Since the 19th century Western Law has entered the Islamic world so that there are three types of states in positioning Islamic Law, some use Islamic law as a formal legal system, some replace Islamic law fully with secular law, and some use secular law but still use Islamic law side by side with Islamic Law. Saudi Arabia is included in the first category of countries while Indonesia is included in the third category. The author here will discuss the comparison of banking institutional arrangements in Indonesia and Saudi Arabia along with their implementation with a comparative legal framework. The method used is a literature study and interview, by examining primary and secondary legal materials found in Indonesia and Saudi Arabia related to banking law, the primary and secondary legal materials are then described and analyzed for comparison within a comparative legal framework. The results of this study are similarities and institutional differences in banking systems in Indonesia and Saudi Arabia, namely the dual banking system, namely Islamic banks and conventional banks go hand in hand, and there is a Sharia Business Unit which is part of conventional banks that run sharia businesses. Indonesia has Bank Indonesia and OJK to regulate and supervise all banking, Saudi Arabia only has SAMA to supervise all banks, sharia banks depend on each scholar in each Islamic bank. Banks in Indonesia must understand what this difference is if they want to cooperate with banks from Saudi Arabia."

"Islamic Banking will be about the nature of risk in Islamic banking and the regulatory framework which includes capital adequacy, corporate governance, transparency and risk associated with Islamic banking. The book will cover materials about Islamic banking and also will show how each of these issues defers from the non-Islamic Banking, shading light on the effect of the global economic crisis on Islamic banks vs. conventional banks. It will discuss history and development, the nature of risk, the importance and role of capital, corporate governance and transparency, the salient features of Islamic banking that distinguishes it from non-Islamic banking, and the development of the regulatory bodies and supervisory agencies that support the Islamic banking system. The book will try to give answers to questions such as: Is the existing regulatory framework sufficient enough to - Ensure safe and sound banking system? Face the inherent risk associated with Islamic banking? Prevent systemic risk in the banking system? The book concludes with discussions on (1) the relationship between the Islamic banking regulators and the western regulators, and (2) the obstacle and challenges from regulatory prospective that faces the Islamic banking"

"The Handbook of Islamic Banking comprises 25 studies by leading international experts on Islamic banking and finance specially commissioned to analyse the various debates and the current state of play in the field.
From its origins thirty years ago, Islamic banking has expanded rapidly to become a distinctive and fast growing segment of the international banking and capital markets. Despite this expansion, Islamic banking still remains poorly understood in many parts of the Muslim world and continues to be a mystery in much of the West. This comprehensive Handbook provides a succinct analysis of the workings of Islamic banking and finance, accessible to a wide range of readers. At the same time, it seeks to bring the current research agenda and the main issues on Islamic banking before a wider audience.
Islamic banking offers, as an alternative to conventional interest-based financing methods, a wide variety of financial instruments and investment vehicles based on profit-and-loss sharing arrangements. These are all explored in detail along with other subjects such as governance and risk management, securities and investment, structured financing, accounting and regulation, economic development and globalization.
M. Kabir Hassan, Mervyn Lewis and the other contributors have created an authoritative and original reference work, which will contribute to a wider understanding of Islamic banking as well as provoking further discussion and research. It will be invaluable to all scholars, researchers and policymakers with an interest in this subject."
