"Abstrak
Makalah ini bertujuan untuk mendeskripsikan/menjelaskan undang-undang pidana yang mengatur kejahatan/kekerasan di wilayah domestic, dan permasalahan yang muncul di Indonesia. Kajian ini menggunakan metode perbandingan yaitu membandingkan substansi hukum pidana Indonesia dengan hukum pidana Malaysia. Focus kajian pada masalah pokok hukum pidana substantive, khususnya perbuatan, sanksi pidana dan permasalahan yang terjadi. Hasilnya menunjukkan bahwa Malaysia dan Indonesia telah memiliki peraturan hukum pidana tentang kekerasan domestic, Indonesia diatur dalam UU No. 23 Tahun 2004 tentang Penghapusan Kekerasan dalam Rumah Tangga (UU PKDRT), dan Malaysia diatur dalam Domestic Violence Act 1994 amademen 20 Februari 2012. Perbandingan yang singkat ini dapat dimanfaatkan sebagai bahan pembaharuan hukum pidana."

"Protection issues of children's rights in Indonesia has not received sufficient attention. Law4 of 1979 concerning child welfare, and No. 23 of 2002 on the protection of children. Children'srights, such as the right to life, the right to protection from the threats to her own safety, the right to equality in education, employment, health, the right to employment, the right to meet the needs of food, clothing and shelter. Quantitatively, the number of street children in the city of Padang in the last ten years has increased. This research provides in-depth information about the various forms of violence experienced by street children in the city of Padang. This study was conducted in five point activity gathering place and street children in the city of Padang.The study found that violence to street children and some factors which it caused the violence.Demoralization among street children is a reaction to a situation that is very limited and therigors of life on the streets. It is difficult to make strict limits on the morality of the group of street children. All forms of violence experienced by children and street, is a phenomenological reality for street children and a variety of social interactions that occur among street children in it loaded with a cargo of reciprocity, and can be seen as a form of social safety networks."

"In this article the author looks into social conflict and alternative solutions to the problem. He begins by discussing the merits of a conflict model in viewing society, as expounded by Dahrendorf, Bailey and others. The author argues that, in contrast, the New Order Regime of Indonesia followed a model of equilibrium, characteristic of most pseudo-democratic or authoritarian states. With an emphasis on gotong royong. uniformity, balance and harmony, any move toward individuality or anti-stability was seen as having no function in the maintenance of the system. Holding to this latter model, any view deviating from official policy was removed. Different views could only be expressed by those with power, who were in fact those in power. By setting the rules of the game, their own views were never seen as a form of deviation. This led to the emergence of conflict between various groups, whereby some were stripped of their identities, dignity and/or material resources in the interest of the state or more powerful groups. Conflicts between ethnic groups present a special problem, because any attack on the group is seen as an attack on the individual, and vice versa. The author suggests that with a conflict model, differences are a given, and conflicts give rise to competition where there exist rules for competition that are fair and well-enforced. These rules must be enforced by an impartial police. However, the incorporation of the police into the Indonesian military for the past 32 years has placed emphasis on the use of military tactics for resolving conflict. In fact, one solution to the problem of conflict is the presence of one institution or organization that can be trusted and depended upon by all parties involved; and this should be the police."

"ABSTRAK
Pembinaan hukum nasional masih sangat dipengaruhi oleh prinsip "legalitas" merupakan kenyataan yang menyebabkan banyak masalah-masalah sosial kemasyarakatan tidak terjangkau oleh hukum.
Salah satu masalah itu adalah "tindak kekerasan terhadap perempuan dalam keluarga" yang jika dipandang dari gaya stelsel hukum nasional, bukan suatu bentuk kejahatan (dalam bidang hukum pidana) dan bukan suatu perbuatan melanggar hukum (dalam bidang hukum perdata) karena tindak kekerasan ini memiliki ciri khas yakni "berbasis jender".
Para ahli hukum modern seperti Joanne Belknap dan Katharine T Bartlett yang tergolong kaum feminis barat mulai neninggalkan prinsip legalitas dan melakukan pembaharuan hukum dengan pusat perhatian pada "keluwesan" suatu perundang-undangan agar hukum dapat mengikuti dinamika masyarakat.
Dinamika gerakan perempuan dalam masyarakat mulai mempertanyakan seberapa jauh hukum dapat mengayomi hak-hak asasi perempuan dan mampukah hukum melindungi kaum perempuan dari perbuatan tindak kekerasan dalam keluarga.
Hasil penelitian ini menunjukkan bahwa tindak kekerasan terhadap perempuan dalam keluarga tidak bisa ditindaki dengan KUHP saja atau Undang-undang Perkawinan saja karena faktor-faktor penyebab terjadinya tindak kekerasan ini memiliki peranan yang kuat balk terhadap pelaku, korban dan penegak hukum mengenai kedudukan perempuan yang masih tersubordinasi dan terdiskriminasi oleh hukum.
Upaya pencegahan dan penanggulangan kekerasan terhadap perempuan penlu dilakukan dengan cara mensosialisasikan Deklarasi PBB tentang Penghapusan tindak kekerasan terhadap perempuan dan dibantu dengan pendekatan viktimologi dan kriminologi serta pendekatan hukum yang berperspektif perempuan.
