"Penyelesaian sengketa secara konvensional yang dilakukan melalui aktivitas tatap muka dinilai menyulitkan konsumen untuk menuntut kerugian yang dialami setelah menggunakan barang atau jasa. Posisi konsumen dan pelaku usaha yang berjauhan menyulitkan kedua belah pihak karena harus menempuh jarak ke lokasi penyelesaian sengketa. Online Dispute Resolution menjadi solusi yang memungkinkan para pihak untuk menyelesaikan sengketa meskipun berada di lokasi yang berbeda. Penelitian ini bertujuan untuk mengetahui perkembangan Online Dispute Resolution di Indonesia dan menganalisis penerapannya di LAPS SJK. Indonesia belum memiliki peraturan perundang-undangan yang secara khusus mengatur Online Dispute Resolution, namun keberadaan Online Dispute Resolution telah tersebar di berbagai peraturan perundang-undangan. Online Dispute Resolution juga telah diterapkan dalam proses penyelesaian sengketa, antara lain dalam mediasi di Pengadilan, melalui layanan pengaduan konsumen di Kementerian Perdagangan, serta dalam penyelesaian sengketa yang diselenggarakan LAPS SJK. Sebagai perbandingan penerapan Online Dispute Resolution, Belanda memiliki platform terintegrasi yang memungkinkan pihak untuk melakukan pengaduan dari berbagai sektor sengketa. Selain itu, Belanda juga memiliki platform di beberapa sektor yang terintegrasi dengan platform Online Dispute Resolution milik Uni Eropa. Adapun China menjadi negara pertama yang menerapkan Online Dispute Resolution di Asia melalui CIETAC. Khusus berkaitan dengan sengketa konsumen, Brasil juga telah memiliki platform Online Dispute Resolution yang membantu konsumen dalam melakukan pengaduan dan menyelesaikan sengketa. Dalam penerapannya di LAPS SJK, Online Dispute Resolution terdapat dalam proses penyelesaian sengketa melalui arbitrase, mediasi, dan pendapat mengikat. Secara teknis, proses penyelesaian sengketa di LAPS SJK dilaksanakan secara elektronik, namun masih dimungkinkan untuk menyelenggarakan penyelesaian sengketa secara konvensional atau secara hybrid sesuai persetujuan para pihak.

Conventional dispute resolution, which is carried out through face-to-face activities, is considered difficult for consumers to claim their loss after using goods or services. The position of consumers and businesses far apart makes it difficult for both parties because they have to travel the distance to the location of the dispute settlement. Online Dispute Resolution is a solution that enables parties to resolve disputes even though they are in different locations. This research aims to understand the development of Online Dispute Resolution in Indonesia and its implementation in the LAPS SJK. Indonesia does not yet have laws and regulations that specifically regulate Online Dispute Resolution, but the existence of Online Dispute Resolution has been mentioned across various laws and regulations. Online Dispute Resolution has also been implemented in the dispute resolution process, including mediation in courts, through the consumer complaint service at the Ministry of Trade, as well as in dispute resolution organized by LAPS SJK. Compared to the implementation of Online Dispute Resolution, the Netherlands has an integrated platform that allows parties to submit complaints from various dispute sectors. In addition, it also has several sectors whose platforms are integrated with the European Union's Online Dispute Resolution platform. Meanwhile, China became the first country to implement Online Dispute Resolution in Asia through CIETAC. Regarding consumer dispute settlement, Brazil has an Online Dispute Resolution platform that helps consumers to complain and resolve disputes. In the LAPS SJK, Online Dispute Resolution is contained in the process of resolving disputes through arbitration, mediation, and binding advice. Technically, the dispute settlement process at the SJK LAPS is carried out electronically. However, it is still possible to carry out conventional or hybrid dispute resolution according to the parties' agreement.

"Sengketa pajak merupakan hal yang tidak dapat dihindari, namun dapat diminimalisir. Dalam kurun waktu 6 tahun terakhir, jumlah sengketa pajak pada proses Banding mengalami peningkatan. Selain jumlah yang meningkat, 98,5% dari sengketa dalam proses Banding dimenangkan oleh Wajib Pajak. Direktorat Jenderal Pajak menanggapi isu ini dengan membentuk Quality Assurance yang bertujuan meminimalisir sengketa pajak. Tetapi, setelah Quality Assurance telah diterapkan, angka sengketa pajak tidak mengalami penurunan. Oleh karena itu, Quality Assurance perlu dianalisis penerapannya berdasarkan teori alternative dispute resolution dalam meminimalisasi sengketa pajak di Indonesia. Tujuan penelitian ini yaitu menganalisis penerapan Quality Assurance sebagai alternatif penyelesaian sengketa dalam meminimalisasi sengketa pajak di Indonesia beserta dengan faktor penghambatnya dan menganalisis perbandingan penerapan Quality Assurance di negara lain (khusunya Amerika Serikat) dengan penerapan di Indonesia. Penelitian ini dilakukan melalui pendekatan kualitatif, dengan didukung data dari studi lapangan dan wawancara mendalam dengan Direktorat Jenderal Pajak, Akademisi, Komite Pengawas Perpajakan, DDTC, dan CITA. Hasil penelitian ini menunjukkan bahwa sebenarnya Quality Assurance merupakan jawaban atas permasalahan yang ada di Direktorat Jenderal Pajak, namun, dalam penerapannya Quality Assurance masih belum dapat mencapai tujuannya yaitu mengurangi angka sengketa pajak karena ketidakselarasan antara tugas, fungsi, mekanisme dan tujuan. Selain itu, faktor penghambat secara substansial menjadi faktor penghambat terbanyak dalam penerapan Quality Assurance. Dalam hal perbandingan dengan negara lain, Indonesia dapat menerapkan paradigm cooperative compliance yang telah diterapkan oleh Amerika Serikat dalam penyelesaian sengketa pajak.

Tax disputes cannot be avoided but can be minimized. In the last 6 years, the numbers of tax disputes in the appeal process has increased. Furthermore, 98,5% of the disputes in the appeal process were won by the Taxpayer. The Directorate General of Taxes responds to this issue by establishing Quality Assurance which aims to minimize tax disputes. However, after Quality Assurance has been implemented, the number of tax disputes has not decreased. Therefore, it is important to analyze the application of Quality Assurance based on the theory of Alternative Dispute Resolution in minimizing tax disputes in Indonesia. This study aims to analyze the application of Quality Assurance as an Alternative for Dispute Resolution in minimizing tax disputes in Indonesia along with its inhibiting factors and to analyze the comparison of the application of Quality Assurance in other countries (especially the United States) with the application in Indonesia. This research was conducted through a qualitative approach, supported by data from field studies and in-depth interviews with the Directorate General of Taxes, academics, Tax Omnbudsman, DDTC, and CITA. The results of this study indicate that Quality Assurance is the answer to the low quality of examination did by the Directorate General of Taxes, however, the feasibility of Quality Assurance has not been able to achieve its goal due to inconsistencies between its duties, function, mechanism, and aim. Moreover, the inhibiting factors were substantially the most inhibiting factor. Besides, in comparison with the United States, Indonesia can adopt the cooperative paradigm that has been applied by the United States to tackle tax disputes."

"The issue of law enforcement is central to land property rights. Modes of property rights
enforcement can be performed either with or without intervention of the state. This article focuses
on the latter mode of enforcement; that is, how people manage to enforce their land rights without
the involvement of state institutions and to what extent informal arrangements can offer effective
enforcement and secure land property rights. This article also contributes to the debate on how
formal and informal institutions can be used to secure property rights and resolve disputes over
land ownership. In particular, this paper examines how the people of Flores, East Nusa Tenggara
Province, settle land disputes among themselves. Many available studies indicate that the residents
of Flores rely heavily on informal land dispute resolution based on adat (customary) law rather
than formal or legal rules. Adat provides certain sense of security and has been proven effective in
resolving conflicts in a relatively closed and homogenous community. Moreover, it offers greater
accessibility, flexibility and legitimacy that support reconciliation process between the disputing
parties.
Isu penegakan hukum merupakan masalah inti dalam perlindungan hak-hak kebendaan atas
tanah. Perlindungan atas hak kebendaan tersebut dapat diberikan baik oleh Negara maupun
oleh aktor-aktor lain selain Negara. Artikel ini fokus pada perlindungan yang diberikan oleh
aktor bukan Negara, yaitu bagaimana masyarakat mampu untuk melindungi hak-hak kebendaan
mereka tanpa keterlibatan institusi Negara. Pertanyaannya adalah,sejauh mana institusi informal
dapat bekerja secara efektif untuk memberikan perlindungan atas hak kebendaan atas tanah?
Artikel ini juga berkontribusi terhadap debat mengenai bagaimana institusi formal dan informal
dipergunakan oleh masyarakat untuk melindungi hak milik mereka dan untuk menyelesaikan
konflik terkait dengan tanah dalam masyarakat. Secara khusus, artikel ini membahas mengenai
bagaimana masyarakat di Flores, Nusa Tenggara Timur mempergunakan hukum adat untuk
menyelesaikan konflik yang terjadi dalam masyarakat. Berbagai penelitian menunjukkan bahwa
masyarakat Flores masih sangat bergantung kepada mekanisme hukum Adat ketimbang hukum
nasional. Hukum Adat terbukti memberikan perlindungan kuat terhadap hak kebendaan dan
dapat mengatasi konflik secara efektif, terutama dalam sebuah komunitaskecil yang homogen.
Selain itu, hukum Adat memberikan akses yang lebih besar, lebih fleksible, dan memiliki legitimasi
yang kuat dalam proses rekonsilitasi diantara para pihak yang bersengketa."

"Dalam skripsi ini penulis akan membahas mengenai perlindungan hukum bagi pasien di Indonesia ditinjau berdasarkan Hukum Kesehatan, dan pengaturan serta penyelenggaraan penyelesaian sengketa medik melalui mediasi di Indonesia. Bentuk penelitian yang digunakan dalam menulis skripsi ini adalah yuridis normatif, dan tipe penelitian yang digunakan penulis adalah penelitian deskriptif dan peskriptif. Kesimpulannya adalah perlindungan hukum bagi pasien yang mengalami kerugian akibat kelalaian medik dapat diselesaikan melalui penyelesaian sengketa litigasi dan penyelesaian sengketa non litigasi. Penyelesaian sengketa non litigasi yang akan dibahas penulis adalah mediasi, karena mediasi memiliki peran yang penting bagi terwujudnya keadilan yang cepat, sederhana, dan biaya ringan. Mediasi juga dapat mengatasi beban perkara di Pengadilan yang semakin menumpuk. Sarannya adalah agar mediasi hukum kesehatan berkembang di Indonesia, pemerintah harus menyelenggarakan pelatihan mediator khusus yang menangani kasus sengketa medik dan membuat peraturan lebih lanjut pedoman pelaksanaan penyelesaian sengketa medik melalui mediasi.

In this thesis the author will discuss about the legal protection for patients in Indonesia reviewed based on medical law, and regulation and implementation of medical dispute settlement through mediation in Indonesia. The form of research used in writing this thesis is juridical normative, and the type of research used by the author is descriptive and peskriptif research. The conclusion is that legal protection for patients suffering losses due to medical negligence can be resolved through dispute resolution through litigation and dispute resolution through non litigation. The dispute resolution through non litigation that the author will discuss is mediation, since mediation has an important role for the realization of quick, simple, and low cost justice. Mediation can also overcome the burden of cases in the increasingly accumulating Court. The suggestion is that in order for medical law mediation to developing in Indonesia, the government should organize specialized mediator training that handles medical dispute cases and make further regulations for the implementation of dispute resolution through mediation.Keywords Medical dispute, mediation, mediator, medical negligence, responsibility, compensation, hospital.
