ABSTRAKPerampasan objek jaminan fidusia oleh negara mengakibatkan kepastian atas kedudukan dari objek jaminan fidusia serta kedudukan kreditor penerima jaminan untuk dapat mengeksekusi objek jaminan fidusia ketika debitor gagal melaksanakan kewajibannya menjadi tidak jelas. Hal inilah yang terjadi pada PT Astra Sedaya Finance dan PT Oto Multiartha, objek jaminan fidusia yang mereka terima dinyatakan dirampas untuk negara dalam suatu putusan pidana sehingga mereka pun akhirnya melakukan perlawanan. Penelitian dalam tesis ini menggunakan pendekatan perundang-undangan dengan penggunaan data sekunder. Jaminan fidusia mengakui adanya prinsip droit de suite yaitu jaminan fidusia tetap mengikuti benda yang menjadi objek jaminan fidusia dalam tangan siapapun benda tersebut berada, kecuali pengalihan atas benda persediaan yang menjadi objek jaminan fidusia. Hasil penelitian ini adalah bahwa dengan dianutnya prinsip droit de suite maka walaupun objek jaminan fidusia dirampas oleh negara, kreditor pemegang jaminan fidusia tetap memiliki hak untuk mengeksekusi objek fidusia. Kedudukan kreditor penerima fidusia tetaplah sebagai penerima fidusia yang memiliki hak untuk mengeksekusi objek fidusia ketika pemberi fidusia cedera janji dan benda yang dirampas tersebut tetaplah berkedudukan sebagai objek jaminan yang berfungsi sebagai agunan untuk menjamin pelunasan.

ABSTRACTDeprivation of object of fiduciary by the state lead the certainty of the position of the object as well as the position of the creditor to execute the object when the debtor fails to carry out his obligations becomes unclear. It happened to PT Astra Sedaya Finance and PT Oto Multiartha, the object of fiduciary was declared deprived by the state in a criminal verdict so that they eventually took legal action. The research in this thesis uses the approach of legislation with the use of secondary data. Fiduciary acknowledges the principle of droit de suite. Although the object of fiduciary has been deprived by the state, the creditor who recipient of fiduciary still has the right to execute the object of fiduciary. The position of the creditor who is recipient of fiduciary remains a recipient who has the right to execute the object when the debtor fails to carry out his obligations and the object of the fiduciary remains as collateral to secure repayment.
