Restorative justice, sebagai alternatif penyelesaian konflik yang berfokus pada pemulihan korban dan tanggung jawab pelaku, menjadi relevan dalam konteks KDRT yang seringkali menimbulkan trauma berkepanjangan bagi korban. Sebagai metode yang informal, terdapat banyak tantangan dan kekurangan dalam praktik formalisasi Restorative justice sebagai alternatif penyelesaian kasus KDRT. Oleh karena itu, penelitian ini bertujuan untuk menjadi kritik terhadap formalisasi tersebut dengan harapan dapat terwujudnya sistem dan dasar hukum yang lebih jelas di kemudian hari. Metodologi penelitian ini menggunakan pendekatan kualitatif dengan teknik wawancara mendalam dan observasi partisipatif. Data dikumpulkan dari berbagai sumber, termasuk aparat penegak hukum, korban KDRT, serta dokumen resmi terkait penerapan restorative justice. Hasil penelitian menunjukkan bahwa penerapan restorative justice dalam penyidikan KDRT oleh Polri di Polres Metro Bekasi Kota sudah sesuai prosedur yang berlaku. Namun, peraturan tersebut belum dapat mengakomodir dinamika dan komplesitas yang ada dalam kasus KDRT. penelitian ini juga menemukan tantangan dalam penerapan yang konsisten, terutama terkait dengan keterbatasan sumber daya dan pelatihan bagi anggota Polri. Kesimpulan dari penelitian ini menegaskan pentingnya penguatan kapasitas aparat penegak hukum dalam menerapkan prinsip-prinsip restorative justice secara efektif. Selain itu, penelitian ini memberikan rekomendasi untuk pengembangan kebijakan yang mendukung penerapan restorative justice dalam penanganan kasus KDRT, dengan tujuan akhir untuk meningkatkan kesejahteraan dan keadilan bagi korban.

Restorative justice, as an alternative conflict resolution approach that focuses on victim recovery and offender accountability, becomes relevant in the context of domestic violence (DV), which often causes prolonged trauma for victims. As an informal method, there are many challenges and shortcomings in the practice of formalizing Restorative justice as an alternative for resolving domestic violence cases. Therefore, this research aims to critique this formalization with the hope of establishing a clearer legal system and foundation in the future. This research methodology uses a qualitative approach with in-depth interview techniques and participatory observation. Data were collected from various sources, including law enforcement officers, DV victims, and official documents related to the implementation of restorative justice. The research findings indicate that the application of restorative justice in the investigation of DV by the police at the Polres Metro Bekasi Kota aligns with the applicable procedures. However, these regulations have not yet fully accommodated the dynamics and complexities present in DV cases. This study also found challenges in consistent implementation, particularly related to resource limitations and training for police officers. The conclusion of this study underscores the importance of strengthening the capacity of law enforcement officers in effectively applying restorative justice principles. Furthermore, this research provides recommendations for the development of policies that support the implementation of restorative justice in handling DV cases, with the ultimate goal of improving the well-being and justice for victims.
