ABSTRAKNama:Kunto WibisonoNPM:1506780475Program Studi:Magister HukumJudul:Perlindungan Hukum Terhadap Pekerja Indonesia Yang Mengalami Pemutusan Hubungan Kerja di Kedutaan/Konsulat Asing di Wilayah Indonesia Studi Kasus Keputusan Mahkamah Agung Republik Indonesia No. 673 K/PDT.SUS/2012 Tesis ini membahas perlindungan terhadap pekerja Indonesia yang mengalami pemutusan hubungan kerja di Kedutaan/Konsulat asing yang berada di wilayah Indonesia. Dalam beberapa tahun belakangan ini dunia peradilan di Indonesia sudah mulai bersentuhan terhadap kekebalan diplomatik dari perwakilan diplomatik khususnya dalam perkara pemutusan hubungan kerja termasuk didalamnya adalah Putusan MA No. 673 K/PDT.SUS/2012. Timbul sebuah pertanyaan besar ketika menghadapi permasalahan tersebut, yurisdiksi negara manakah yang akan dipakai?. Terjadi perbedaan pendapat dalam menjawab pertanyaan tersebut. Ada yang berpendapat bahwa yurisdiksi kedutaan/konsulat asing lah yang berlaku dengan berlandaskan paham imunitas yang bersumber dari asas extrateritorialitas kemudian ada pendapat lain yang menyatakan yurisdiksi Indonesialah yang berlaku karena permasalahan ketenagakerjaan tidak termasuk hal ndash; hal yang dilindugi dalam imunitas perwakilan diplomatik asing. Pertanyaan lain yang kemudian timbul adalah apakah Pengadilan hubungan Industrial memiliki kewenangan dalam mengadili perkara yang melibatkan perwakilan diplomatik asing. Tesis ini menggunakan metode penelitian normatif yang bersifat explanatoris dengan maksud untuk menguji hipotesa bahwa yurisdiksi Indonesia dapat digunakan untuk menyelesaikan perkara pemutusan hubungan kerja yang melibatkan pekerja Indonesia yang bekerja pada kedutaan/konsulat asing, Tesis ini menggunakan data yang bersifat sekunder dari bahan hukum yang sifatnya primer, sekunder dan tersier. Tesis ini nantinya akan menguraikan dasar ndash; dasar hukum yang menyebabkan yurisdiksi Indonesia dapat digunakan untuk menyelesaikan perkara pemutusan hubungan kerja antara pekerja Indonesia dengan perwakilan diplomatik asing. Tesis ini kemudian juga akan meguraikan bahwa terdapat sebuah celah dimana sebenarnya pengadilan hubungan industrial tidak memiliki kewenangan untuk mengadili perselisihan pemutusan hubungan kerja antara pekerja Indonesia dengan perwakilan diplomatik asing. In recent years the court in Indonesia has begun to contact the diplomatic immunity of the diplomatic representation, especially in the case of termination of employment including the Supreme Court Decision No. 673 K PDT.SUS 2012. Arises a big question when faced with these problems, the jurisdiction of which country will be used . There is a difference of opinion in answering these questions. Some argue that the jurisdiction of the embassy consulate of foreigners who applies to understand the basis of the principle of immunity sourced extrateritorialitas theory. then there is another opinion that jurisdiction of Indonesia applicable because of employment issues are not included in the immunity of foreign diplomatic representatives. Another question which then arises is whether the Court of Industrial relations has the authority to prosecute cases involving foreign diplomatic missions. This thesis research method normative explanatoris with the intent to test the hypothesis that the jurisdiction of Indonesia can be used to resolve the case of termination of employment involving Indonesian workers who work at embassies consulates of foreign, this thesis uses data that is secondary legal materials that are primary , secondary and tertiary. This thesis will outline the basic basic legal cause Indonesian jurisdiction can be used to resolve the case of termination of employment between the worker Indonesia with foreign diplomatic representatives.
