"Dengan diterbitkannya Peraturan Komisi Pengawas Persaingan Usaha ("KPPU") Nomor 2 Tahun 2009 tentang Pedoman Pengecualian Penerapan Undang-Undang No. 5 Tahun 1999 tentang Larangan Praktek Monopoli dan Persaingan Usaha Tidak Sehat terhadap Perjanjian yang Berkaitan dengan Hak Atas Kekayaan Intelektual, maka telah ada sebuah pedoman dari ketentuan Pasal 50 huruf b Undang-Undang No.5 Tahun 1999, dimana terdapat pembatasan pengecualian dari Pasal tersebut. Berdasarkan Peraturan tersebut, KPPU dapat memeriksa hal terkait dengan perjanjian lisensi atas dugaan pelanggaran Undang-Undang Nomor 5 Tahun 1999 apabila terjadi penolakan pemberian lisensi yang terkait essential facilities serta apabila suatu perjanjian lisensi HaKI klausul exclusive dealing yang mengakibatkan praktek monopoli dan persangan usaha yang tidak sehat.

With the issuance of Business Competition Supervisory Commission ("KPPU") Regulation Number 2 Year 2009 concerning Guidelines on the exception of application of Law Number 5 Year 1999 concerning Prohibition of Monopolistic Practices and Unfair Business Competition, thus there has been a guidance for Article 50 letter b of Law Number 5 Year 1999, where there are limitations pursuant to that Article. KPPU may examine any intellectual property right license agreements upon allegation of violation of Law Number 5 Year 1999, if there is refusal to license regarding essential facilities and if the license contains exclusive dealing clause which can cause monopolistic practices and unfair business competition."

"There are several substantial problems remain on intellectual property rights in the focal society of Indonesia. The needed for the protection of intellectual property did not come from the civil society itself but from the pressure of external factor. Intellectual Properly Regime is also known as capitalistic regime and that is the problem. The protection is given to the one who own the right, not for the real author. The characteristic of intellectual property is to protect individually. In the other hand, the background of local society of Indonesia, V which consists of many tribes, lived based on communalistic, The opposite of concept did not avoid Indonesia for taking a step into ratification of international instruments of intellectual property rights protection. The reason behind is the position of Indonesia as a developing country which has powerless bargaining position put side by side with developed countries. This article attempts to offer another point of view to find out what is the real matter, the root of the problems, why intellectual property regime can not be implemented well in Indonesia."
