun sebelum ada pegadaian
syariah, namun penurunan tersebut tidak hanya disebabkan
adanya pegadaian syariah, ada faktor-faktor lain yang
menghambat perkembangan pegadaian konvensional. Pegadaian
syariah memiliki pangsa pasar tersendiri, yakni masyarakat
yang ingin bertransakasi ekonomi secara syariah, yang tidak
memakai bunga dalam pengelolaanya. Selain diminati oleh
masyarakat muslim, ada juga masyarakat non-muslim yang
datang ke pegadaian syariah karena biayanya yang relatif
lebih murah dibandingkan di pegadaian konvensional yang
menggunakan bunga dalam pengelolaanya."

"ABSTRAK
Pegadaian sebagai lembaga keuangan yang memberikan pinjaman kepada masyarakat dengan sistem gadai dan lembaga pegadaian banyak memberikan pinjaman kepada masyarakat menengah ke bawah dengan jumlah pinjaman kecil. Tugas dari pegadaian adalah agar masyarakat terhindar dari sistem rentenir. Permasalahan dalam penelitian ini adalah bagaimana mekanisme peminjaman dalam lembaga pegadaian menurut perundang-undangan? Apakah penentuan bunga pegadaian mendasarkan pada prinsip keadilan? Dan apakah bunga pegadaian sudah sesuai dengan peraturan yang berlaku dan bagaimana kendala yang terjadi? Penelitian ini merupakan penelitian yang sifatnya sosio-legal yang metode pengumpulan datanya adalah dengan wawancara dan juga penyebaran kuesioner kepada nasabah pegadaian. Penelitian ini mencoba menganalisis besaran tingkat bunga di beberapa lembaga pegadaian Indonesia dengan membandingkan dengan peraturan pegadaian yang ada negara Cina dan India. Mekanisme peminjaman di pegadaian baik berupa kriteria barang jaminan, taksiran, penebusan harus memperhatikan SEOJK 52/SOJK.05/2017. Tingkat bunga pegadaian yang mencapai 10 persen untuk setiap bulannya dipandang belum memenuhi rasa keadilan. Meskipun demikian, penerapan tingkat bunga pegadaian di Indonesia sudah sesuai dengan peraturan yang ada di Indonesia. Dalam menentukan besaran bunga pegadaian yang ada sekarang bagi pegadaian tidak terdapat kendala, namun besaran bunga yang telalu tinggi menjadi kendala bagi nasabah karena sebagian besar ekonomi mereka adalah menengah ke bawah, namun mereka tetap menggunakan pegadaian karena untuk memenuhi kebutuhan mereka.

ABSTRACT
Pawnshops as a financial institution that provides loans to the community with a pawn system and pawnshop institutions provides loans to the middle and lower classes with small loans. The task of pawnshops is for the community to avoid the loan shark's system. The problem in this study is how is the mechanism of lending in a pawnshop institution according to legislation? Is the determination of pawnshops based on the principle of justice? And is the pawnshop interest in accordance with the applicable regulations and how do the obstacles occur? This research is a socio-legal nature of the data collection method by interviewing and distributing questionnaires to pawnshops customers. This study tried to analyze the interest rates in several Indonesian pawnshops by comparing the pawnshop regulations in China and India. The mechanism of lending in pawnshops in the form of criteria for collateral, estimated, redemption must pay attention to SEOJK 52/SOJK.05/2017. Mortgage rates which reach 10 percent for each month are seen as not fulfilling a sense of justice. Nevertheless, the application of pawnshops in Indonesia is in accordance with the regulations in Indonesia. In determining the amount of pawnshops that are currently available for pawnshops there are no obstacles, but the high amount of interest is an obstacle for customers because most of their economy is middle to lower, but they still use pawnshops because to meet their needs."

"Perbankan syariah merupakan bank yang berdasarkan prinsip bagi hasil. Prinsip bagi hasil tidak hanya membagi pada saat terdapat keuntungan, namun juga berbagi bila terdapat kerugian. Dengan dikeluarkannya Undang-Undang 24 Tahun 2004 tentang Lembaga Penjamin Simpanan, menyebabkan perbankan syariah dipaksa untuk mengikuti sistem penjaminan nasional yang terdapat pada Undang-Undang 24 Tahun 2004. Penjaminan yang dilakukan oleh Lembaga Penjamin Simpanan terhadap perbankan syariah meliputi giro, tabungan dan deposito baik yang menggunakan prinsip wadi?ah ataupun mudharabah. Penjaminan oleh Lembaga Penjamin Simpanan dapat menghilangkan jati diri perbankan syariah sebagai bank yang menerapkan sistem bagi hasil. Dalam tulisan ini penulis ingin memaparkan kajian terhadap Penjamin yang dilakukan Lembaga Penjamin Simpanan terhadap perbankan syariah dan meneliti lebih dalam bagaimana pengaruh penjaminan uang nasabah oleh Lembaga Penjamin Simpanan terhadap perbankan syariah dalam sistem ekonomi syariah.

Islamic banking is a bank based on profit sharing principles. The principle of sharing not only split when there is profit, but also to share when there are losses. With the release of Act 24 of 2004 on Lembaga Penjamin Simpanan, prompting the Islamic banking system to follow the national safeguards contained in the Act 24 of 2004. Guarantee by LPS Islamic banking including checking, savings and time deposits using either the principle or mudaraba wadi'ah. Guarantee by LPS can eliminate identity as an Islamic banking system of banks that apply for the results. In this paper the author describes a study of the Guarantor LPS on Islamic banking and examine more deeply how the effect of ensuring clients 'money' by LPS of Islamic banking in the Islamic economic system."
