"Penelitian ini adalah efektifitas strategi anti Fraud Bank Indonesia (2011) sebagai
bentuk pencegahan kejahatan perbankan. Tujuan penelitian ini adalah untuk
menganalisis prospek keberhasilan Surat Edaran Bank Indonesia No.13/28/DPNP
tentang Penerapan Strategi Anti Fraud bagi Bank Umum menurut pendapat para
ahli dibidang perbankan di Indonesia.
Metodologi yang digunakan dalam penelitian ini adalah teknik Delphi yaitu
sebuah metode menyusun sebuah proses komunikasi kelompok sehingga proses
tersebut membantu dalam pengelompokkan pendapat sebagai suatu kesatuan dalam
menghadapi permasalahan penelitian dengan melibatkan beberapa pakar.
Hasil penelitian menyimpulkan bahwa strategi anti Fraud Bank Indonesia 2011
adalah prospektif. Pilar pencegahan dinilai memiliki prospek karena programprogram
tersebut merupakan langkah-langkah yang sesuai dengan kepentingan
bank dalam menciptakan lingkungan dan budaya kerja yang profesional tanpa
kecurangan. Pilar deteksi dinilai memiliki prospek didasarkan pada kepentingan
bank dalam mengkoreksi setiap kegiatan bisnis dengan setiap perencanaan guna
pencapaian tujuan bisnis bank agar efektif dan efisien. Pilar investigasi, pelaporan
dan sanksi dinilai prospek guna pemeliharaan kinerja tanpa kecurangan dengan
memberikan efek jera bagi si pelaku kecurangan dan memberikan efek kehatihatian
bagi para karyawan bank untuk mempertimbangkan ulang atas perbuatan
kecurangan yang mungkin akan dilakukannya. Pilar evaluasi, pemantauan dan
tindak lanjut dinilai prospek di dalam rangka untuk memberikan evaluasi
berkelanjutan terhadap potensi-potensi terjadinya kecurangan dalam bank dalam
jangka panjang.

Abstract
This study is about the effectiveness of antifraud strategy of Bank Indonesia
(2011) as a form of crime prevention. The purpose of this research is to analyze of
the prospect of Surat Edaran Bank Indonesia No. 13/28DPNP about the
implementation of antifraud strategy for commercial bank in according to expert?s
opinion in Indonesia.
The methodology used in this research is Delphi technique, a method for
formulating a group communication process which assist grouping experts
opinion as a whole.
The research result revealed that the antifraud strategy of Bank Indonesia 2011 is
considered as prospective. The prevention pillar is appreciable prospect since that
programs is the efforts in line with the bank?s interest in creating the
environmental and cultural work with the high professionalism without the fraud.
The detection pillar is appreciable prospect since that programs assisted in
correcting every business activities in according to every planning in order to
meets the business goals to be effectively and efficient. The investigation,
reporting and sanction pillars are appreciable prospect since that programs can
give the wary for employees to consider for fraud will be done in the future. And
evaluation, monitoring and following are appreciable prospect in order to run
continuously improvement in handling potential fraud in a bank in long term."

"Banking crime was is an story. However, at any time the story may be blown up on the surface as new crime story like the automatic teller machine breaking which happenned in Jakarta and Bali in the last view months ago. As likely and iceberg story, the case of breaking ATM is just a peak of iceberg, there may many unseen crime stories that we have never known whether in total capital lose or in total customer disadvantaged. The main stream of action can be varied amongst intelectual actors and direct crime perpetrators, thus there are possibly become a global crime network. The breaking ATM has become a test case of law No. 11 year 2008 regarding Information and Electronic Transaction. International syndication did the action of breaking automatic teller machine using such method such as, skimming, ATM cloning, stealing Personal Identification Number (PIN), credit card cloning, installing camera or card reader to copy the PIN. The question now are, why occured the ATM breaking undetected until the accumulated lose reached for billions of rupiah? How far banking security system works to protect bank customer and credit card holder? Then, how wide the impact of the ATM breaking case on bank rush?"

"Banking crime phenomenon recently occurs by vreaking the Automatic Teller Machine as conducted by the criminal has created unsafe feeling amongst community specially for bank's customer. There are some typical methods used in the crime operation such as using skimmer, cloning credit card, cloning ATM card and stealing Personal Identification Number by hidden-camera and card reader installing on the machine. This type of electronic transaction crimes (e-banking) has been technically improved along with the highly development of technology in electronic banking transaction. The Act No. 11 year of 2008 regarding Information and Electronic Transaction has been attempted to cover and anticipate the accurrence of electronic crime. In practice, however, there is sort of constraint in implementing the law since such articles have called as grey are or having different meaning in perception of legal institution, so there requirement for another legal remedy in form of legal interpretation. In case the Judge unwilling to search for another legal interpretation but prefers to apply streams of legism then sociologically the law would not catch the highly e-banking crime. "

"Penelitian ini membahas mengenai implementasi pencegahan kejahatan dalam internet banking sebagai salah satu instrumen keamanan perbankan. Teori yang digunakan dalam penelitian ini adalah 25 teknik pencegahan kejahatan situasional yang berfokus kepada delapan teknik pencegahan kejahatan yang sesuai dengan penerapan dalam dunia perbankan. Metode penelitian yang dilakukan berdasarkan studi kasus pada Bank X dengan melakukan wawancara dan observasi.
Kesimpulan dari penelitian ini bahwa implementasi pencegahan kejahatan yang dipakai dalam dunia perbankan yaitu menggunakan increase the effort yang berfokus pada target hardening dan access control, increase the risk yang berfokus pada reduce anonimity dan use place managers, reduce the rewards yang berfokus pada conceal targets dan remove.

This study discusses about the implementation of crime prevention in internet banking as an instrument of banking security. The theory which used in this study was the 25 situational crime prevention techniques that focus on the eight techniques of crime prevention that appropriate to the application in the banking world. Research methodology is based on a case study of Bank X to conduct interviews and observations.
The conclusion of this study that the implementation of crime prevention that used in the banking world is using the increase the effort focused on target hardening and access control, increase the risk focusing on reduce anonimity and use place managers, reduce the rewards that focus on conceal targets and remove targets, and remove excuses that focuses on the set rules and assist compliance.

"Artikel ini membahas mengenai alasan tingginya jumlah uang Rupiah palsu yang beredar di DKI Jakarta dibandingkan dengan kota dan provinsi lain yang ada di Indonesia. Transaksi tunai yang terjadi setiap hari dan dilakukan oleh seluruh lapisan masyarakat dianggap menjadi suatu aktivitas rutin dan gaya hidup yang seringkali membuat masyarakat menjadi abai terhadap keaslian uang Rupiah yang mereka gunakan atau mereka terima, sehingga memunculkan banyak kesempatan bagi para pelaku potensial kejahatan pemalsuan uang, ini dapat dijelaskan melalui teori routine activity melalui segitiga kejahatan dan yang didukung dengan teori lifestyle exposure.

This article discusses the reasons for the high amount of counterfeit Rupiah banknotes circulating in Jakarta compared to other cities and provinces in Indonesia. Cash transactions that occur every day and done by all levels of demographic are considered to be a routine and lifestyle activity that often leaves people ignorant or underestimates the authenticity of the Rupiah banknotes they use or receive, thereby generating opportunities for potential perpetrators of money counterfeiting crimes, this can be explained through the theory of routine activity through the crime triangle and are supported by the lifestyle exposure theory."

"In the year of 1997 Indonesia hit by financial dissaster known as monetary crisis. Thousands of bank's customer withdrawn their money in a great numbers from national banks, consequently many private banks in Indonesia have facing with deficit of liquidity. bank of Indonesia as lender of the last resort pouring fresh money into 48 banks arround IDR 144,5 trillion as loan assistance to back up their sort of liquidity, and additional loan assistance gave in 29 January 1999 about IDR 14,447 trillion therefore totally loan assistance in amount is IDR 158,947 trillion. The good faith is to help dying banks in the situation of crisis. Indonesiagovernment supports the loan assistance given by Bank of Indonesia Through releasing presidential decree No. 26/1998.On the first of November 1997 the government liquidated 17 private banks out of 48 receiver banks of the BI loan because of their incapabilityto continue running the banks caused by capital rush in a great amounts. The BI loan received by the 17 closing banks is IDR 11,89 trillion, but untill now the loan backs into state account just only IDR 2,96 trillion. How very protracted is the government in handling the BI loan cases in the history of Republic Indonesia. Protest, demonstration, till accusation against government and legal axamination of the government policy have been done frequently, however the rule of law and the government failed to jail the loan's embezzler, even less to confiscate their properties."

"ABSTRAK
Penelitian ini adalah tentang Penerapan Strategi Anti Fraud Bagi Bank Umum (Studi Kasus oleh Karyawan Citibank Indonesia : Melinda Dee). Tujuan penelitian ini adalah untuk menganlisis penerapan Surat Edaran Bank Indonesia No. 13/28/DPNP tanggal 9 Desember 2011 perihal Strategi Anti Fraud bagi Bank Umum khususnya Citibank Jakarta terkait kasus Fraud yang terjadi di internal bank tersebut.
Metodologi yang digunakan dalam penelitian ini metode penelitian yuridis empiris. Metode penelitian secara empiris yaitu mengkaji pelaksanaan atau implementasi ketentuan hukum posistif atau perundang-undangan secara faktual pada peristiwa hukum tertentu yang terjadi dalam masyarakat.
Tulisan ini merupakan studi kasus dan penelitian yang dilakukan secara lansung dengan wawancara kepada nara sumber dimana kasus fraud dan penerapan strategi anti fraud terjadi di internal bank khususnya Citibank Jakarta yang merupakan data primer, dan juga menggunakan studi kepustakaan dan bahan ? bahan sekunder yang mendukung tesis ini.
Hasil penelitian ini menyimpulkan pilar pencegahan dinilai memiliki nilai yang sangat strategis diantara pilar yang diterapkan Bank Indonesia dalam Strategi Anti Fraud karena merupakan langkah awal yang sesuai dengan kepentingan bank dalam menciptakan lingkungan dan budaya kerja yang propesional (good governance culture) tanpa adanya kecurangan (fraud)

ABSTRACT
This Study about the implementation of anti fraud strategy for commercial bank (case study by Citibank Employee : Melinda Dee). The purpose of this research is to analyze of the implementation of Surat Edaran Bank Indonesia No. 13/28/DPNP on 9 Desember 2011 about the implementation of anti fraud strategy for commercial bank expecially Citibank Jakarta fraud in internal bank.
The methodology used in the study of empirical legal research methods. Methods of empirical research that examines the implementations or implementation of provisions of positive law or statutory law factually on certain events that happen in the community.
This paper in a case study and research interviews conducted directly with the source where cases of fraud and anti fraud strategy implementation occurs in particular internal bank Citibank Jakarta which is the primary data, and also the library and study materials-secondary materials that support this thesis.
The result of this study conclude prevention pillar considered to have value among the three pillars of Bank Indonesia applied the Anti-Fraud Strategy as in initial step in accordance with the bank?s interest in creating a work environment and culture propfessionals (good governance culture) in the absence of fraud (fraud).

"ABSTRAK
Fraud dalam dunia perbankan bukanlah suatu hal yang baru lagi untuk terjadi, terutama dalam bidang perkreditan. Dalam praktiknya, jenis dan modus dilakukannya fraud selalu berkembang seiring dengan perkembangan teknologi informasi sehingga sudah tentu makin sulit pula untuk dideteksi. Modus dilakukannya fraud dalam perkreditan dapatlah bermacam-macam bentuknya seperti pembuatan rekening fiktif, pemberian kredit dengan menggunakan nominee, penyerahan jaminan kredit yang fiktif atau tidak senilai dengan nilai kreditnya itu sendiri, dan sebagainya. Untuk itulah pada tanggal 9 Desember lalu BI mengeluarkan suatu peraturan baru untuk bank-bank umum di Indonesia yang dinamakan dengan Strategi Anti Fraud bagi Bank Umum. Dalam penelitian ini, akan dibahas lebih lanjut mengenai bagaimana saja bentuk fraud dalam perbankan, khususnya perkreditan yang di antaranya seperti contoh yang disebutkan di atas. Serta akan dibahas pula mengenai pengawasan BI atas bentuk penerapannya dalam bidang perkreditan oleh bank umum di Indonesia dengan menggunakan Bank X (nama disamarkan) sebagai sampelnya. Dengan menggunakan metode yuridis normatif, penelitian ini memberikan kesimpulan bahwa BI telah menyusun kebijakan tentang mekanisme pengawasan fraud yang cukup komperhensif dan bentuk penerapan Strategi Anti Fraud ini oleh Bank X pun, dalam bidang perkreditannya, dapat dikatakan telah memenuhi standar penerapan dalam peraturan tentang Strategi Anti Fraud untuk bank umum tersebut.

ABSTRACT
Fraud is not a new thing to happen in banking anymore, especially in its credit sector. In practice, types and modes of bank fraud are always developing along with the development of information technology which make it more difficult to be detected. Fraud in banking credit sector can be conducted in several ways such as make an account with a fictive id, granting a credit solicitation which use a nominee party, giving a fictive collateral in a credit solicitation, delivery of a collateral that does not have a same value with the credit itself, etc. Because of that, Bank Indonesia (?BI?) has make a new regulation named ?Anti Fraud Strategy? for Indonesian banks. This study will explain about the forms of fraud, especially in credit sector like what are explained above. Besides that, this study will also explain about BI?s oversight mechanism over the implementation of this anti fraud strategy by Indonesian banks with Bank X (the real name is disguised) as the sample. By using normative juridical method, this study gives conclusion that BI has made a comprehensive oversight mechanism and the implementation of anti fraud strategy by Bank X, in its credit sector, is can be said has already met the requirements that are stipulated in the anti fraud strategy regulation."

"Penelitian ini bertujuan untuk mengidentifikasi dampak konsentrasi kepemilikan bank terhadap risiko perbankan di Indonesia. Konsentrasi kepemilikan bank ditandai dengan tingginya komposisi saham yang dimiliki oleh satu pihak pemegang saham. Tingkat konsentrasi dibagi menjadi tiga level: (1) < 20%; (2) 20%-50%; (3) > 50%. Berdasarkan estimasi data panel terhadap individu bank di Indonesia, ditemukan bahwa tingginya konsentrasi kepemilikan bank akan meningkatkan risiko perbankan dan secara rata-rata bank dengan pemilik yang terkonsentrasi pada level 3 memiliki tingkat risiko paling besar diantara dua level konsentrasi lainnya. Selain itu, penelitian ini ikut mengkaji tingkat risiko jenis-jenis bank di Indonesia dimana jumlah bank dengan jenis Bank Umum Swasta Nasional yang banyak akan meningkatkan risiko perbankan.

This study aims to identify the impacts of bank ownership concentration on banking risk in Indonesia. The ownership concentration is characterized by the high composition of shares that is held by one shareholder. The concentration is classified into three levels: < 20%; 20%-50%; > 50%. Based on panel data estimation using 115 banks from 2008-2017, it was found that higher concentration of ownership would increase the banking risk. Banks with ownership concentration on level 2 are riskier than the other levels. This study also examines the risk of specific types of Indonesia banking sector. The large number of National Private Commercial Bank tend to increase the banking risk."
