"Saat ini perkembangan CFSP bergerak Iambat. CFSP dibentuk oleh Uni Eropa untuk menghadapi tantangan regional dan global, serta berbagai ancaman. Seiring dengan itu, UE juga membentuk European Security and Defence Policy (ESDP) pada tahun 1999. Kenyataannya, ESDP dan CFSP saling terkait sebagai pendekatan keamanan Eropa menghadapi berbagai masalah keamanan di kawasan UE. Dalam artikel ini, penulis berpendapat bahwa CSFP dan EDSP sangatlah penting dan harus menjadi kerangka kerja yang utuh bagi UE karena (1) UE telah menjelma menjadi aktor global. UE harus memiliki CFSP yang komprehensif untuk memainkan peran penting sebagai kekuatan yang harus dilatih dan diperkuat oleh kemampuan pertahan di era politik global, (2) CFSP harus meliputi agenda keamanan UE dan ESDP mencerminkan agenda pertahanan UE, dan (3) UE rnemiliki peran penting, peran global dalam menghadapi isu perdamaian dan keamanan. CFSP merupakan pendekatan yang efektif bagi UE dalam mernainkan peran tersebut."

"This article attempts to identify and asses the weaknesses of the CFSP that have been inherently implicated in substantive and institutional limitations. Critical analysis on this particular issue becomes increasingly important, since the discourse on the CFSP in Indonesia is not well developed in the way that the very nature of the CFSP and its complexities are not properly understood. Having said that this article is particularly aimed at contributing to the development of the discourse on the CFSP in Indonesia. In analyzing this issue,it confines itself to the theoretical views assumed by realists because they would appropriately divulge and address the weaknesses of the CFSP. It also argues that the EU member states, despite their apparent enthusiasm for developing a truly CFSP, are reluctant to fully give up their national sovereignty over foreign and security policy. Since the CFSP can be only seen as reflection of the interests or EU Member States,it is very difficult to put any limits on the foreign policy initiatives of the member states, to shape their interests or bring them to stick to the common framework .In conclusion,this article suggests that all of these weaknesses are the underlying causes of the incapability of the EU to match today's global challenge."

Balkan conflict caused by the dissolution of Sosialist Federal Republic of Yugoslavia in 1990 which brought about various conflicts both inter-states or interenal conflicts among states of fomrer Yugoslavia. As a region which is contiguous directly to European Union (EU), the existing conflicts in Balkan could influence political stability and security that is developed by EU as "an area of jreedom, security and justice". The solution effort of Balkan conflicts carried out by EU as one of its ideas materialization to unifly Europe in one solid and strong institution European Union.
EU?s policy in solving the conflicts in Balkan region mentioned in Common Foreign and Security Policy (CFSP), namely (i) strengthening "security building" as an effort to prevent conflict and enforcing regional stability by facilitating peaceful and constitutional agreements both through diplomacy or sending peace-keeping forces; and (ii) strengthening ?ins!itution building" or development economic aids with a view to creating an efficient policy-making in line with EU?s standards, with laying agenda of pre-access Balkan region into EU.
It is undeniable that the susceptibility of Balkan region mainly caused by its brittleness of political situation owing to the fall of communism which ended the cold war in 1990 and hardening the existed ethnic conflicts in the region. Dark history of inter-ethnic conflicts brought about by the existing copious ethnicities nationalism led to tragedy of ?ethnic cleansing" in Croatia and Bosnia-Herzegovia by Yugoslav ruler. lt was depicting how strong the situation and condition with nuance of "ethnopolirics " in Balkan region.
At the outset, EU regarded that the Balkan conflicts as domestic regional problem which may solved by its own region. However, for the sake of regional stability and security, EU was urged to take part more actively in the solution of Balkan conflict. Through CFSP, EU was demanded to be able to settle Balkan conflicts comprehensively through ?secw-ity and development? (soft politics) and ?de_nends? (hard politics) policies. Notwithstanding, the solution of various conflicts faced by Balkan states still leit problems which any time can come up and become new conflicts that EU will cope with the future.

"Tesis ini bertujuan menganalisis mengenai pertanyaan penelitian, mengapa Benelux melakukan kerjasama keamanan untuk memperkuat Common Foreign and Security Policy (CFSP) Uni Eropa'Bagaimana Benelux mendukung kebijakan Uni Eropa dalam merespons perang Rusia-Ukraina (2014-2022), serta pendekatan apa yang dilakukan Benelux untuk itu. Penelitian ini menggunakan metode kualitatif dengan deskriptif analitik dengan menganalisis data-data yang bersumber dari data sekunder. Penelitian ini menggunakan empat level analisis teori Regional Security Complex oleh Barry Buzan dan menggunakan konsep keamanan kooperatif di tiap tingkat analisis tersebut. Temuan penelitian ini, Benelux dalam mendukung CFSP Uni Eropa dalam merespons perang Rusia-Ukraina belum kolektif secara institusional. Faktor kepentingan domestik Benelux tetap menjadi pertimbangan masing-masing negara. Selain itu ketergantungan Benelux terhadap Uni Eropa sebagai suatu kekuatan, sangat penting dalam menjaga stabilitas keamanan Benelux.

This thesis aims to analyze the research question, why is the Benelux conducting security cooperation to strengthen the EU CFSP? How the Benelux supported the EU's policy in response to the Russian-Ukrainian war (2014-2022), as well as what approach the Benelux took to it. This research uses a qualitative method with descriptive analytics by analyzing data sourced from secondary data. This study used four levels of analysis of the theory of the Regional Security Complex by Barry Buzan and used the concept of cooperative security at each level of analysis. The findings of this study, the Benelux in supporting the EU CFSP in responding to the Russian-Ukrainian war have not been institutionally collective. The factor of domestic interests of the Benelux remains the consideration of each country. In addition, the Benelux's dependence on the European Union as a power, is very important in maintaining the security stability of the Benelux."

"[ABSTRAK
Tesis ini berjudul Analisis Perlindungan Hukum Bagi Pembuat Kebijakan Di Bank Indonesia Dalam Menjalankan Fungsinya Sebagai Lender of The Last Resort. Tugas sebagai Lender of The Last Resort (LoLR) merupakan tugas yang melekat dalam sejarah keberadaan bank sentral. LoLR dalam sistem keuangan Indonesia ditujukan untuk membantu bank-bank yang mengalami kesulitan likuiditas dan berfungsi untuk mencegah terjadinya krisis keuangan yang sistemik. Sebagai bank sentral, tugas LoLR tidak lepas dengan tugas dan kewenangan Bank Indonesia. Namun demikian, dalam pelaksanaan tugas LoLR ini beberapa kali pembuat kebijakan di Bank Indonesia terkait dengan kasus hukum.
Oleh karena itu, perlindungan hukum bagi para pejabat pengambil kebijakan atau keputusan di Bank Indonesia sangatlah penting, apalagi kebijakan erat kaitannya dengan diskresi yang apabila menyangkut urusan pemerintahan akan lebih mengutamakan pencapaian tujuan sasarannya (doelmatigheid) daripada legalitas hukum yang berlaku (rechtsmatigheid).
Terdapat 2 (dua) permasalahan yang dikaji dalam penelitian ini yaitu bagaimana pengaturan perlindungan hukum bagi pembuat kebijakan di Bank Indonesia dan bagaimana ketentuan perlindungan hukum yang diberikan kepada pegawai dan pejabat pengambil keputusan dengan ketentuan yang berlaku. Penelitian dalam tesis ini adalah penelitian hukum normatif yang bersifat deskriptif analitis dengan menggunakan pendekatan undang-undang dan ketentuan serta analisis konsep hukum. Bahan hukum yang digunakan terdiri dari bahan hukum primer berupa perundang-undangan dan ketentuan, bahan hukum sekunder berupa literatur yang berkaitan dengan permasalahan, dan bahan hukum tersier berupa kamus hukum dan artikel.
Bentuk pengaturan hukum terhadap perlindungan hukum diatur dalam Pasal 45 Undang-Undang No. 23 Tahun 1999 Tentang Bank Indonesia sebagaimana telah diubah beberapa kali terakhir dengan Undang-Undang Republik Indonesia Nomor 6 Tahun 2009 dan Peraturan Bank Indonesia Nomor No.11/10/PDG/2009 tentang Bantuan Hukum. Perlindungan hukum ditujukan untuk menciptakan suasana kerja yang kondusif guna meningkatkan kinerja pelaksana tugas kedinasan Bank Indonesia dalam menghadapi permasalahan hukum yang semakin kompleks dan berkembang. Prinsip penyediaan perlindungan hukum adalah bahwa pegawai atau pejabat BI tidak dapat dihukum atas pelaksanaan tugas dan wewenangnya atau karena telah mengambil keputusan yang diperlukan dalam melaksanakan tugas dan wewenangnya, sepanjang dilakukan dengan itikad baik dan sesuai dengan peraturan perundang-undangan.

ABSTRACT
This thesis entitled Analysis of Legal Protection for Policy Makers in Bank Indonesia on Doing of Its Function as Lender of the Last Resort. The task as Lender of Last Resort (LoLR) is embedded in the existence of the central bank's history. LoLR in Indonesia's financial system aims to help banks experiencing liquidity problems and serves to prevent a systemic financial crisis. As a central bank, LoLR cannot be separated with the duties and authority of Bank Indonesia. However, in the execution of LoLR several times policy makers in Bank Indonesia related to the legal case.
Therefore, legal protection for officials or policy makers in Bank Indonesia is very important, moreover policy is closely related to discretion regarding the affairs of government will prioritize the achievement of the target objectives (doelmatigheid) rather than the legality of applicable law (rechtsmatigheid).
There are two (2) issues examined in this research is how the legal protection arrangements for policymakers in Bank Indonesia and how the legal protection that is given to employees and decision makers with applicable regulations. The research in this thesis is a normative legal research that is descriptive analytical approach by using legislation and regulations as well as analysis of legal concepts. Legal materials consisted of primary legal materials in the form of legislation and regulations, secondary legal materials in the form of literature related to the problems, and tertiary legal materials in the form of legal dictionaries and articles.
Form of legal regulation of the legal protection provided for in Article 45 of Law No. 23 of 1999 concerning Bank Indonesia as amended several times, most recently by the Law of the Republic of Indonesia Number 6 of 2009 and Regulation of Bank Indonesia Number 11/10 / PDG / 2009 on Legal Assistance. Legal protection is intended to create a working atmosphere which is conducive to improve the performance of executing official duties of Bank Indonesia in the face of increasingly complex legal problems and develop. The principle of the provision of legal protection is that BI‟s employee or official cannot be punished for the implementation of tasks and authority or for taking the necessary decisions in carrying out its duties and authorities, all done in good faith and in accordance with legislation., This thesis entitled Analysis of Legal Protection for Policy Makers in Bank Indonesia on Doing of Its Function as Lender of the Last Resort. "Bank Indonesia adalah otoritas moneter tertinggi di Indonesia. Bank Indonesia bertanggung jawab untuk memelihara kestabilan kondisi moneter nasional. Untuk mewujudkan hal tersebut bank Indonesia diberikan beberapa wewenang, salah satunya adalah wewenang BI sebagai Lender of Last Resort. Bank Indonesia dalam hal ini memiliki wewenang untuk memberikan pinjaman jangka pendek kepada bank yang memiliki kesulitan likuiditas. Bank Indonesia dalam menjalankan wewenangnya tersebut diberikan status independen, lepas dari pengaruh pihak manapun. Akan tetapi independensi Bank Indonesia tidak berarti Bank Indonesia tidak dapat dimintai pertanggungjawaban manakala dalam menjalankan wewenangnya tersebut terdapat indikasi pelanggaran hukum. Bank Indonesia harus mempertanggungjawabkan wewenang mereka kepada DPR, BPK, dan masyarakat.

Bank Indonesia is Indonesia's monetary authority. Bank Indonesia has the responsibilities to maintain the stability of national monetary condition. Bank Indonesia to do such responsibilities had given some powers by the law, one of it is the power as Lender of Last Resort. Bank Indonesia, as the Lender of Last Resort, have the right to give banks a short term loan to solve their liquidity problem. Bank Indonesia to exercise their power has given a independent status, a status that ensured that BI can not be affected by other party. On the other hand, Bank Indonesia independent status doesn?t mean that BI can not be requested for their responsibility if there are indication that their policy was against the law. Bank Indoensia must gave such responsibility to the DPR, BPK, and the people."
