"Penelitian ini berdasarkan kepada pemikiran Imam Al-Mawardi terkait dengan persyaratan dan sistem pemilihan kepala negara dibandingkan dengan ketentuan yang ada di dalam Undang-Undang Dasar Negara Republik Indonesia Tahun 1945. Penelitian ini membahas tiga permasalahan. Pertama, pemikiran Imam Al-Mawardi tentang persyaratan dan sistem pemilihan kepala negara. Kedua, perbandingan pemikiran tersebut dengan ketentuan yang ada di Undang-Undang Dasar Negara Republik Indonesia Tahun 1945. Ketiga, penerapan pemikiran Imam Al-Mawardi di Indonesia. Metode yang digunakan adalah yuridis normatif yang menggunakan data sekunder dengan pendekatan perbandingan. Hasil penelitian ini adalah sistem pemilihan kepala negara menurut Imam Al-Mawardi dapat melalui mekanisme musyawarah dan penunjukkan oleh kepala negara sebelumnya. Pemikiran Imam Al-Mawardi tentang sistem pemilihan kepala negara akan sulit diterapkan di Indonesia karena perbedaan yang mendasar terkait dengan bentuk negara, hukum dasar yang berakibat berbedanya sistem pemilihan kepala negara. Lalu, pemikiran Imam Al-Mawardi tentang persyaratan pencalonan dapat dimasukkan sebagian karena tidak bertentangan dengan persyaratan pencalonan kepala negara yang berlaku di Indonesia.

This research was based on the toughts of Imam Al-Mawardi system requirements related to the elevtion of the head of state compared with the provisions of the constitution of the Republic of Indonesia in 1945. First, thought of Imam Al-Mawardi about requrements and the systems of election of the head of State. Second, the tought-provoking with existing provisions in the Constitution of The Republic Indonesia in 1945. Third, the application of the thought of Imam Al-Mawardi in Indonesia. The method used is normative legal research approach to secondary data use comparisons.

The results of this research is the head of State electoral system according to Imam Al-Mawardi can be through mechanisms of deliberation and the appoinment by the previous head of state. Imam Al-Mawardi thinking about electoral systems the head of State will be difficult to apply in Indonesia due to differences associated with the fundamental form of the Basic Law of The State, which resulted in different electoral systems the head of State. And then, the thought of Imam Al-Mawardi abaout candicacy requirements can be incorporated in part because it does not conflict with the requirements of the nomination of the head of State in Indonesia."
