ABSTRAKPenulisan ini membahas mengenai permasalahan keberlakuan Surat Edaran Direktur Jenderal Pajak Nomor SE-26/PJ/2015 yang menegaskan bahwa Nomor Seri Faktur Pajak yang diberikan oleh Direktorat Jenderal Pajak (DJP) hanya dapat digunakan untuk membuat Faktur Pajak pada tanggal Surat Pemberian Nomor Seri Faktur Pajak atau tanggal sesudahnya dalam tahun yang sama dengan kode tahun tertera pada Nomor Seri Faktur Pajak. Faktur Pajak dengan tanggal mendahului (sebelum) tanggal surat pemberian Nomor Seri Faktur Pajak dianggap sebagai Faktur Pajak yang mencantumkan keterangan yang tidak sebenarnya atau tidak sesungguhnya, sehingga merupakan Faktur Pajak Tidak Lengkap. Implikasi dari hal tersebut adalah Pengusaha Kena Pajak (PKP) dikenakan sanksi administrasi yaitu sebesar 2% dari Dasar Pengenaan Pajak (DPP) yang tercantum pada Faktur Pajak tersebut. Kondisi lain yang semakin memperkeruh permasalahan Surat Edaran Direktur Jenderal Pajak Nomor SE-26/PJ/2015 adalah ketentuan Surat Edaran Direktur Jenderal Pajak Nomor SE-26/PJ/2015 sebagai penegasan atas Peraturan Direktorat Jenderal Pajak Nomor PER-24/PJ/2012 diberlaku surutkan sejak adanya penjatahan nomor Faktur Pajak yaitu tahun 2012. Keberlakuan Surat Edaran Direktur Jenderal Pajak Nomor SE-26/PJ/2015 ini secara jelas tidak memberikan kepastian hukum dan mengakibatkan tidak terpenuhinya asas keadilan dan memberikan suatu beban konkert bagi Pengusaha Kena Pajak.

ABSTRACTThis study addresses the issue of the enforcement of circulars No. SE-26/PJ/2015 issued by Director General of Taxes, which emphasize that the tax invoice?s serial number provided by General Directorate of Taxes can only be used for tax invoice which has the same date as tax invoice?s serial number issued by General Directorate of Taxes or on later date in the same year with the code stamped on tax invoice?s serial number. Tax Invoice, which its date has preceded the date of tax invoice?s serial number issued by General Directorate of Taxes is considered as a tax invoice with false information, so it is called as an Incomplete Tax Invoice. As the result, the Taxable Entrepreneurs can be charged with administration charge amounted to 2% of Tax Basis which is mentioned in preceding tax invoice. Another condition which complicates the matter further is the enforcement of Circulars No. SE-26/PJ/2015 issued by Director General of Taxes, which works as the averment of Regulation No. PER-24/PJ/2012 issued by General Directorate of Taxes, applies retroactive since the existence of tax invoice?s serial number provided by Directorate General of Taxes exist in 2012. The enforcement of Circulars No. SE-26/PJ/2015 issued by Director General of Taxes clearly does not provide legal certainty. It also causes the unfulfilled need of the principal of justice and burden for Taxable Entrepreneurs.;;
