ABSTRAKHakim agama dalam menangani perkara perceraian di pengadilan agama memiliki kewajiban untuk mendamaikan para pihak sehingga tidak terjadi suatu perceraian. Usaha hakim untuk mendamaikan para pihak ini merupakan suatu amanah dari Undang-undang nomor 7 tahun 1989 tentang Peradilan Agama jo. Undang-undang No. 3 Tahun 2006 tentang Perubahan Atas Undang-undang No 7 Tahun 1989 tentang Peradilan Agama jo. Undang-undang No. 50 Tahun 2009 tentang Perubahan Kedua Undang-undang No 7 Tahun 1989 tentang Peradilan Agama Pasal 82 ayat (1). Peran hakim sangat krusial sebagai penentu dan pemutus dari suatu perkara yang diajukan kepadanya yang dalam hal ini merupakan keputusan atas suatu kelanjutan suatu perkawinan seseorang. Agar mencapai suatu keputusan yang baik dalam mengadili suatu perkara perceraian hakim semaksimal mungkin harus menciptakan suatu perdamaian sehingga tidak tercipta perceraian, akan tetapi apabila memang perceraian merupakan suatu jalan terakhir yang terbaik maka hakim berkewajiban untuk memutus dengan pertimbangan-pertimbangan yang baik. Pelaksanaan Asas Wajib Mendamaikan bukan merupakan pelanggaran atas kewajiban hakim untuk memeriksa dan memutus perkara yang diajukan ke hadapannya dalam hal penanganan kasus perceraian. Hakim dituntut mengupayakan agar para pihak sebaik-baiknya terjauh dari penjatuhan putusan cerai yang berdampak pada putusnya perkawinan seseorang. Pemberian kelenturan waktu atau penundaan waktu hingga perkara tersebut diperiksa secara materiil menjadi salah satu keleluasaan yang memberi kesempatan para pihak mengadakan perdamaian.

ABSTRACTReligious judges in divorce cases handled in religious courts have a duty to reconcile the parties so that it is not the case of a divorce. Judge's efforts to reconcile the parties, it is a mandate of Act No. 7 of 1989 about Religious Judiciary jo. Act No. 3 of 2006 about changes Of Law No. 7 of 1989 about Religious Judiciary jo. Act No. 50 of 2009 about second amendment law No. 7 of 1989 on Judiciary Religion Article 82 paragraph (1). The role of judges is very crucial as decisive and breaker of a case submitted to him, which in this case is a follow-up to a decision over the marriage of a person. In order to reach a good decision in the case of divorce judges adjudicate a greatest extent may have to create a peace so as not to create a divorce, but if indeed divorce is a last best way then the judge is obliged to break with good considerations. The implementation of the principle of Compulsory Reconcile does not constitute a violation of the obligation of judges to examine and put forward to break the case before him in terms of handling divorce cases. The judge is required to intervene in order for the parties as best as possible the most distant of the overthrow of the ruling of the divorce which resulted in a breakdown in the marriage of a person. Giving the suppleness of the time or the delay time until the review case materially became one of the spaciousness that gives the opportunity the parties held peace.
