"Penelitian skripsi ini dilakukan dengan menganalisis permasalahan hukum tertuang dalam Time Charter Party dan Voyage Charter Party PT PIS Melawan Prinsip hukum transportasi laut Indonesia, dengan metode penelitian yuridis normatif. Landasan teori yang digunakan dalam penelitian skripsi ini adalah teori hukum angkutan laut dan teori hukum perjanjian. Hasil Penelitian menunjukkan bahwa bentuk standar Time Charter Party dan Voyage Pihak Piagam PT PIS belum memenuhi ketentuan dalam Undang-Undang Nomor 17 Tahun 2008 tentang Pelayaran, juga Kode Hukum Dagang Kode Hukum Perdata. Ini ditunjukkan dengan adanya enam pasal-pasal Partai Piagam Waktu dan lima pasal Partai Piagam Pelayaran memiliki ketentuan yang berbeda dengan ketentuan dalam UU Nomor 17 Tahun 2008 tentang Pelayaran, Kitab Undang-Undang Hukum Dagang, dan Kode Sipil. Saran yang bisa disampaikan kepada pihak yang mengeluarkan formulir perjanjian piagam standar untuk memenuhi syarat melakukan tinjauan terhadap klausul formulir standar dan menyesuaikannya dengan prinsip hukum perhubungan laut Indonesia.

This thesis research is conducted by analyzing legal problems contained in the Time Charter Party and Voyage Charter Party of PT PIS Against the principles of Indonesian sea transportation law, using the method normative juridical research. The theoretical basis used in this thesis research is sea transportation law theory and agreement law theory. The results show that the standard forms of Time Charter Party and Voyage of PT PIS Charter Parties have not met the provisions in Law Number 17 of 2008 concerning Shipping, as well as the Code of Commercial Law, Code of Civil Law. This is indicated by the existence of six articles of the Time Charter Party and five articles of the Shipping Charter Party which have different provisions from the provisions in Law Number 17 of 2008 concerning Shipping, the Code of Trade Law, and the Civil Code. Suggestions can be conveyed to the party issuing the standard charter agreement form to fulfill the requirements to review the clauses of the standard form and adapt them to the principles of Indonesian sea transportation law."

"This article compares Indonesia legal system and Malaysian legal system. The government legalized Islamic law in national legislations, which are in effect for Muslim people. To facilitate dispute settlement, there is a religious court to solve Islamic dispute based on Islamic law. The existence of Islamic law in Indonesia and Malaysia has similarity and differentiation. The similarties among others are: the Muslim-majority in both countries pushes the government to put Islamic law into force, Islamic law must be written into constitution or legislation. It is needed to have legal basis when performing Islamic law, the existence of religious court is very important in dispute settlement related to Islamic law. The influence of western legal system is very strong in national legal system. Nevertheless, the western legal system differs substantially from Islamic legal system, and Islamic law was implemented limitedly based upon western legislation. It was limited to family law. While the differentiations are: the way of implementation of western legal system into national legal system and the form of legislation. Indonesia has one legislation, which is in effect to all of Indonesia people. On the contrary, Malaysia has many enactments, which are different from one to another in each negeri."

"Disertasi ini membahas penyusunan ruang lingkup, materi dan narasi pengajaran sejarah Indonesia dalam kurikulum 1964-2004. Penelitian menyimpulkan bahwa penyusunannya sangat dipengaruhi konsep stabilitas yang dinamis sehingga perbaikan kurikulum sejarah tidak mengubah formulasi yang menekankan pemberian legitimasi kekuasaan dan pengulangan materi pengajaran sejarah Indonesia. Penelitian ini mengusulkan tiga perubahan formulasi. Pertama, perubahan dari pemberian legitimasi kekuasaan ke penguatan jati diri dan integrasi bangsa. Kedua, perubahan cara pandang yang menempatkan sejarah lokal dari peretak ke perekat bangsa. Ketiga, perubahan ruang linngkup dan materi pengajaran sejarah di SD, SMP dan SMA dari pengulangan ke berkelanjutan.

This dissertation examines the construction of scope, content, and narration in teaching of Indonesian history in Curriculum 1964-2004. The result of this research shows that the construction has been very influenced by the dynamic stability concept so that the revision of teaching of Indonesian history has not changed the formulation that emphasize to give legitimization of power, and to repeat the content of teaching. This research proposes three changing. The first is giving of legitimization of power to national identity and integrity. The second is world view to local history from disintegration to integration factor. The third is scope and content of teaching of Indonesian history at SD, SMP, and SMA from repetition to continuity."
